The property owners are Donovan and Sandra Tousignant and their existing home is located on northerly parcel. The proposed lots meet the standards for lots in the Rural Residential zoning district. The preliminary plat was approved by the City Council on December 3rd, subject to a revision of the public right-of-way dedication for Dodd Boulevard. The Planning Commission reviewed the final plat of Rachels Woods on December 10 and recommended approval. I RECOMMENDED ACTION: A motion to approve A RESOLUTION APPROVING RACHELS WOOD FINAL PLAT. COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1991- A RESOLUTION APPROVING RACHELS WOOD FINAL PLAT WHEREAS, the City of Rosemount has approved the Rachels Wood subdivision preliminary plat; and WHEREAS, the Planning Commission of the City of Rosemount has recommended approval of the final plat for Rachels Wood. Rachels Wood subdivision is a two -lot subdivision of approximately 11 acres and is situated on the west side of Dodd Boulevard, just south of 120th Street West. The property owners are Donovan and Sandra Tousignant and their existing home is located on the northerly parcel. As you will recall, the Planning Commission recommended approval of the preliminary plat at the November 19th Planning Commission Meeting. The City Council approved the preliminary plat on December 3rd, subject to the revision of the public right-of-way dedication for Dodd Boulevard. The final plat is being prepared by Del Schwan and he has indicated that it would be complete on Monday, December 9th. Planning Commission will not meet again in December and the Tousignants are trying to complete a real estate transaction on the property yet this year. BACKGROUND: A preliminary plat of Rachels Wood Subdivision has been submitted by Donovan and Sandra Tousignant. Rachels Wood is a two lot subdivision of 11.13 acres located on the southwest corner of 120th Street West and Dodd Boulevard. Presently this site consists of three metes and bounds parcels. The southern metes and bounds parcel is 2.50 acres and the northern two metes and bound parcels have been combined into one development lot totaling 8.63 acres. The northerly two parcels are in two different sections and the County will not allow the combination of metes and bounds parcels that are in different sections. For purposes of the City's regulations the northerly two parcels are considered one developable lot and in fact, the existing home on the property straddles both of those lots. As it currently exists, the southerly metes and bounds lot of 2.5 acres has limited development potential because of soil conditions and wetlands on the westerly two-thirds of the lot. The existing structures on the proposed Lot 1 meet setback requirements. The Tousignants are requesting to readjust the lot lines to create two platted parcels: Lot 1, the northerly lot, would be 5.54 acres and Lot 2, the southerly lot, would be 5.59 acres. The subject property is zoned Rural Residential. The minimum lot size in the RR district is 2.5 with a maximum density of 1 lot per five acres for a subdivision. 6veriylkings Coom1ng ( J6 gosemounlY Rachels Wood Page 2 Under the definition of subdivision in the City of Rosemount Subdivision Ordinance, this type of common lot line adjustment is exempted from the park dedication requirements because it is considered an administrative correction. The westerly area of the subject property contains soils classified as wetlands. The attached letter from the Department of Natural Resources (DNR) indicate that the wetland on this property is not regulated under the shoreland zoning requirements so there are no restrictions regarding minimum lot size, structure setbacks, etc. Any grading, filling, draining, and stormwater outfalls within the wetland area do, however, require a permit from the DNR. At the City's request, the applicant provided a percolation test for Lot 2. The Building Inspection staff has reviewed the data and has determined that a septic system can be properly installed on the site but a mound system may be required depending on the siting of the house. Between the required front and side yard setbacks, the wetland area and the septic suitability limitations, the building envelop for a house is a relatively small portion of the 5.54 acre lot. There does, however, appear to be ample room for building a reasonable house. According to the Public Works Department the required right-of- way for Dodd is 60 feet. The preliminary plat shows 66 feet. The final plat should be revised to reflect the 60 foot right- of-way. The preliminary plat meets all other applicable city requirements' and standards.
