The city currently has an ordinance regulating the discharge of "firearms" in the City. This ordinance is not specific enough to cover those situations which have arisen where, in most cases, discharge of firearms is occurring in residential neighborhoods. With the wide diversity in land uses and varying degrees of density in population in the community it is difficult to come up with a blanket statement on firearms use in the City. Our police department has already discussed some options on the revision of the ordinance and Councilmember Staats has offered his assistance in reviewing the ordinance and drafting something acceptable which will meet the concerns of most. There is a difficulty with existing situations where homeowners have constructed their own firing ranges in residential (RR) neighborhoods. These situations may be extremely difficult to manage under a "area" restriction and we must be aware of those when we discuss "area" definitions for enforcement. At your direction the Police Department and the City Attorney will work with others to prepare a draft ordinance for your consideration. RECOMMENDED ACTION: Motion to direct the to review options for the revision of the discharge of firearms in the City and to revision on September 15, 1992. COUNCIL ACTION: Police Chief and Councilmembers ordinance regulating the present proposals for its 7-5-1 CHAPTER 5 FIREARMS' SECTION: 7-5-1: Definitions 7-5-2: Shooting Restrictions 7-5-2 7-5-1: DEFINITIONS: ENCASED Any weapon included in the definition of FIREARM "shooting" which is dismantled in such a manner as to prevent shooting of the same. LANDOWNER Any person, group, firm or corporation owning, leasing or legally controlling any lands within the territorial limits of the City. PERSON Any individual, regardless of age or residence. SHOOTING The firing of firearms of any kind whatsoever regardless of the method of propulsion of the ammunition; including but not limited to the firing of shotguns, rifles and pistols. 7-5-2: SHOOTING RESTRICTIONS: The shooting or carrying of firearms which are not encased or dismantled shall be restricted to the following circumstances within the territorial limits of the City: A. A landowner or his guest, by written permission to be carried on the person of said guest may shoot or carry a firearm upon lands owned by said landowner, provided that no shot, bullet or other ammunition used shall pass beyond the boundaries of his property nor in any event create a nuisance or danger to other persons. B. By law enforcement officers in the line of duty. 1. Shooting range provisions are contained in Title 3, Chapter 2A of this Code; firearms in parks provisions are contained in Section 4-3-4 of this Code. 7-5-2 7-5-2 C. By a person discharging any firearm when done in the lawful defense of a person, property or family or the necessary enforcement of the law. D. By any person discharging firearms on a licensed rifle range, trap range or target range within the City. All other shooting of firearms in the City is prohibited. (XIV.6, 10-4-77)
