WALSH, CITY CLERK k ATTACMdENTS: RESOLUTION, NEW PRECINCT MAP, OLD APP D_BY• PRECINCT MAP, MEMO FROM SECRETARY OF STATE Since 1987, State law has prohibited the City from changing effiy precinct boundaries. Effective this year precinct boundary lines can be altered based upon newly drawn state legislative district lines. Cities cannot have more than one legislative district in a precinct. Pending are a state redistricting plan and a federal redistricting plan, but since neither plan runs legislative district lines through the City, we do not have to be concerned with a precinct being split. At the Special Council meeting, I will review the proposed new precinct boundaries. To give you an idea on what kind of numbers we are looking at for the new precincts; I have listed below estimated number of registered voters for the new precincts. I have also listed the number of registered voters of the current four precincts: Current Precincts: Registered Voters on November 5, 1991 Precinct 1: 892 Precinct 3: 1329 Precinct 2: 896 Precinct 4: 2073 Proposed Precincts: Estimated Registered Voters Precinct 1: 1,075 Precinct 4: 1037 Precinct 2': 1,231 Precinct 5: 1212 Precinct 3: 977 When working on new precinct lines, my goal was to establish precincts with balanced registered voters while taking into account short term and long term population growth, polling place availability that is handicap accessible and voter turnout. RECOW4ENDED ACTION: MOTION TO ADOPT A RESOLUTION ESTABLISHING NEW PRECINCTS AND POLLING PLACES COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1992- A RESOLUTION ESTABLISHING NEW PRECINCTS AND POLLING PLACES WHEREAS, the United States Constitution requires that the membership of the House of Representatives be reapportioned among the states following each census; and WHEREAS, redistricting plans for the Minnesota House of Representatives were completed following the 1990 census; and WHEREAS, the City Council has reviewed the pending legislative district lines which were established by the state legislative redistricting plan and the federal legislative redistricting plan and has acknowledged that neither redistricting plan will cause the City of Rosemount to have more than one state legislative district; and WHEREAS, the City Council has the statutory authority to established new precinct boundaries and polling places; and WHEREAS, the City Council acknowledges the need to create an additional precinct which will allow the City to administer more manageable and efficient elections and optimize the citizens' ability to vote; and WHEREAS, the City Clerk reviewed with the City Council anew city precinct map, which is attached as Exhibit I, and has informed the City Council the new precincts represents a balanced voting population within the City. NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Rosemount hereby approves the attached city precinct map designated as Exhibit I; and BE IT FURTHER RESOLVED, that the new precincts identified on Exhibit I as Precincts 1, 2, 3, 4 and 5 will take effect on September 15, 1992, when the State Primary election is held; and BE IT FURTHER RESOLVED, that the polling places for each of the five precincts will be as follows: Precinct 1: Shannon Park Elementary School 13501 Shannon Parkway Precinct 2: United Methodist Church 14770 Canada Avenue Precinct 3: St. John's Lutheran Church 3286 144th Street West Page 2 Precinct 4: Lutheran Church of Our Savior 14980 Diamond Path Precinct 5: Senior Citizens Center 2900 145th Street West BE IT FURTHER RESOLVED, that the City Clerk is directed to provide the new precinct map,to the Secretary of State, the County Auditor and the State Planning Director. As you are aware, legislative redistricting is currently being pursued by both the state and federal courts in two unrelated actions. The fate of the legislative redistricting plan, however conceived, is of interest to you since the reestablishment of precincts, wards and county commissioner districts is directly related to the f incl adoption of a legislative plan. On December 9, 1991, a state court redistricting panel issued an order for a legislative redistricting plan. This order became effective on January 30, 1992. The result of this order was the determination of the final dates for precinct reestablishment and redistricting of wards and county commissioner districts, those dates being March 30 and April 20, respectively. on February 20, 1992, a federal court redistricting panel issued an order for a legislative redisricting plan. .-This...-plan was.., substantially different than the plan issued earlier by the state court. I have .instructed the attorney general, who is representing'tbi's office in both court cases, to prepare an appeal of the federal court order to the U.S. supreme Court. The purpose of the appeal is to resolve the apparent jurisdictional dispute between the courts and come to at final determination on the legislative plan as rapidly as possible. We are also seeking an immediate appeal in order to definitively determine the period during which local redistricting activities must be concluded. our goal is to allow the ongoing redistricting activities to be completed on our current schedule if at all possible. , As we await action by the supreme court, it may be advisable to temporarily postpone any format adoption of precinct or local election district boundaries. However, it may well be possible for counties, cities and townships who are not affected by the differences in legislative district boundaries in the two court plans to continue their activities.
