At the Port Authority's October 20 work session, the commissioners
discussed code compliance with city inspection personnel. There was
agreement that codes were to be met by the Port Authority in its
activities. There was also general agreement that a resolution "re-
affirming" this position would be helpful to city and Port Authority staff
people as it would show these issues were not negotiable.
A resolution adopting this position is attached for your review.
RECOMMENDED ACTION:
Motion to approve A RESOLUTION REAFFIRMING PORT AUTHORITY'S COMPLIANCE
WITH CITY OF ROSEMOUNT BUILDING SAFETY AND ZONING CODE REQUIREMENTS.

RESOLUTION 1992 -
A RESOLUTION RE -AFFIRMING PORT AUTHORITY COMPLIANCE WITH
CITY OF ROSEMOUNT BUILDING, SAFETY, AND ZONING CODE REQUIREMENTS
WHEREAS, Minnesota Statute Section 469.0813 permits the creation of the
Rosemount Port Authority and bestows upon it the same powers as a Port
Authority established under Section 469.001 to 469.047 with approval of the
Rosemount City Council; and
WHEREAS, the Rosemount City Council has adopted an enabling resolution to
create the Rosemount Port Authority, Resolution 1992-85; and
WHEREAS, the Rosemount Port Authority will in due course of completing its
responsibilities as permitted by law (including but not limited to) be
involved in construction of speculative buildings, relocation of
businesses, and redevelopment of purchased properties.
NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of the
Rosemount Port Authority as follows:
1. It is the intention and responsibility of the Port Authority to
meet all City of Rosemount building, safety and zoning codes.
2. The Port Authority staff is directed to work with city building,
fire, police, and planning staff to meet city code requirements
of all Port Authority initiated or aided projects.
