At their May 12, 1992 Regular Meeting, the Planning Commission
reviewed a set of text amendments for Ordinance B, City of
Rosemount Zoning Ordinance and Ordinance XVII.4, City of
Rosemount Subdivision Ordinance. These amendments address those
code deficiencies that Planning staff have identified as
important to fix prior to the completion of the Comprehensive
Guide Plan Update. The attached Planning Commission review
overviews the proposed amendments.
After discussing the proposed amendments, the Planning
Commission decided to recommend approval of all the amendments
except for those addressing the fence regulations (Section 7.2,
Supplementary Regulations). They identified additional fence
regulations that should be more clearly addressed by the zoning
ordinance: athletic complex and utility pond fencing; barb wire
fencing; required front yards in AG, Ag -P, and RR; and
electrical fencing.
In the interest of enacting the other amendments in a timely
fashion, the Planning Commission is requesting that action be
taken on the other amendments. The amendment regarding fencing
will be brought before City Council for public hearing and
action at a later meeting.
RECOMMENDED ACTION: A motion to adopt Ordinance No. B-20, AN ORDINANCE
AMENDING ORDINANCE B, CITY OF ROSEMOUNT ZONING ORDINANCE and approve
the summary for official publication.

CITY OF ROSEMOUNT ZONING ORDINANCE
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS
FOLLOWS:
SECTION 1. Section 3.2 Definitions of Ordinance B - City of Rosemount Zoning
Ordinance is amended by adding the following:
Lot D th The shortest distance between the front and rear lot lines, measured at the side
yard setback line of the shortest side lot line.
Lot Line, Rear Any boundary of a lot which is opposite the front lot line. If the rear lot
line is less than ten (10) feet in length, the rear lot shall be a line ten (10) feet in length
within the lot, connecting the side lot lines and parallel to the front lot line.
Lot Width The width measured along the front yard setback line.
SECTION 2. Section 7.1 Dimensional Standards of Ordinance B, City of
Rosemount Zoning Ordinance is amended to read:

" Comer Lots in R-1 shall have a minimum of 12,000 square feet in area.
SECTION 2. Section 14.4, Subparagraph A(1) of Ordinance B, City of Rosemount
Zoning Ordinance is amended to read:
No building permit shall be issued until a site plan has been prepared in accordance with
the provisions of this Ordinance and approved by the Planning Commission. The applicant,
the zoning administrator, a member of the City Council, or any person owning property or
residing with 350 feet of the property for which site approval is sought may appeal the
Planning Commission decision to the City Council. An appeal, as provided for in Section
15.3 of this Ordinance, must be filed with the Planning Department within ten (10) working
days after written notice of the Planning Commission decision is sent.
SECTION 3. Section 14.8 Mineral Extraction, Subsection C, of City of Rosemount
Zoning Ordinance is amended to read as follows:
C. A op lication Public Hearing. Notice and Procedure. The application, public
hearing, public notice and procedure requirements for mineral extraction permits shall
be the same as those for amendments as provided in Section 16 of this Ordinance,
except that the permit shall be issued on the affirmative vote of a majority of the entire
Council. Application for the extraction permit shall be made in writing in the form
specified by the City. The application shall contain the following information:
1. The correct legal description of the land upon which excavation is proposed.
2. The name and address of the applicant, the owner of the land, and the person or
corporation conducting the actual removal operation.
3. The names and addresses of all adjacent land owners within 250 feet.
4. The purpose of the proposed excavation.
5. The estimated time required to complete the proposed excavation and
rehabilitation.
6. The names of the highways, streets, or other public roadways within the City
upon which the material shall be transported.
SECTION 4. Section 15.2, Subsection F of Ordinance B, City of Rosemount Zoning
Ordinance is amended to read:
F. Within ten (10) working days of action of the Board of Appeals and Adjustments, the
applicant, the zoning administrator, a member of the City Council or any person
owning property or residing within 350 feet of the property affected by the decision
may appeal the decision to the City Council. The appeal must be filed with the
Planning Department.
SECTION 5. Section 15.3 Appeals to City Council of Ordinance B, City of Rosemount
Zoning Ordinance is added as follows:
SECTION 15.3 APPEALS TO CITY COUNCIL
A. The City Council shall have the power to hear and decide appeals where it is alleged
by the appellant that there is an error in any fact, procedure, or finding made by the
Board of Appeals and Adjustments or the Planning Commission.
B. Building permits shall not be issued after an appeal has been filed with the Planning
Department. If permits have been issued before an appeal has been filed, then the
permits are suspended and construction shall cease until the City Council has made a
final determination of the appeal.
C. The City Council shall conduct a hearing on the appeal within thirty (30) days after the
receipt by the City Council of the appeal from the action of the Planning Commission.
As provided in Section 16 of this Ordinance, the City Council shall give due notice of
the hearing. The City Council shall render a decision on the appeal without
unreasonable delay.
Any person may appear and testify at the hearing either in person or by duly
authorized agent or attorney.
D. A fee to be established by resolution of the City Council shall be paid to the Planning
Department by the appellant at the time the notice of appeal is filed. Such resolution
may provide for waiver or refund of such fee under specific circumstances.
SECTION 6. This ordinance shall be effective immediately upon its passage and
publication according to law.

