Mr. Jim Allen, Hampton Development Corp., is requesting approval of a
preliminary plat and concept Planned Unit Development (PUD) for 103 single
family lots on 36.4 acres between Jaycee Park and the West Ridge PUD, west
of Shannon Parkway. Mr. Allen is requesting that the City condemn a small
parcel owned by Rosemount Development Co. that is an integral part of the
overall project. This parcel is approximately 120 feet wide by 750 feet
long and contains a 60 -foot wide storm sewer easement. A public right-of-
way for streets and utilities will be developed within the 120 -foot strip.
As of thio date, negotiations between Hampton Development Corp. and
Rosemount Development Co. regarding purchase of the parcel apparently have
reached an impasse. The developer requests that the City intervene by
considering condemnation for the public right-of-way. Council is being
asked to make a policy decision whether to condemn land for private
development in addition to the necessary public improvements for streets
and utilities. City Attorney Mike Miles will be prepared to discuss the
legal aspects with regard to condemnation.
At their August 25, 1992 meeting, the Planning Commission passed a motion
recommending that the City Council schedule a public hearing to review the
Shannon Pond Planned Unit Development (PUD) and preliminary plat.
The purpose of the Public Hearing is to discuss planning issues regarding
the lots, street circulation, and required improvements to serve the
project.
According to the Subdivision Ordinance, title to the entire property is not
required until the time of final plat approval. If Council decides not to
proceed with condemnation, the developer may wish to delay the Public
Hearing -for the PUD/Preliminary Plat.

or MOTION to deny developer's request to consider condemnation for
public streets in the Shannon Pond Development;i

Pursuant to the planningcommission request, our clients have
met on several occasions with representatives of the Broback family
in an effort to resolve the issue of the acquisition of the
approximately 2.1 acres encumbered by the City storm sewer
easement.
Mr. Robert Smith prepared and presented to the family drawings
indicating a proposed exchange of what we consider to be the most
comparable property of ours for the Broback's property. We are
prepared to do this despite the fact the Broback's property is
encumbered by the storm sewer easement and is basically of no value
at all to them. They rejected our proposal.
As you are aware, we also offered them cash of $8,300 an acre,
the price we paid for the unencumbered land surrounding the 2.1
acres. That too was rejected and the family indicated they did not
even want to talk about a cash purchase. Rather, they have offered
to purchase the encumbered land for other land of ours which is
clearly, in our mind, superior.
Our last meeting was this morning at the office of Michael
Broback, attorney for the family, and after approximately a one
hour meeting it became clear that there was simply no middle ground
available
Consequently, please accept this letter as a formal request
that the City proceed to acquire the 2.1 acre parcel which has the
storm sewer located within it. We are prepared to enter into an
agreement with the City to acquire that .2.1 acre parcel from the
City at the City's cost through condemnation.

We would ask that you commence the condemnation immediately so
that the 90 -day "quick ck take" period expires as soon as possible and
the City would then own the property.
We will be asking the planning commission to approve our
preliminary plat and forward it to the city council, subject to our
acquiring and proving good title. I would then request the City
Council table the preliminary plat until the condemnation procedure
gets under way and the 90 -day "quick take" period ends. If your
subdivision ordinance requires the city council to act on a
preliminary plat within a certain period of time subsequent to the
planning commission's actions, please accept this' letter as a

formal, please forward an agreement to that effect and I will have
my client execute it.
I am sure I don't have to tell you that this delay is going to
be very costly to our development. In an effort to keep those
additional costs as low as possible, we are requesting a
preliminary grading permit, or such permit is as required by the
City to allow us to do work in accordance with our preliminary
grading plan which we have already submitted. Needless to say, we
would not be doing any grading on property we do not own. If we're
not able to grade this fall, however, we will probably lose an
entire selling season and the first group of home will be erected
(and pay taxes) a year late.
We very much appreciate the City's assistance in resolving
this very difficult development issue and we are certainly sorry
we're having to ask the City for help. Considering that this is a
trunk facility, it is probably best that fee title to the sewer
line end up with the City ultimately.

On August 11, 1992, the Planning Commission tabled action on the Preliminary Plat for
Shannon Pond PUD to encourage the Hampton Development Corporation and Rosemount
Development Inc. to continue efforts to negotiate a settlement relative to the 120 -foot wide strip
of land owned by Rosemount Development Inc. In addition, several unresolved planning issues
were indicated that require additional discussion from the Planning Commission before a
recommendation can be forwarded to _the City Council. Those issues are:
1) Acquisition of 15 feet of property from the' City utility property south of Jaycee Park;
2) Planning Commission granting lot width and lot depth variances for Lot 6, Block 6, and
Lot 2, Block 5;
3) Planning Commission consideration of the request from the Park and Recreation
Committee of the sidewalk/trail extension from 137th to 156th Street along Upper 156th
Street West.
The Planning Commission had been informed of these issues, but little discussion took place
because of the apparent focus on the possible condemnation of the 120 -foot wide strip of land
owned by Rosemount Development Inc. by the Developer as well as the property owner.
Planning staff would hope to refocus the discussion on the above mentioned issues so that a
recommendation can be made to the City Council that would be separate from the condemnation
issue.
The preliminary plat review by the Planning Commission does not require that the ownership
issues be resolved in order to make a recommendation to the City Council. Final plat
procedures -require proof of ownership as specified by Subd. 3.3(b) of the City of Rosemount
Subdivision Ordinance.
The Developer may decide to modify the design of the plat if he desires. If the Developer
chooses not to acquire the above mentioned 15 feet of property form the City, and makes
adjustments to lots without affecting streets or creating substandard lots, Planning staff could
process the 'changes to the City Council. However, if the Developer chooses to redesign the
plat with the effect of creating outlot(s) and reconfiguring streets, then he -will be required tc
return to the Planning Commission with a revised preliminary plat.
The Utility Commission tabled action regarding the land acquisition at their regular August 17,
1992 meeting. Public Works staff was directed to research information regarding a future water
treatment facility proposed for the site. Area requirements for the facility will have to be

