RECOMMENDED MOTION: Motion to approve the variance petition of Jesse
Blankenship for setback variance for the east side yard (interior) because the request
meets the requirements of Section 15.2 of the Zoning Ordinance, subj the
variance allowing the'nummum encroachment into the setback to orm y;

NATURE OF REQUEST:
A"I , )e
Mr. Blankenship intends to construct a deck along the east side of his house, approximately
12.5 feet from the side yard property line. The zoning is R-1 Single Family Residential.
The house was constructed with a sliding door on the first floor of a split -entry house.
There is currently no access between the sliding door and the ground below. The sliding
door is approximately five feet above ground level and is about 12.5 feet from the side yard
property line. The side yard setback is ten feet. The proposed deck will provide a
connection to the rear yard were a larger deck will be constructed.
BACKGROUND:
The Planning Commission will recall that variances have been granted for decks that
encroach into setback areas only enough to provide "traffic" space to another location that
provides enough space' to build a deck with out causing setback encroachments.
This is in contrast to granting a variance for a deck that provides useable or functional space
for chairs and tables that encroaches into a setback area.

REQUIRED FINDING:
In order to grant a variance, the Planning Commission is required to make the following
findings:
1. Granting a variance will not adversely affect the public health, welfare and safety and
will not be detrimental or injurious to property or improvements in the neighborhood.
2. Strict interpretation or enforcement would result in a practical difficulty or
unnecessary hardship inconsistent with the intent of this ordinance and the
Comprehensive Guide Plan.
There are exceptional or extraordinary circumstances or conditions applicable to the
property, use or facilities that do not apply generally to other properties in the same
district.
4. Strict or literal interpretation would deprive the applicant of the use -and enjoyment of
his property in a manner similar to other owners in the same district.
5. Granting of the variance will not allow a use which is otherwise not a permitted use
in the zoning district in question.
DISCUSSION:
The proposed deck would be six feet wide in the side yard for the "traffic space." The
width is necessary to clear the two foot deep fireplace chase and meet building code
requirements. The deck in the rear yard area expands to about 12 x 20 ft. (240 sq. ft. )
The adjacent house to the east is about 13 feet east of the property line and has no windows
along the wall that faces the petitioners' proposed deck.
The Building Inspection Staff have indicated that three feet of clearance around the chimney
would meet the minimum uniform building code requirements. Mr. Blankenship has
requested a variance that would allow for a two foot encroachment into the
setback by a deck that ,would be one foot wider than minimum building code standards.
Although the same amount of materials would likely be used, the Planning Commission may
consider granting a variance that results in as minimal encroachment into the setback as is
necessary to conform to the Uniform Building Code. That would result in a one foot
variance to the side yard setback. This would result in a variance that continues a precedent
of not allowing excessive variances to the Zoning Ordinance.

I have requested anfoot variance to facilitate building a.
deck on the south end of home with access from a sliding door on
the east end ',south to the back of my home with a 4 foot walkway
past the fireplace chase_
The builder with whom I had contracted this home positioned it
so close to the east property line that I am unable to build the
deck as the house was designed_ I instead must attach it to the
rear of the house with a walkway from the sliding door_
This variance would only be 2 feet closer than current setback
requirements_' It would not represent a severe deviation from any
other building or deck construction and would not be detrimental to
the property or neighborhood_
Failure to receive this variance would render the sliding door
useless, and would eliminate any possibility of building a deck on
this home_
The deck proposed is of size and construction quality consistent
with those of neighboring houses_ It will not be covered by a roof
nd will be constructed by a reputable licensed contractor_
Code requirements will be met for aG�e�e and construction

NOTICE IS HEREBY GIVEN, the Planning Commission of the City of Rosemount
will hold a public hearing on Tuesday, September 8, 1992 in the Council Chambers
of the City Hall, 2875 145th Street West, beginning at 5:30 p.m. or as soon thereafter
as possible. The public hearing listed below pertains to the following described
property;
LOT 1, BLOCK 2, O'LEARY's HILLS 4TH ADDITION
The purpose of this hearing is to receive comments on a requested variance to Zoning
Ordinance side yard setback requirements to permit construction of an attached deck'
to within. eight (8) feet of the side yard property line of subject property. The Zoning
Ordinance requites ten (10) feet side yard setbacks for decks exceeding three (3) feet
in height in the R-1 Single Family Residential District.
Such persons as desire to be heard with reference to this item will be heard at this
meeting on Tuesday, Sotetnber 8. 1992.
