Include'" a statement regarding affirmatively furthering fair housing. The document herein, as Supplement #2 to the existing Cooperative Agreement for the Dakota County Community Development Block Grant Program, does that. RECONII+2ENDED ACTION: Motion to approve Supplement #2 to the Dakota County Community Development Block Grant Program ensuring certain civil rights. Dakota County first qualified a5 an urban county in 1983 and the recertification process occurs every three years. In order to complete this process, a Cooperation Agreement must be executed between the County and each unit of local government that wishes to participate in the County's CDBG Program. The City of Rosemount originally executed such a Cooperation Aareement in late 1983 or early 1984, and this Agreement could usually be automatically renewed atthe end of each three-year certification period. However, the U.S. Department of Housing and Urban Development (HUD) now requires that the Cooperation Agreement be amended to include some new requirements. These include: 1. A certification regarding the use of excessive force by law enforcement agencies in response to non-violent civil rights demonstrations. 2. Additional references to applicable laws and regulations, and a statement regarding affirmatively furthering fair housing. In regard to the "excessive force" certification, the Dakota County Attorney's office has 1 determined that the existing County policy regarding the use of deadly force by law enforcement personnel meets the requirements of this certification. A copy of the Attorney's opinion and the County policy is enclosed for comparison to your own policies. For those communities, who receive law enforcement service from the County, the County Attorney's determination is sufficient to allow you to make this certification. The City of Rosemount must execute Supplement #2 to the Cooperation Agreement for the Dakota County CDBG Program and return it to Dakota County HRA by September ',4, 1992, in order to participate in the County's CDBG Program for the three year period beginning in Fiscal Year 1993. .AN EQUAL OPPORTUNITY EMPLOYER" -2- The Supplement to the Cooperation Agreement does not necessarily have to be approved by the City',Council or Township Board; however, it must be signed by the Mayor or Town Board Chair. If you elect not to execute the supplement and participate in the CDBG Program, you must so notify Dakota County and HUD, at the, Minneapolis/St. Paul Area Office, 220 Second Street South, Minneapolis, MN 55401, in writing by September 4, 1992. The CDBG Program has provided substantial funding to Dakota County over the last three years to perform Community Development activities throughout Dakota County!. We hope that you will continue to participate in the program to allow these activities to continue at the maximum funding level possible.'', The number of participating communities is a factor in determining the level of funding for the County's CDBG Program. Ulfe s Executive Director MSU:kmg cc: Stephan Jilk, City ',Administrator Attachment SUPPLEMENT #2 TO THE EXISTING COOPERATION AGREEMENT FOR THE DAKOTA COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM THIS AGREEMENT made and entered into by and between the COUNTY OF DAKOTA, State of Minnesota, hereinafter referred to as "COUNTY" and the City of Rosemount hereinafter teferred to as "COOPERATING COMMUNITY," said parties to this Agreement each being governmental units of the State of Minnesota, and is made pursuant to Minnesota Statutes, Section 471.59. The parties further agree that the COOPERATING COMMUNITY has adopted and is enforcing: 1. A policy prohibiting the use of excessive force by law enforcement agencies within its',,jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and 2. A policy of enforcing applicable State and local laws against physically barring ',entrance to or exit from a facility or location which is the subject of such non-violent civil rights demonstrations within jurisdictions. The parties further agree to take all actions necessary to assure compliance with the COUNTY's certification required by Section 104(b) of Title I of the Housing and Community Development Act of 1974, as amended, the Fair Housing Act, The Americans with Disabilities Act of 1990, and other applicable laws. They also agree that the COUNTY shall not fund activities in or in support of a unit of general local government that does not affirmatively further fair housing within its own jurisdictions or that impedes the COUNTY's actions to comply with its fair housing certification. The parties have caused ',this Agreement to be duly executed.
