Mr. Timothy Broback, Parkview, Inc., is requesting final plat approval of
O'Leary's Hills Fifth Addition. The City Council held a public hearing
for a rezoning petition on September 15, 1992. The request to rezone this
property from AG (Agricultural) to R-1 (Single Family Residential) was
tabled until the Metropolitan Council acted on Comprehensive Guide Plan
Amendment No. 22. On October 22, 1992, the Metropolitan Council approved
this sewer diversion amendment and included the land affected by this
rezoning petition into Metropolitan Urban Service Area (MUSA).
At the September 15th public hearing no testimony was received on this
petition. Now, with the action taken by the Metropolitan Council,
approval of this rezoning would be consistent with the policies of the
City of Rosemount's Comprehensive Guide Plan.
RECOMMENDED ACTION: A MOTION to adopt Ordinance B-24, AN ORDINANCE
AMENDING ORDINANCE B, CITY OF ROSEMOUNT ZONING ORDINANCE.

CITY OF ROSEMOUNT ZONING ORDINANCE
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS:
Section 1. Ordinance No. B, adopted September 19, 1989, entitled "City of Rosemount Zoning
Ordinance," is hereby amended to rezone from AG Agriculture to R-1 Single Family Residential the
following described property located within the City of Rosemount, Minnesota to -wit:
That part of the South Half of the Northeast Quarter (Slh of NEIA) of Section 31, Township 115,
Range 19 described as follows: Beginning at the northeast comer of O'LEARY's HILLS FOURTH
ADDITION, according to the recorded plat thereof, thence south 89 degrees 46 minutes 31 seconds east,
assumed bearing, along the north line of said South Half of the Northeast Quarter (S'h of NEI/)
1,578.10 feet to the northeast comer thereof, thence south 00 degrees 44 minutes 26 seconds west
along the east line of said South Half of the Northeast Quarter (S 1h of NE 1/) 300.01 feet; thence north
89 degrees 46 minutes 31 seconds west 190.00 feet; thence south 00 degrees 44 minutes 26 seconds
west 30.00 feet; thence north 89 degrees 46 minutes 31 seconds west 1,231.03 feet; thence southerly
along a �nontangential curve which is concave to the east, central angle of 01 degrees 37 minutes 53
seconds, radius of 785.38 feet, chord bearing of south 11 degrees 34 minutes 35 seconds west, 22.36
feet to a northeast corner of said O'LEARY's Hu -Ls FouRTH ADDITION; thence north 79 degrees 14
minutes 21 seconds west along said plat line 60.00 feet; thence north 83 degrees 49 minutes 52
seconds west along said plat line 125.00 feet; thence north 06 degrees 04 minutes 39 seconds east
along said plat line 329.72 feet to the point of beginning; and, as of the date of City Council approval
and publication of this ordinance, the property described as O'LEARY's HILLS FIFTH ADDITION.
Section 2. The Zoning Map of the City of Rosemount, referred to and described in said
Ordinance No. B as that certain map entitled "ZONING MAP OF THE CITY OF ROSEMOUNT", shall not
be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said zoning
map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove provided for
in this Ordinance and all of the notation references and other information shown thereon are hereby
incorporated by reference and made a part of this Ordinance.
Section 3. This ordinance shall be effective immediately upon its passage and publication
according to law.
Enacted and ordained into an Ordinance this 3rd day of November, 1992.

Mr. Timothy Broback of Parkview Inc., is requesting final pla approval of
O'Leary's Hills Fifth Addition. the 11.9 -acre plat includes 35 single
family lots with a gross density of 2.9 dwelling units per acre. The plat
is the fifth phase of the O'Leary's Hills Planned Unit Development (PUD)
between Chippendale Avenue and Shannon Parkway.
Prior to approval of the final plat, the property must be rezoned to R-1
(Single Family Residential). Presently, it is zoned AG (Agriculture). A
Comprehensive Guide Plan Amendment is being processed by the Metropolitan
Council that incorporates this plat into the Metropolitan Urban Service
Area (MUSA). This amendment will allow the diversion of Section 31
sanitary sewer to the Empire Waste Water Treatment Plant. Once approved by
the Metropolitan Council, this rezoning will be consistent with the
Comprehensive Guide Plan and with the Urban Service Area Extension
policies. `
The Guide Plan Amendment must be approved prior to Council action on the
rezoning and final plat approval. In the interest of avoiding delays on
this project, Planning staff suggests that the Council hold the public
hearing for the rezoning, close the hearing, and then table action until
the amendment is approved.
RECOMMENDED ACTION: A MOTION to table action until the Metropolitan
Council -approves Comprehensive Guide Plan Amendment No. 22.

On Tuesday, August 11, 1992, the Planning Commission passed a motion to recommend
approval of the final plat for O'Leary's Hills Fifth Addition, as requested by Mr. Tim Broback of
Parkview, Inc. This 35 -lot phase of the O'Leary's Hills Planned Unit Development is dependent
on Metropolitan Council approval of the Comprehensive Guide Plan Amendment that will divert
Section 31 sanitary sewer effluent to the Empire Waste Water Treatment Plant. Approval of the
final plat also requires rezoning from Agriculture (AG) to Single Family Residential (R-1).
The Guide Plan Amendment must be approved prior to council action on the rezoning and final
plat approval. In the interest of avoiding delays on this project, Planning staff suggests that the
Council hold the public hearing for the rezoning at this time. After the Metropolitan Council
approves the Comprehensive Guide Plan the final plat and rezoning can be placed on the next
available City Council agenda for formal action.
In addition, the Council will review an amendment to the O'Leary's Hills Planned Unit
Development (PUD) that will outline anticipated future phases of the project. Action will be
requested on this item at the time of the Public Hearing, as the PUD Amendment is not
dependent upon the Comprehensive Guide Plan Amendment.
Mr. Broback has also requested rezoning a parcel that will yield two lots called O'Leary's Hills
Sixth Addition, adjacent to O'Leary's Hills First Addition, and north of 155th Street West. The
lots would have been part of a later phase of the PUD, however, with the construction of 155th
St. W., the services are in place and the land is in the MUSA. The Planning Commission will
review the final plat and rezoning at their September 8, 1992 Regular Meeting and will make a
recommendation for Council consideration at the Public Hearing on September 15, 1992.

consideration of an amendment to the O'Leary's Hills Planned Unit De-
velopment to reflect a revised phasing plan for this subdivision.
