FREESE, DIRECTOR OF PLANNING ATTACHMENTS: ORDIN; PETITION; MC RESPONSE; APPROVED BY: HEARING NOTICE & MAILING LIST; LOCATION MAP , V In July, the Metropolitan Council reviewed and approved the City's Minor Comprehensive Guide Plan Amendment pertaining the Solberg proposal to relocate their business to a 10 acre parcel located at the northeast corner of Highway 52 and County Road 42. The property in Rosemount where their current business is located has been sold to Koch Refinery. On this proposed site, Solberg intends to build a office/repair shop building and equipment storage yard. Solberg Aggregate has submitted a petition requesting to rezone the property from Agricultural to General Industrial. There are no apparent inconsistencies in this request with respect to the Guide Plan or the City's desire to expand the industrial district in the Pine Bend Area. The recent deliberations on the Comprehensive Guide Plan update affirm that position. Based on the fact that this request is in conformance with the Guide Plan and is consistent with the land use pattern in the Pine Bend Area, the Planning Commission recommended approval of the rezoning at the September 24 Regular Meeting. RECOMMENDED ACTION: A motion to adopt Ordinance No. B-14, AN ORDINANCE AMENDING ORDINANCE B, CITY OF ROSEMOUNT ZONING ORDINANCE. COUNCIL ACTION: CITY OF ROSEMOUNT ORDINANCE NO. B-14 AN ORDINANCE AMENDING ORDINANCE B CITY OF ROSEMOUNT ZONING ORDINANCE THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS: SECTION 1. Ordinance No. B, adopted September 19, 1989, entitled "City of Rosemount Zoning Ordinance," is hereby amended to rezone from Agriculture to IG General Industrial the following described property located within the City of Rosemount, Minnesota to -wit: A tract of land in the Southwest Quarter of the Northwest Quarter (SW341 of NW-'-*) of Section 30, Township 115, Range 18, Dakota County, Minnesota, described as follows: Commencing at a point on the south line of said Northwest Quarter (NW ;),,700.53 feet east of the southwest corner thereof; thence north perpendicular to the last described line, 50.0 feet to the actual point of beginning of the land to be described. Thence continuing north on the last described line, 832.25 feet; thence west 646.79 feet to the easterly boundary of State Trunk Highway No. 56; thence south 16 degrees, 31 minutes east along said highway boundary 868.07 feet; thence east 400.0 feet to the point of beginning. Containing 10 acres. SECTION 2. The Zoning Map of the City of Rosemount referred to and described in said Ordinance No. B as that certain map entitled, "Zoning Map of the City of Rosemount," shall not be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove provided for in this Ordinance and all of the notation references and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance. Box 510 Rosemount, MN 55068 612 291-6359 FAX 612 291-6550 77Y 612 291-0904 RE: Concurrent Review - City of Rosemount Comprehensive Plan Amendment Review and Land Use Change in an Airport Search Area, Solberg Aggregate/Construction Metropolitan Council District No. 16 Metropolitan Council Referral File No. 15404-1 Dear Mr. Jilk: The Metropolitan Council received Rosemount's proposed comprehensive plan amendment and application for land use change/rezoning in the "Dakota" airport search area on April 19, 1991. On May 3, 1991 the Chair determined that the proposed plan amendment was incomplete for Council review, and that the land use change application as submitted was inconsistent with the Rosemount comprehensive plan. The city's letter of June 26, 1991 and subsequent conversations between Dean Johnson and Council staff responded to the Council's request for more information. The proposed plan amendment is now complete for review. Council staff have reviewed the proposed plan amendment and have determined that it has no potential impact upon any of the metropolitan system plans. The city may place the amendment into effect immediately. Council staff have also completed a review of the apparent consistency of the proposed amendment with other adopted chapters of the Metropolitan Development Guide and have found no inconsistencies. Enclosed is a copy of the comments as they will appear on the Council's consent list for non -controversial items. Formal action by the Council will take place on July 25, 1991, and will complete the Council's review of the amendment. The Council's determination on the plan amendment means that the application for the land use change and rezoning in the airport candidate search area is consistent with the amended Rosemount comprehensive plan. -f -herefore, the Council will waive further review and comment on this application, and the city can implement the land use change/rezoning immediately. City of Rosemount Comprehensive Plan Amendment Solberg Aggregate/Construction, Metropolitan Council Referral File No. 154041, Metropolitan Council District No. 16 The Rosemount plan amendment proposes to change the land use designation from Agricultural to General Industrial and rezone 10 acres of a 38 -acre site located in the northeast quadrant of US 52 and CSAR 42. The site is in the "Dakota" airport search area. The site is adjacent to the Pine Bend Industrial Area immediately to the north. This area contains - six petro -chemical industries and five manufacturing/service industries dispersed over nearly 3,000 acres of land. Koch Refining Company owns over two-thirds of the industrially zoned property and has acquired a considerable amount of the agriculturally zoned property as well. The city has been working to prepare an update to its comprehensive plan that would describe planned industrial land uses adjacent to the Pine Bend Industrial Area, for property that is now planned for agricultural uses. Although the city has not yet completed the plan update, it decided to submit this plan amendment in the interim in the belief that the proposed land use change and rezoning are compatible with the city's long-term goals for this part of Rosemount. The city is encouraged to complete the plan update as soon as possible, before allowing other land use changes/rezonings in the area. The proposed land use will be served by an on-site septic system. Metropolitan sewer service is not planned for this part of Rosemount. The Council's policy is to not extend service into the rural service area in response to pollution problems that result from development activity or inadequate management of existing sewer facilities. If the septic system should fail, the responsibility for resolving such problems rests upon the city. The city has acknowledged its responsibility in this regard.
