How prudent does the Port Authority want to be? I've visited with representatives of the Soo Line Railroad about the property at C.R. 42 and T.H. 3. They've stated they have no knowledge of any contamination of the soil or water outside of some surface contaminants usual with truck repair activity. The cost of a straight -forward Phase 1 environmental audit for a parcel this size (with no soil borings or laboratory analysis) will be in the $1,800 - $2,100 range. Federal legislation does protect the "unknowing buyer" who purchases land and later finds it contaminated. The "unknowing buyer" is however defined as someone who has made a reasonable effort to determine whether the property is contaminated, i.e. completed at least a Phase 1 audit. My recommendation? I don't believe anyone (since buying a 1975 Ford Maverick several years ago) likes surprises. Have the work completed. RECOMMENDED ACTION: Motion to direct John Miller to have a Phase 1 environmental audit completed on the Soo Line property.