CITY OF ROSEMOUNT ZONING ORDINANCE
The City Council of the City of Rosemount, Minnesota ordains as follows:
A SUMMARY OF THE CONTENTS OF ORDINANCE B-20
The City Council of the City of Rosemount on May 19, 1992, adopted an amendment to the Zoning
Ordinance. This summary, approved by the Rosemount City Council on May 19, 1992 provides a
brief description of the amended provisions. Printed copies of the entire text of the Zoning Ordinance
and this amendment are available, for sale or inspection, at the Rosemount City Hall during regular
business hours.
SECTION 3.2 (DEFINITIONS) Adds definition for Lot Depth and Lot Line, Rear. Revises
definition of Lot Width.
SECTION 7.1 (DIMENSIONAL STANDARDS) Adds a minimum depth requirement for RL, R-1,
R-2, R-3, R-4, and C-1 Zoning Districts and establishes a minimum comer lot size of 12,000 square
feet in the R-1 District.
SECTION 14.8 (MINERAL EXTRACTION) Adds a public hearing before the City Council with
notification to adjacent property owners as part of the approval procedure.
SECTION 15.2 (PROCEDURES) Clarifies the appeals procedure for variances and zoning
ordinance interpretation and makes the appeal filing requirements consistent with other appeals.
SECTION 15.3 (APPEALS TO CITY COUNCIL) Adds a section setting forth the procedures to
be used by City Council in handling appeals of the Planning Commission and Board of Appeals and
Adjustments decisions.
The effective date of this ordinance shall be after its passage and publication according to law.

SUBDIVISION ORDINANCE
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS
FOLLOWS:
SECTION L Subdivision 5.2(c) Intersections of Ordinance XVIIA. City of
Rosemount Subdivision Ordinance is amended as follows:
SUBD. 5.2(c) INTERSECTIONS
Centerline Offsets. The minimum distance between the centerline offset intersections for
local streets shall be 250 feet. The minimum distance between the centerline offset
intersections for collector streets shall be 660 feet.
SECTION H. Subdivision 5.6(i) Lots of Ordinance XVIIA. City of Rosemount
Subdivision Ordinance is amended as follows:
SUBD. 5.6(i) LATS
Corner Lots. Corner lots shall be platted at least fifteen (15) feet wider than the minimum
width required by the Zoning Ordinance. The lot area of such a comer lot shall be platted
at least eighteen (18) percent larger than the minimum area required by the Zoning
Ordinance.
SECTION M. This ordinance shall be effective immediately upon its passage and
publication according to law.

RECOMMENDED ACTION: Motion to recommend approval of the text amendments for
Ordinance XVIIA, City of Rosemount Subdivision Ordinance, and Ordinance B - City of
Rosemount Zoning Ordinance.
Planning staff has been working to draft a set of text amendments for Ordinance B, City of
Rosemount Zoning Ordinance and Ordinance XVH.4, City of Rosemount Subdivision
Ordinance. The text amendments are additions, clarifications, or enhancements to standards and
definitions in the current ordinances.
Generally, this set of amendments are the code deficiencies that Planning staff has identified as
critical to fix, easy to develop language for, and in support of existing plans and policies.
Ordinance amendment suggestions previously discussed by the City Council and Planning
Commission that are of a more complex nature will be developed upon completion of the Guide
Plan.
The Planning Commission must review and make a recommendation to the City Council on
these text amendments. The City Council has scheduled a public hearing on these amendments
on May 19, 1992.
The remainder of this memo lists the sections of each ordinance to be amended, provides the
text being recommended by Planning staff, and provides a brief discussion of the reason for the
proposed changes.
Please note that the hearing notice listed the amendment requiring percolation tests for
subdivision platting for areas served by on-site systems. After careful review of the existing
Subdivision Ordinance, it is staff's opinion that the requirement is already stipulated clearly.
Therefore, it is not included in these proposed text amendments.

