All costs are in and ready for assessing. This project is being assessed using the assessment policy in effect at the time .of initiation and not the recently adopted policy. City Project No. 213 extended the trunk 1211_watermain from Chippendale Avenue east to Biscayne Avenue. It was initiated on April 17, 1990. On June 5, 1990 a' -revised report was authorized to study an alternate route. The P blit Hearing was held June 5, 1990 and the original project alignment was ordered. The Feasibility Report project cost estimate was $260,000. The project was completed in late 1991. The _final project costs totalled $250,:688 and*are itemized on the spreadsheet entitled "Breakdown Report". Watermain Core Funds will pay for one half the costs due to the fact that a 121 watermain is required in a general industrial area, but the southerly frontage of 160th Street is in Empire Township and is not assessable. The Core funds will pay for $125,344 while the remaining $125,344 is 1000 assessable to the benefiting properties adjacent to 160th Street. The project was assessed on a front foot basis Staff is recommending declaring cost and setting a public hearing for October 20, 192 at 8:00 p.m. or as soon thereafter as possible. RECOMMENDED ACTION: A RESOLUTION DECLARING COST TO BE ASSESSED AND -ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT, 160th STREET WATERMAIN EXTENSION, CITY PROJECT #213.' COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1992 - A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREP TION OF PROPOSED ASSESSMENT, AND CALLING OR HEARING ON THE PROPOSED ASSESSMENT 160TH STREET WATERMAIN IMPROVEMENTS CITY PROJECT #213 WHEREAS, a contract has been let for 160th Street Watermain Improvements and the contract price for such improvement is $169,770.00, and the expenses incurred or to be incurred in the making of such improvement amount to $80,918.00 so that the total cost of the im rovement will be $250,688.00. NOW, THEREFORE, BE IT RESOLVED by the City Council of Rosemount Minnesota: 1. The portion of the cost of such improvement to be paid by the City is hereby declared to be $125,344.00 and the portion of the cost to be assessed against benefited property owners is declared to be $125,344.00. 2. BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. LIMITATION ON No appeal may be taken as to the amount of APPEAL: any assessment adopted by the City Council unless a written objection signed by the affected property owner is filed with the Clerk prior to ,the assessment hearing or presented to the presiding officer at the hearing. All objections to the assessments not received at the assessment hearing in the manner prescribed by Minnesota Statutes, Section 429.061 are waived, unless -the failure to object at the assessment hearing is due to -a reasonable cause. DEFERMENT OF Under the provisions of Minnesota ASSESSMENTS: Statutes, Sections 435.193 to 435.195, the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. However, the City has elected not to establish any deferment procedure pursuant to those Sections. PREPAYMENT: You may prepay the entire assessment to the Treasurer of the City until the assessment roll is certified to the County Auditor; after certification to the County Auditor, prepayments of the entire amount remaining due may be made to the County Auditor at any time prior to November 15 in the year this assessment is adopted. NO PARTIAL The City Council has not authorized the partial prepayment of assessments prior to certification of the assessment or the first installment thereof to the County Auditor. PREPAYMENT WITHOUT No interest shall be charged if the entire assessment INTEREST, OR WITH is paid within 30 days from the adoption of the INTEREST TO EN OF assessment roll. Assessments shall be payable in equal annual installments extending over a period of up to 10 years, the first of the installments to be payable with general taxes for the year 1992, collectible with such taxes during the year 1993.
