The agreement you have before you has been drafted by Public Works
Secretary Dorniden and reviewed by our City Attorney, Mike Miles. The
agreement has been sent to Nininger Township Attorney, Dave Tanner.
He will be presenting this to Nininger Town Board on this same night.
The City has had basically the same agreement since 1974,: with the
rotation of November 1st, we are now asking to go from January to
January. The agreement has never been in written agreement format.
Staff is recommending, if Nininger Township agrees, to enter into this
Maintenance Agreement for the maintenance of Fischer Avenue.
RECOMMENDED ACTION:
MOTION TO APPROVE THE MAINTENANCE AGREEMENT FOR
FISCHER AVENUE BETWEEN
THE CITY OF ROSEMOUNT AND NININGER TOWNSHIP AND
AUTHORIZE THE NECESSARY
SIGNATURES PROVIDING NININGER TOWNSHIP AGREES
TO THE AGREEMENT.

AGREEMENT
This agreement,) made and entered into this _ day of , 1992, by and
between the Township of Nininger, a municipal corporation, hereinafter referred to as
"Nininger", and the City of Rosemount, a municipal corporation, hereinafter referred
to as "Rosemount".
WHEREAS, each of the parties has, by appropriate action, authorized its officers
to enter into this agreement.
WHEREAS, it is mutually agreed by and between the parties hereto that the
maintenance and upkeep of Fischer Avenue (a border road) will be shared between
Rosemount and Nininoer.
WHEREAS, Rosemount will plow, grade and cut road ditches on Nininger's
Fischer Avenue every !,odd year, and;
WHEREAS, Nin
inger will plow, grade and cut road ditches on Rosemount's
Fischer Avenue everyjeven year.
WHEREAS, if either party should be out with equipment (not during their year)
and see a problem they will maintain a passable roadway until the respective party
gets to the road.
NOW, THEREFORE, all gravel costs on Fischer Avenue would be split on a 50-
50 basis and any graveling of Fischer Avenue must be agreed to by both Rosemount
and Nininger before any of this work is commenced.
FURTHER THEREFORE, the year in question will begin on the 1 st day of
January with Rosemount taking odd years and Nininger even years.
IN TESTIMONY WHEREOF, each of the parties hereto has caused this
agreement to be executed on its behalf by its respective officers as of the date and
year first above written.