DISCUSSION: This amendment adds a definition for Lot Depth and Lot Line, Rear, to
correspond with the minimum depth standards established in this text amendment for Section
7.1 for the residential districts. As well, this amendment revises the definition of lot width to
correspond with the current staff practice of determining the width at the front yard setback
line, rather than the front yard line.

DISCUSSION: This amendment establishes minimum standards for lot depth in residential
districts and adds a minimum square footage requirement for corner lots in the R-1 Zoning
District.
Section 7.2 (Supplementary Regulations), Subsection C. of Ordinance B. City of Rosemount
Zoning Ordinance is amended as follows:
E. Fences, Walls. Hedges. and Berms not exceeding six (6) feet in height, are permitted in
any district in the side or rear yards, but shall not exceed 30 inches in front yards, provided
that no structure shall interfere with sight distance. Barb wire fences not exceeding five (5)
feet are permitted in the AG, AG -P and RR Districts.
I. Security Fences not exceeding eight (8) feet in height are permitted in the side and rear
yards in the IG and WM Districts. Barb wire, not exceeding three strands, may be permitted
on the top of the fence, providing the arms do not project over the public property. The
minimum height of the bottom strand of barb wire shall not be less than six (6) feet from the
finished grade. In all cases where a barb wire security fence is requested an application shall
be made to the Building Official. A Certificate of Insurance indemnifying the City of
Rosemount shall be submitted with the application subject to the approval of the City
Attorney as to form and in an amount as set forth in Minnesota Statutes Section 566.04.
DISCUSSION: This amendment restricts barb wire fences and allows barbs on security fences
only in the IG and WM Districts. It also allows fences up to eight feet in height in the IG and
WM Districts.
Section 14.4, Subparagraph A(1) of Ordinance B. City of Rosemount Zoning Ordinance is
amended to read:

DISCUSSION: This provision is being revised so that all of the City Council appeal processes are
consistent. See Section 15.3 for the rest of the associated revisions.

DISCUSSION: This amendment adds a public hearing requirement for mineral extraction
permits. It would require notices to be sent to property owners within a quarter mile of the
extraction operation. The public hearing would be held by the City Council.

DISCUSSION: This amendment provides for consistent procedures for appeals of decisions
made by the Planning Commission: variance, zoning ordinance interpretation, and site plan
reviews. Appeals must be filed within ten (10) working days. It also establishes the criteria
that City Council must use in considering an appeal.
Subdivision 5.2(c) (Intersections) of Ordinance XVII.4, City of Rosemount Subdivision
Ordinance is amended as follows:

Centerline Offsets. The minimum distance between the centerline offset intersections for local
streets shall be 250 feet. The minimum distance between the centerline offset intersections for
collector streets shall be 660 feet.
DISCUSSION: The current minimum distance offset for centerlines of streets is only 125 feet.
This standard is very minimal and past experience has demonstrated some problems with traffic
circulation and flow. This amendment increases the minimum standard to 250 feet for local
streets and establishes a minimum standard of 660 feet on collector streets. The 660 feet
standard is the same as the Dakota County standard for County Collector Roads.
Subdivision 5.6(1) (Lots) of Ordinance XVII.4. City of Rosemount Subdivision Ordinance is
amended as follows:

Ordinance.

NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a
public hearing on Tuesday, May 19, 1992 in the Council Chambers of the City Hall, 2875
145th Street West, beginning at 8:00 p.m. or as soon thereafter as possible.
The purpose of this hearing is to receive comments on proposed text amendments to
Ordinance B, City of Rosemount Zoning Ordinance and Ordinance XVIIA, City of
Rosemount Subdivision Ordinance. The City Council will consider additions and clarifications
to the Zoning and Subdivision Ordinance including but not limited to the following:
Definition additions or clarifications describing lot depth, lot line -rear, lot width and
security fence;
Specification of corner lot minimum area standard;
Increasing the minimum spacing standard for offset intersections;
Requirement of percolation tests for subdivision platting;
Revision of appeal procedures for Variances, Site Plan Review and Zoning Ordinance
Interpretation to achieve consistent procedures;
Addition of requirement for a Public Hearing for PUD Amendments and Mining Permit
requests and renewals;
Increasing the maximum allowable height for fencing in General Industrial and Waste
Management districts;
Allowance for barbed wire fencing in Agricultural, Rural Residential and General
Industrial districts with bonding requirements for barbed wire fences exceeding 48
inches in height.
Persons wishing to speak on these proposed amendments are invited to attend this meeting on
Tuesday, May 19, 1992 at 8:00 p.m.
