This item is back on the agenda for your consideration and final adoption.
The Smoke Free Policy, proposed to restrict the smoking of tobacco products
in any City owned building and vehicle was first proposed for your
consideration at the July 7th council meeting.
It was decided that the policy had merit and that other groups should
provide input into the consideration of the policy before the City Council
would take final action to adopt it.
Since July 7th the Park and Recreation Committee, the Utilities Commission
and the Fire Department have reviewed the policy and provided input. Not
all comments were fully supportive and some comments suggested that if
there was some space at City Hall to provide a place for people to smoke
without bothering non-smokers we should attempt to accommodate.
Other than that the feedback was supportive and accepting of the proposed
policy.
Based on the discussion held by the City Council and the feedback of other
Commissions and employees I would recommend your adoption of AD -5, "Smoke
Free Policy".
One major change has been incorporated into the policy since it was
provided to you in July. The initial draft allowed for smoking in city
vehicles under certain circumstances. This section of the policy has been
revised to eliminate this option and causes City owned vehicles to be
totally "smoke free".
A second minor change was made to clarify that "buildings" included such
areas as pump houses, manholes and storage buildings. This change was
suggested by the Utilities Commission. Their concern was for those working
in confined spaces.
RECOMMENDED ACTION:
MOTION to adopt City of Rosemount Policy AD -5, "Smoke Free Policy"
effective October 1, 1992.

The City of Rosemount is dedicated to providing healthy,
comfortable, public facilities for its citizens and visitors and
a healthy, comfortable, and productive work environment for its
employees. Medical evidence clearly shows that smoking is
harmful to the health of smokers. Long-term exposure to second-
hand smoke may seriously threaten the health of a non-smoker.
In an effort to consider the needs and concerns of smokers
and non-smokers alike, this City's Smoke Free Policy will take
effect on October 1, 1992.
POLICY
This policy provides that all City buildings, structures and
vehicles in their entirety, shall be designated as Smoke Free,
meaning that no person will smoke tobacco or other substances
while in such City facilities.
PROCEDURE
All City Buildings, structures, and vehicles in their
entirety, are designated Smoke Free effective October 1, 1992.
1. Public notification will be accomplished through
appropriately placed signs within City facilities.
2. A copy of this policy statement will be provided to each new
and existing employee and all standing commission members
and City Councilmembers.
3. Copies of this policy will be placed on bulletin boards or
otherwise appropriately displayed.

RESPONSIBILITY
The success of this policy depends upon the thoughtfulness,
consideration, and cooperation of smokers and non-smokers.
Violations of this policy should be brought to the attention of
the appropriate supervisor. Any disciplinary action will be
taken in accordance with the City's Personnel Policy.
AUTHORITY
The Minnesota Clean Indoor Act, M.S. 144.411-417, effective
July 1, 1975, and the Minnesota heart and Lung Law, M.S. 176.011,
Subd. 15. Approved by the Rosemount City Council on August 18,
1992.
