"'BY: At the October 1, 1991 City Council Meeting, the Council set a public hearing for November 19, 1991 for the Master Transmission Rezoning Petition. The Council also requested that staff review the tape recordings of the Council Meetings when this section of the Zoning Ordinance was discussed and report their findings to the Council and Planning Commission. Due to a misunderstanding of the intent of the motion passed by the Council, Planning staff did not publish a public hearing notice for tonight's meeting. Planning staff is just completing its investigation of the City Council's deliberations on the 1989 Zoning Ordinance revision. As well, the EDA will be hosting the first workshop on the Downtown Plan on Saturday, November 23, 1991, and after the workshop, the Planning Commission and Council will be in a better position to review this Rezoning Petition. Therefore, Planning staff is recommending that the hearing be reset for December 3, 1991. I will provide a verbal explanation of this item under Department Heads Report. Council's consideration for resetting the public hearing date will be under the Consent Agenda. The property is presently zoned C-2 Community Commercial and auto service businesses are mot permitted in that Zoning District. Mr. Mckinley's business is considered a legal nonconforming use because it was legally established prior to 1989 when the Zoning Ordinance was changed. Legal nonconforming uses are permitted to continue in the C-2 district, but the Ordinance prohibits them from expanding. Therefore, Mr. Mckinley is requesting that the property be rezoned to C-3, a district which permits auto service business so that he can add a new building to his site. Planning Staff recommends that the City Council set a public hearing to consider the rezoning petition. The Public Hearing will be scheduled for the October 15, 1991 Council meeting.
