OF PLANNING AGENDA M 11�m # MALA ATTACHMENTS: RESOLUTION, INDENTURE, LETTER APPROVED BY: OF REQUEST, SITE PLAN, LOCATION MAP Raymond and Shelly Gifford own two adjoining lots, Lots 2 and 3 in Happy Ours Subdivision. Their house is situated on Lot 3 and is addressed as 12334 South Robert Trail. The subject properties are zoned RR Rural Residential. The Gifford's are proposing to construct a new deck on the - north side of house. The deck cannot meet the required setback so rather than seeking a variance, the Gifford's would like to legally combine the two parcels. Lot 2 is the northern parcel and it is approximately 17,400 square feet. Lot 3 is the southern parcel and it is approximately 16,200 square feet. These lots are legal nonconforming lots of record. By combining the lots together, they will become more conforming. Because the home is on septic systems it is advantageous to have larger a larger lot. Staff recommends, however, that the attached Indenture be recorded to insure that the lots are not administratively split in the future. The Indenture will only permit a division of the lots if the City's zoning ordinance changes to permit it. At the September 24 Regular Meeting, the Planning Commission reviewed this request and recommended approval of the lot combination subject to the recording of the attached Indenture. RECOMMENDED ACTION: A motion to adopt "A RESOLUTION APPROVING A LOT COMBINATION". COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY RESOLUTION 1991- A RESOLUTION APPROVING A LOT COMBINATION WHEREAS, the City of Rosemount has received a request from Raymond G. and Shelley Gifford to combine the following described lots as illustrated on the attached Exhibit A: Property A: Lot 2, Block 1 Happy Ours Subdivision Property B: Lot 3, Block 1 Happy Ours Subdivision WHEREAS, the Planning Commission reviewed this request at the September 24, 1991 Regular Meeting and has recommended approval of the lot combination subject to the recording of an Indenture for combination of Properties A and B. NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Rosemount approves the Indenture combining Properties A and B between the City of Rosemount and Raymond G. and Shelly Gifford and authorizes the signatures thereon and distribution to the County. Gifford and Shelley Gifford, husband and wife, hereinafter referred to as "The Giffords" and City of Rosemount, a Minnesota municipal corporation in the County of Dakota and State of Minnesota, hereinafter referred to as "City"; WITNESSETH: WHEREAS, the Giffords are owners of the following described premises, to wit: Property A: Lot 2, Block 1 Property B: Lot 3, Block 1 Happy Ours Subdivision Happy Ours Subdivision WHEREAS, the said Properties A and B are adjacent to each other and have a common boundary line.
