At the June 2, 1992 Council at Staff's recommendation authorized a
contract to be entered into for the repair of the Fire Hall roof.
This contract was contingent upon the contractor furnishing a
performance bond in the amount of the contract to guarantee the work
would be completed. The contract was to be 'awarded to Water Tight
Systems, Inc. of St Cloud.
This contractor has been unable to obtain the necessary bond. I have
offered alternatives such as a letter of credit or cash escrow
account, but none of the required forms of surety are obtainable by
Water Tight Systems. They were given until 10:00 a.m. Monday,July
113, 1992 to produce the bond or alternative and they failed to comply.
It is now my recommendation, after discussion with City Administrator
Jilk and City Attorney Mike Miles, that we award the contract to the
next responsible bidder, All Systems Roofing, Inc. for the Fire
Station roof only. We will quote and do the Well Houses at a,
different time.
The original contract amount was to be $51,000.00 for the Fire
Station, $3,996.00 for Well House #3 and $3,435.00 for Well Station #6
for a total of $58,431.00. The new contract, as per my
recommendation, will be $58,575.00.
Reference checks have indicated an ability of the succeeding
contractor to Obtain the necessary bonding

Dear Todd:
Thank you for the update ''you provided me by telephone on July 15, 1992 regarding
Water Tight Systems, Inc. contact security. They have failed to produce a
performance bond, letter of credit or cash escrow by 10:00 a.m., July 13, 1992 as
they had been instructed to do. I feel we have been very fair and patient with them
in providing alternatives and ample time for them to obtain some form of security for
performance.
At this time the City of Rosemount has no alternative but to award the contract to
the next responsible bidder. Please notify Water Tight Systems, Inc. in writing of
our actions and require them to remove all materials that have been delivered to the
site no later than July 31', 1992.
I will be informing the City Council of our actions at their next meeting on July 21,
1992. Pending their concurrence with my recommendations, I will then have you
notify All Systems Roofing, Inc. of the award to them so they can obtain the
necessary bonding. In the mean time please check references of All Systems
Roofing, Inc.