studied to determine if 15 feet of lot width can be sold. Additionally, the facility with or
without the 15 foot strip may displace the park access. At this time, it is unclear whether the
existing site has enough area to accommodate the water treatment facility, the park access and
be reduced by fifteen feet of width. In response to the Utility Commission action, the Park and
Recreation Director may entertain a land substitution for cash dedication to ensure that access is
provided to the park. The Park and Recreation department may even be required to consider
purchasing land if necessary, to provide access to the park.
The process of reviewing Planned Unit Development proposals require a public hearing before
the City Council. In approving the Concept Plan, the Planning Commission must find as
follows and forward its findings to the City Council:
1) The plan provides sufficient useable open space and evidences a substantial preservation
of natural features to warrant the granting of variances through Planned Unit
Development.
2) The plan -complies with the intent of the Comprehensive Guide Plan.
3) The proposed development will not be detrimental to surrounding properties.
4) The plan is more creative and will provide a better living, working or shopping
environment than is possible under strict ordinance requirements.

BACKGROUND:
The proposed development is part of the Gergen farm, on the north side of a depression that
bisects the land generally from the northwest to southeast to Shannon Parkway. Discussions
between City staff and the Developer have been ongoing since January, and the proposal is a
result of the working relationship which resulted.
The focus of those discussions are as follows:
1. Lot sizes must conform to current ordinance standards and inclusive of the recently adopted
ordinance amendments (Ordinance B-20 published May 28, 1992).
2. Street alicrnments that are cohesive and efficient relative to existing and future streets, as
well as limiting the number of intersections with Shannon Parkavay.
3. Establishing the appropriate sidewalkltr~ail connections within the development.
4. Providing sewer capacity via the Guide Plan amendment that diverts sections 31 and part of
32 to the Empire Waste Water Treatment Plant.
The proposal which has been submitted shows 104 single family lots developed on
approximately 36.4 acres. The gross density is 2.85 dwelling units per acre overall. This PUD
differs somewhat from previous PUDs because the current ordinance standards have not been
traded for other considerations. The developer desires, however, to develop the property in
phases mandating that a PUD be required.
The 80 foot lot width standard has been maintained on 103 out of 104 lots. The only exception
is lot 6 block 6 which is adjacent to West Ridge Second Addition and is confined by the
intersection of Danville Avenue and Upper 156th Street West. Planning staff acknowledges that
there is no alternative to platting a 75 foot lot in this case. That lot is however 15 feet deeper
and 400 square feet larger than ordinance standards. Lot 2 block 5 is five feet deficient in lot
depth, however it is eight feet wider and 500 square feet larger than minimum standards. 102
out of 104 lots exceed the lot area and lot depth minimum standards.
The proposal illustrates a compromise between the Developer and City staff. The original
concept indicated three intersections with Shannon Parkway. In the interest of traffic
movements, offset intersection alignments and connections to future streets, the Developer
agreed to convert Dakota Trail from a through street to a cul-de-sac and gave up one lot in the
process. Planning staff feels that the trade-off of two minor lot variances for the street
configuration is well justified as part of the PUD process.
The proposal is dependent upon the acquisition of 15 feet of width from a City well site along
the southeast corner of Jaycee Park. The feasibility of the acquisition is being discussed at this
time and will require approval by the Utility Commission as well as the City Council. The
Developer will lose another lot if acquisition does not occur.

The Park and Recreation Commission has indicated that Park dedication be in the form of cash
contribution per lot at the current rate of $490. Sidewalks have been indicated on the proposal
as a result of continued staff direction. The Comprehensive Parks Master Plan did not provide
specifics regarding sidewalk/trail locations and the proposal seems to meet the intent of the
criteria as published in the Comp Parks Plan. The Park and Recreation Commission motioned
to recommend that an additional sidewalk be installed on the east side of Upper 156th Street
West that would connect 156th Street West and Upper 157th Street West. This information
came too late to be included in the proposal, and the Developer questions the need for it.
This proposal is dependant upon the Comprehensive Guide Plan Amendment for the sewer
diversion to the Empire Waste Water Treatment Plant originally discussed by the Planning
Commission on May 12, 1992. The Amendment is in process with the Metropolitan Council
and Planning staff has been responding to their requests for additional information.
Given the existing street configuration that this proposal must relate to, the PUD as presented
provides an efficient design solution that meets and generally exceeds current ordinance
standards with only two acceptable exceptions as mentioned above.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a
Public Hearing to consider the item listed below on Tuesday, October 6, 1992, in the
Council Chambers of the City Hall, 2875 145th Street West, beginning at 8:00 p.m., or as
soon thereafter as possible. The public hearing listed below pertains to the property as
depicted on the attached map and generally described as follows:
That part of the Southwest Quarter (SW'/4) of Section 31, Township 115, Range 19, Dakota
County, Minnesota lying east of Danville Avenue and Danbury Avenue; adjacent and south of
Jaycee Park.
The purpose of this hearing is to consider a Planned Unit Development and preliminary plat
for the above -described property for a single family development proposed to be identified _
as the SHANNON POND subdivision.
Persons wishing to speak on this issue are invited to attend this meeting on Tuesday,
October 6. 1992 at 8:00 p.m.
