RECOMMENDED ACTION: PREPARED BY: Lisa Freese AGENDA NO. �7 /J regarding a request Director of Planning Family Residential ATTACHMENTS: Rezoning Petition; Final Plat; APPROVED BY: Location Map; Public Hearing Notice. of an amendment to At the September 1, 1992 Regular Council Meeting, I will be requesting Item # 4(1) Set Public Hearing_-- O'Learv's Hills Fifth Addition Rezoning/PUD Amendment be pulled from the CONSENT AGENDA and placed under NEW BUSINESS for discussion and formal action. Tim Broback, Parkview, Inc., and developer of the O'Leary's Hills has requested a rezoning of additional property within this subdivision to accommodate the O'LEARY's HILLS SIxTH ADDITION. This petition was received after the deadline for City Council packet distribution. Upon review of this request, Planning staff feels that it may be in the City's best interest to review these three petitions on the same date. Because contiguous properties are involved, mailing lists will be very similar with some property owners being notified for'all three petitions. By holding the three hearings on the same evening, staff time and mailing costs would be greatly reduced. The attached memo outlines all three requests for your further review. RECOMMENDED ACTION: MOTION to schedule a Public Hearing on September 15, 1992 at 8:00 p.m., or as soon thereafter as possible, to hear testimony regarding a request to rezone property from AG Agriculture to R-1 Single Family Residential to accommodate the O'Leary's Hills Fifth Addition. McMenomy COUNCILMEMBERS Sheila Klassen James (Red) Staats Harry Willcox Dennis Wippermann ADMINISTRATOR Stephan Jilk On Tuesday, August 11, 1992, the Planning Commission passed a motion to recommend approval of the final plat for O'Leary's Hills Fifth Addition, as requested by Mr. Tim Broback of Parkview, Inc. This 35 -lot phase of the O'Leary's Hills Planned Unit Development is dependent on Metropolitan Council approval of the Comprehensive Guide Plan Amendment that will divert Section 31 sanitary sewer effluent to the Empire Waste Water Treatment Plant. Approval of the final plat also requires rezoning from Agriculture (AG) to Single Family Residential (R-1). The Guide Plan Amendment must be approved prior to council action on the rezoning and final plat approval. In the interest of avoiding delays on this project, Planning staff suggests that the Council hold the public hearing for the rezoning at this time. After the Metropolitan Council approves the Comprehensive Guide Plan the final plat and rezoning can be placed on the next available City Council agenda for formal action. In addition, the Council will review an amendment to the O'Leary's Hills Planned Unit Development (PUD) that will outline anticipated future phases of the project. Action will be requested on this item at the time of the Public Hearing, as the PUD Amendment is not dependent upon the Comprehensive Guide Plan Amendment. Mr. Broback has also requested rezoning a parcel that will yield two lots called O'Leary's Hills Sixth Addition, adjacent to O'Leary's Hills First Addition, and north of 155th Street West. The lots would have been part of a later phase of the PUD, however, with the construction of 155th St. W., the services are in place and the land is in the MUSA. The Planning Commission will review the final plat and rezoning at their September 8, 1992 Regular Meeting and will make a recommendation for Council consideration at the Public Hearing on September 15, 1992.
