I have received a request from Splatball, Inca to operate its" business in
Rosemount. For the past two years Paintball Express has operated in
Rosemount and in March, 1992 it merged with Splatball, Inc The owners of
Paintball Express, Jim and Kathy Lathrop, are now two of the four principal
partners of Splatball, Inc. The other two principal partners are William
and Ranae Hansen, husband and wife, who have owned Splatball, Inc. for
approximately five years.
Splatball, Inc. has operated in Hudson, Wisconsin, and investigations
conducted by the Police Department have resulted in clear criminal records
of William and Ranae Hansen, and a good report from St. Croix County
regarding Splatball's business in Wisconsin.
William Hansen admitted to me that he did operate his business in Lake
Forest Township without a permit. Mr. Hansen and I discussed this action
thoroughly. I discussed this issue with the Administrator of Lake Forest
Township who was not aware this occurred, but stated he knew Mr. Hansen
since he used to work for the township. This administrator had good
comments about Mr. Hansen's character.
Based upon Mr. Hansen's willingness to come forward about his operating in
Lake Forest without a permit and based on the good track record established
by the Lathrops over the past two years, I recommended to you that the
permit be issued to Splatball, Inc. based on the time lines and conditions
listed in the permit.
For your information, these terms and conditions are identical to those
listed in the permit you approved for Adventure Zone last month.
RECONKENDED ACTION: MOTION TO APPROVE THE ISSUANCE OF A PERMIT TO
SPLATBALL, INC

PERMIT issued this day of 1992, by the CITY OF
ROSEMOUNT (the "City") to Splatball, Inc.
1. The City hereby issues a permit for Paintball Express, Inca in
accordance with the definition and rules set forth on the attached
Exhibit "A".
2. This permit is issued subject to the following conditions:
a. The permit is valid only on Tax Parcel Number 34-02100-011-50.
b. A permit fee of fifty dollars ($50.00) shall be paid by the
permit holder.
C. The permit holder shall take out and maintain in force general
liability insurance for at least five hundred thousand dollars
($500,000). The form of the policy and the insurer shall be
subject to approval by the City Administrator. The City shall be
named as an additional insured on the policy. The policy shall
further provide that the City shall be given ten (10) days
advance notice of cancellation. Proof of this insurance
(certificate of insurance) will be presented as part of the
approval process of the permit.
d. The hours and days of operation shall be limited to the
following: Monday through Sunday, 8:00 a.m. to dusk.
e. The permit for operating shall continue from April 8, 1992
through November 6, 1992.
f. No building or other structure may be erected on the site.
g. The permit holder shall police the area for litter after each
game and shall insure that a nuisance is not created as a result
of noise, littering, traffic, or disorderly conduct.
h. Beer, wine and intoxicating liquor is prohibited.
3. This permit may be revoked for violation of its terms or violation of
any ordinance or statute
