The current ordinance states: C. Parking After Snowfall: No owner of a motor vehicle shall leave, park or permit the same to stand on,any street or alley for a period longer than four (4) hours after a snowfall of two inches (211) or more in depth or of such amount which necessitates the plowing and clearing of City streets and alleys of snow by the City, until such time that the streets or alleys in question are actually plowed 'and cleared of snow. The suggested revised Snowbird Ordinance (attached) +clarifies two issues: First, the word "owner" has been changed to "owaer/operat:or". This change mill correctly identify the responsible person in cases like car rentals, etc... Second, the phrase "stand on any street or alley for period longer than four hours after a snowfall..." has been subject to several interpretations. The revised ordinance clearly advises motorists that parking during a snow emergency is prohibited until the City plows have cleared the street. RECOMMENDED ACTION: MOTION TO APPROVE AND ADOPT THE REVISED ORDINANCE PERTAINING TO PARKING AFTER SNOWFALL AND CAUSE THE ORDINANCE TO BE EFFECTIVE IMMEDIATELY UPON IT'S PASSAGE AND PUBLICATION. COUNCIL ACTION: ORDINANCE NO. X11.12 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA An Ordinance Amending Title 8, Chapter Pertaining to Parking Provisions The City Council of the City of Rosemount, Minnesota, ordains as Section 8-2-2-C, Title 8, Chapter 2 of the Rosemount City Code is entirety to read as follows: C. Parking After Snowfall: y amended in its 1. Snow Emergency. A snow emergency shall be deemed to exist after a snowfall, wind or other weather condition resulting in an accumulation of snow of two inches (2") or more in depth on public streets. A snow emergency shall continue to exist with respect to'a specific street until that street has been plowed and cleared of snow.', 2. Prohibited Parking. No owner/operator of a motor vehicle shall leave, park or permit the motor vehicle to stand on any public street during a snow emergency. This provision shall not prohibit the stopping of commercial passenger vehicles for periods sufficient to load or discharge passengers from such vehicles.
