Chelsea Woods Easement AgreementCITY OF ROSEMOUNT EXECUTIVE SUMb+lARY FOR ACTION CITY COUNCIL MEETING DATE: November 17, 1992 AGENDA ITEM: Easement Agreement AGENDA SECTION: Lot 2, Block I, Chelsea Woods Consent PREPARED BY: Ron Wasmund AG� Public Works Director/Building Official .4 ATTACEMUMS : Agreement APP B ' The attached easement agreement describes a temporary easement being conveyed to the City of Rosemount to accommodate the temporary cul-de- sac installed on Cobblestone Lane. The developer of that subdivision decided not to develop the street any further north within his plat. His original intention was to continue development on property north of his current ownership, however, when negotiations for that land fell through the need for the street at that time was not necessary. The temporary cul-de-sac encroaches slightly on the described lot and causes a`title transfer problem. By granting this easement to the - City they can transfer the title and complete the sale of the home. RECOMMENDED ACTION: MOTION TO ENTER INTO AN EASEMENT AGREEMENT WITH LOT 2, BLOCK 1, CHELSEA WOODS ESTATES AND AUTHORIZE THE NECESSARY SIGNATURES. COUNCIL ACTION: 5 I EASEb=T AGREEbWT THIS INDENTURE made this 17th day of November 1992, by and between James Koesterincr hereinafter referred to as "Grantor (s) ", and the CITY OF ROSEMOUNT, a municipal corporation organized under the laws of the State of Minnesota, hereinafter referred to as the "Grantee". The Grantor, in consideration of the sum of One Dollar ($1.O0) and other good and valuable consideration to them in hand paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged, do hereby grant and convey to the Grantee, its successors and assigns, forever, a Right of Way for public road, utilities, drainage, purposes, over, across, on, under and through lard situated within the County of Dakota and State of Minnesota' as described on attached Exhibit "A"; INCLUDING the rights of the Grantee, its contractors, agents, servants and assigns, to enter upon the Right of Way premises at all reasonable times to construct, reconstruct, inspect, repair and maintain said Right of Way systems over, across, on, under and through the Right of Way premises, together with the right to grade, level, fill, drain, pave and excavate the Right of Way premises, and the further right to remove trees, bushes, undergrowth and other obstructions interfering with the location, construction and maintenance of said Right of Way systems. The above named Grantor(s), for themselves, their successors, heirs and assigns do covenant with the Grantee, its successors and assigns, they are well seized in fee title of the above described Right of Way premises and have the sole right to grant and convey said premises to the Grantee. r IN TESTIMONY WHEREOF, the Grantors) hereto have signed this Agreement the day and year first above written. Line) of Lot 1, Block 1, 76.00 feet.; thence southeasterly, southerly, and southwesterly 85 feet along a tangential curve, concave to the west., having a radius of 45 feet and a central angle of 96.3794 degrees to the point of beginning.
