Declare Cost / Set Assessment for Chippendale Avenue Improvements, City Project #191Y CITY OF ROSEMOUNT EXECUTIVE SUMMARY FOR ACTION CITY COUNCIL MEETING DATE: September 29, 1992` AGENDA ITEM: Declare Attached is a copy of a spreadsheet showing all cost f Chippendale Avenue Improvements - Project #191. All costs are in and ready for assessing.This project is being assessed using the assessment policy in effect at the time of initiation and not the recently adopted policy. City Project No. 191 was initiated by the City Council on July 19, 1988 to improve Chippendale Avenue from 160th Street to 151st Street. The initial pan was to construct Chippendale Avenue to -a 48' wide, Municipal State Aid (MSA) street in compliance with MSA Standards, plus required public utilities for this segment. The project cost estimate for this design was $450,000. The Engineering Plans were completed for this 48' design. However, the project was delayed due to lack of, MSA funding and MNDOT delay of the Trunk Highway 3 Improvements, which are just now being constructed. (Chippendale was to be used as 'a detour route during the T.H. #3 construction.) The project scale down to provide a minimum width paved surface with a cost estimate of '$270,000, which was reported to Council on May 10, 1990 A Public Hearing was held June 5, 1990 and the scaled down project ordered the final project costs totalled $191,973 and are itemized on the spreadsheet entitled "Breakdown Report". The Watermain Core Fund will pay for the oversizing cost of the 12" watermain which was installed within Chippendale. This amounts to $9,116. The remaining $182,857 is 1009. assessable to the benefiting properties'. The method used was on,'a unit (acre) basis. the project' was completed in late 1991. Staff is recommending declaring cost and setting a public hearing for October 20, 1992 at 8:00 p.m. or as.soon thereafter as possible.- RECOMMENDED -ACTION: A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT, CHIPPENDALE AVENUE IMPROVEMENTS, CITY PROJECT #191. COUNCIL ACTION: 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1992 - A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING OR HEARING ON THE PROPOSED ASSESSMENT CHIPPENDALE AVENUE IMPROVEMENTS CITY PROJECT #191 WHEREAS, a con ract has been let for Chippendale Avenue Imrovements and the contra::t price for such improvement is $143,722.00, and the expenses incurred or to be incurred in the making of such improvement amount to $48,251.00 so that the total cost of the improvement will be $191,973.00. NOW, THEREFORE, BE IT RESOLVED by the City Council of Rosemount Minnesota: 1. The portion of the cost of such improvement to be paid by the City is hereby declared to be $9,116.00 and the portion of the cost to be assessed against benefited property owners is declared to be $182,857.00. 2. Assessments shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with general taxes for the year 1993, and shall bear interest at the rate of 216 points per annum above the interest rate paid by the City for its bonds from date of the adoption of the assessment resolution. 3. The City Clerk, with the assistance of the Public Works Director shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his offi e for public inspection; and BE IT FURTHER "SOLVED by the City Council of Rosemount, Minnesota: 1. A hearing shall be held on the 20th day of October, 1992, in the City Hall at 8:00 p.m., or as soon thereafter as possible, to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such ass ssment. 2. The City Clerk is hereby directed to cause a notice of the hearing n the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and she shall state in the notice the total cost of the Resolution 1992 - improvement. She shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. ADOPTED this 29th day of September, 1992. ATTEST: Susan M. However, the City has elected not to establish any deferment procedure pursuant to those Sections..
