A preliminary plat of Rachels Wood Subdivision has been submitted by
Donovan &'Sandra Tousignant. This proposed 2 lot subdivision is
approximately 11 acres and is situated on the west side of Dodd Boulevard,
just south of 120th Street West. This plat is an adjustment of a common
lot line of two existing metes and bounds lots;. no additional parcels will
be created. Both resulting parcels will be conforming RR Rural Residential
lots.
The Planning Commission reviewed the preliminary plat at the November 19th
regular meeting and recommended approval subject to revision of the public
right-of-way dedication for Dodd Boulevard.
RECOMMENDED ACTION:
A motion to adopt A RESOLUTION APPROVING RACHELS WOOD PRELIMINARY PLAT.

RACHELS WOOD PRELIMINARY PLAT
WHEREAS, the City of Rosemount has received a preliminary plat
known as Rachels Wood; and
WHEREAS, the Planning Commission of the City of Rosemount has
reviewed said preliminary plat and submitted its recommendations
to the City Council; and
WHEREAS, therequiredpublic hearings and notifications have been
completed.
NOW THEREFORE BE IT RESOLVED, the City Council of the City of
Rosemount approves the Rachels Wood Preliminary Plat, subject to
revision of the public right-of-way dedication for Dodd
Boulevard.

RECOMMENDED MOTION: A motion to recommend approval of the
preliminary plat subject to the revised right-of-way dedication.
BACKGROUND: A preliminary plat of Rachels Wood Subdivision has
been submitted by Donovan and Sandra Tousignant. Rachels Wood is
a two lot subdivision of 11.13 acres located on the southwest
corner of 120th Street West and Dodd Boulevard. Presently this
site consists of three metes and bounds parcels. The southern
metes and bounds parcel is 2.50 acres and the northern two metes
and bound parcels have been combined into one development lot
totaling 8.63 acres. The northerly two parcels are in two
different sections and the County will not allow the combination
of metes and bounds parcels that are in different sections. For
purposes of the city's regulations the northerly two parcels are
considered one developable lot and in fact, the existing home on
the property straddles both of those lots. As it currently
exists, the southerly metes and bounds lot of 2.5 acres has
limited development potential because of soil conditionsand
wetlands on the westerly two-thirds of the lot. The existing
structures on the proposed Lot 1 meet setback requirements.
The Tousignants are requesting to readjust the lot lines to
create two platted parcels: Lot 1, the northerly lot, would be
5.54 acres and Lot 2, the southerly lot, would be 5.59 acres. The
subject property is zoned Rural Residential. The minimum lot
size in the RR district is 2.5 with a maximum density of l lot
per five acres for a subdivision.

Under the definition of subdivision in the city of Rosemount
Subdivision Ordinance, this type of common lot line adjustment is
exempted from the park dedication requirements because it is
considered an administrative correction.
The westerly area of the subject property contains soils
classified as wetlands. The attached letter from the Department
of Natural Resources (DNR) indicate that the wetland on this
property is not regulated under the shoreland zoning requirements
so there are no restrictions regarding minimum lot size,
structure setbacks, etc. Any grading, filling, draining, and
stormwater outfalls within the wetland area do, however, require
a permit from the DNR.
At the City's request, the applicant provided a percolation test
for Lot 2. The Building Inspection staff has reviewed the data
and has determined that a septic system can be properly installed
on the site but a mound system may be required depending on the
siting of the house. Between the required front and side yard
setbacks, the wetland area and the septic suitability
limitations, the building envelop for a house is a relatively
small portion of the 5.54 acre lot. There does, however,appear
to be ample room for building a reasonable house.
According to the Public Works Department the required right-of-
way for Dodd is 60 feet. The preliminary plat shows 66 feet.
The final plat should be revised to reflect the 60 foot right-
of-way.

I have reviewed the preliminary plat and half -section map you sent
me regarding the subject land division. As we discussed during our
phone conversation on November 18, 1991, DNR wetland #19-182W is
located on the west end of the property, portions of which are
situated in both Lots 1 and 2. My records indicate wetland 182W is
a type III wetland (cattail marsh), roughly six acres in size.
Because the wetland is less than ten acres in size, it is not
subject to shoreland zoning requirements of the state. As such,
there are no state restrictions regarding minimum lot size,
structure setbacks, impervious coverage, etc. Activities within
the boundaries of the wetland, however, are subject to DNR permit
rules. Grading, filling, draining, and stormwater outfalls, to
name a few, require permit approval from this office. For
regulatory purposes, the limits of DNR jurisdiction is confined to
that area of the wetland lying below the ordinary high water
elevation (OHW). Based on the half -section map, I'm guessing the
OHW of 19-182W to be somewhere between the 938' and 940' contour.
A field inspection would be necessary to more accurately define the
OHW.
Also, I noted several inaccuracies on the half -section map in terms
of identifying DNR wetlands. I'm returning the map, with those
inaccuracies identified. As we discussed, when we get together
after Thanksgiving, I will bring along the office copy of our mylar
overlays. These overlays more clearly depict the location of DNR -
regulated wetlands
As you are probably aware, the U.S. Army Corps
has jurisdiction over wetlands, often above
jurisdiction. I encourage you to consult with
matters.

The Port Authority Enabling Resolution approved by the City Council on
September 3, 1991, stated that the effective date of the Port Authority
would be January 2, 1992.However, appointments to the Port Authority will
not be made until the second regular City Council meeting in January
(January 21, 1992) per the Committee Selection Policy.
Therefore, a resolution amending the Port Authority Enabling Resolution has
been prepared by City Attorney, Eric Short, to delay the effective date of
the Rosemount Port Authority until February 4, 1992.
RECOMMENDED ACTION: MOTION TO APPROVE A RESOLUTION MODIFYING THE
COMMENCEMENT DATE FOR ROSEMOUNT PORT AUTHORITY,
A DEVELOPMENT AGENCY.
