At the September 15 Council meeting this agreement was first presented
and discussed. Council gave Staff the direction to explore other
alternatives, including one entity providing the service as a contract -
of sorts and the other entity making cash payment.
I have spoken with Mr. Bob Rotty, Nininger Township Chairperson,
regarding their preferences. They contract for all township
maintenance and have no preference. They do have -a road intersecting
with Fischer so they will have somebody in the area anyway. They
could logically maintain Fischer Avenue at those times. We do not
have roads in the area and must make a special trip to this area. Mr.
Rotty suggested we submit a proposal for their consideration.
I have prepared a proposal with Rosemount making cash payment to
Nininger. The cash payment amount of $1,100 referred to in the
Agreement was calculated using our 1992 maintenance costs. Since we
would normally provide all maintenance on alternate years, I simply
divided those costs by two (2) to arrive at an annual payment amount.
Gravel costs would be determined by joint inspection and agreement on
how much is needed. The total cost would then be split 50/50.
This Agreement has been presented to Nininger, however they have not
met to discuss it. They will meet November 17th.
Staff is recommending, if Nininger Township agrees, to enter into this
Maintenance Agreement for the maintenance of Fischer Avenue
RECOMMENDED ACTION: MOTION TO APPROVE THE MAINTENANCE AGREEMENT FOR
FISCHER AVENUE BETWEEN THE CITY OF ROSEMOUNT AND NININGER TOWNSHIP AND
AUTHORIZE THE NECESSARY SIGNATURES PROVIDING NININGER TOWNSHIP AGREES
TO THE AGREEMENT.

CITY OF ROSEMOUNT/TOWNSHIP OF NININGER-FISCHER AVENUE MAINTENANCE
AGREEMENT
This agreement, made and entered into this _ day of , 1992, by and
between the Township of Nininger, a municipal corporation, hereinafter referred to as
"Nininger", and the City of Rosemount, a municipal corporation, hereinafter referred
to as "Rosemount".
WHEREAS, each of the parties has, by appropriate action, authorized its officers
to enter into this agreement.
WHEREAS, it is mutually agreed by and between the parties hereto that the
maintenance and upkeep of Fischer Avenue (a border road) will be shared between
Rosemount and Nininger.
WHEREAS, Rosemount desires to make cash payment to Nininger for
maintenance of Rosemounts Fischer Avenue;
WHEREAS, -Nininger will plow, grade and cut road ditches on Rosemount's
Fischer Avenue every year.
WHEREAS, Nininger prefers Class V crushed rock to Rosemounts Class V
aggregate and consistency is desirable, Rosemount prefers to make cash payment for
graveling.
NOW, THEREFORE, all gravel costs on Fischer Avenue would be split on a 50-
50 basis and any graveling of Fischer Avenue must be agreed to by both Rosemount
and Nininger before any of this work is commenced.
FURTHER THEREFORE, Rosemount will make an annual cash payment of
51,100 (One Thousand, One Hundred) for routine maintenance of Rosemounts Fischer
Avenue excluding gravel costs.
IN TESTIMONY WHEREOF, each of the parties hereto has caused this
agreement to be executed on its behalf by its respective officers as of the date and
year first above written.
