As Mary Dyrseth,s letter indicates the City must by resolution approve the
special legislation creating the Rosemount Port Authority. In addition the
resolution must be filed with the Secretary of State.

Delivered to you by facsimile is a resolution for consideration by the City Council
on Tuesday, August 4. The resolution approves the special legislation passed by the 1991
Legislature which authorized the City of Rosemount to create a port authority.
Subdivision 6 of the legislation provided that the law was not effective until after
local approval and filing with the Secretary of State. The local approval certificate has to
be filed with the Secretary of State before the first day of the 1993 legislative session. I
have requested a copy of a local approval certificate from the Secretary of State's Office.
As soon as I receive it, I will send it down toyou. The certificate, along with an
executed copy of the enclosed resolution, should be filed with the Secretary of State's
Office as soon as possible.
As we discussed, in order to be able to use tax increments derived from the
redevelopment tax increment financing district created in 1979 by the Housing and
Redevelopment Authority to help finance the ice arena, it is necessary to enlarge the
boundaries of the redevelopment project area and adopt a new tax increment financing
plan. The following are the procedural steps necessary to accomplish the amendment:
1. Preparation of Amendment to Redevelopment Plan and Tax Increment
Financing Plan.
2. Resolution of City Council setting a public hearing on the amendment of
the Redevelopment Plan and Tax Increment Financing Plan.

3. Thirty day's mailed notice of public hearing to school district and city.
4. Ten day's published notice of public hearing in local paper.
5. Resolution of Planning Commission approving amendment of
Redevelopment Plan.
b. Port Authority resolution approving amendments.
7. City Council resolution approving amendments.
Please let me know when you are ready to proceed with the amendments. I
would be happy to prepare the first draft of the amendment to the Redevelopment PIan
and the Tax Increment Financing Plan as soon as you have the construction cost
estimates.

RESOLUTION 1992 -
A RESOLUTION APPROVING SPECIAL LAW
WHEREAS, the Laws of Minnesota 1991, Chapter 291, Article 21,
Section 17 (the "Act") authorizes the City of Rosemount to
establish a port authority commission;
WHEREAS, Subdivision 6 of the Act provides that the Act is
effective the day after the governing body of the City complies
with Minnesota Statutes, Section 645.021, subd. 3;
WHEREAS, Minnesota Statutes, Section 645.021, subd. 3, provides,
in part, that as soon as the local governmental unit has approved
a special law, the City clerk shall file with the Secretary of
State a Certificate stating the essential facts necessary to
valid approval and a copy of the resolution of approval;
NOW, THEREFORE BE IT RESOLVED, that the Laws of Minnesota, 1991,
Chapter 291, Article 21, Section 17, is hereby approved by the
City council of the City of Rosemount.
BE IT FURTHER RESOLVED, that the City Clerk is hereby directed to
file a certified copy of this Resolution in the office of the
Minnesota Secretary of State as required by Minnesota Statutes,
Section 645.021, subd. 3.
BE IT FURTHER RESOLVED, that all actions previously taken by the
City Council with respect to the Rosemount Port Authority,
3including, but not limited to, the adoption of Resolutions 1991-
53 and 1991-76 are hereby ratified, confirmed and approved.
