As noted in the memo, there may be some convenience in submitting the amendment to the Metropolitan Council for formal review. It is anticipated that this process will take 90 days. Many of the issues in the update of the entire guide plan may be resolved during the same time frame. The City Council is not required to take final action on the amendment until after the Metropolitan Council review is completed. Sowles plan amendment packet. The guide plan issues and previous actions by the Planning Commission and City Council surrounding the Solberg guide plan amendment, are nearly identical to those of the L.H. Sowles amendment. For this reason, I have simply attached my March 15, 1991 memo as background. The Solberg amendment is limited to a 10 -acre parcel, which is owned by Solberg. Solberg Aggregate Company wishes to relocate its current offices and contracting business to this site, in response to the acquisition of their existing operations to the north of Koch Refining Co. The proposed use would be consistent within the general industry designation of the guide plan. As with the L.H. SOWLES GUIDE PLAN AMENDMENT Attached are copies of staff memos, dated February 13, 1991; April 3, 1990; and February 8, 1990. Staff involvement in this project dates back to the spring of 1989. Also attached are copies of Comprehensive Guide Plan materials, maps and Planning Commission Minutes. Original discussions with L.H. Sowles Co. involved concerns over the use and development of the entire 55 -acre parcel under option for acquisition. L.H. Sowles indicated its immediate plans were to utilize five acres for storage of tower cranes and equipment, which are currently housed at its main office location in Minneapolis. Long term plans included relocation of the entire L.H. Sowles office and operations, a potential for its own tower crane manufacturing facility and the development of an industrial park. At staff's request, L.H. Sowles prepared a preliminary plat for the site, to illustrate access and development potential for future uses. As the review of this proposal progressed, the City Council held a "goals session" and identified the need for a complete update of the City's Comprehensive Guide Plan. One consensus of the goals session was to foster the expansion of industrial development in the Pine Bend area and to analyze the need and feasibility for public utilities in conjunction with new development. Original consideration of the L.H. Sowles guide plan amendment occurred at the February 13, 1990 Regular Planning Commission Meeting. Concerns expressed by both the Planning Commission and City Council regarded the need to evaluate the issues for development potential in the Comprehensive Guide Plan update process, before making potentially premature decisions regarding site specific development proposals. The Planning Commission and City Council were cognizant of the lengthy delay in considering the L.H. Sowles development, but acknowledged the need to sort out community wide issues prior to taking any action. The target date for completing the guide plan update was set by the Council for July, 1991. In response to concerns by the developer regarding a 15 month delay in consideration for its proposal, the City suggested revisiting the issue when the goals and policies were completed. The specific motion of the Planning Commission was to "....recommend to City Council that consideration of the L.H. Sowles Comprehensive Guide Plan Amendment application be deferred until the City has completed revision of the Goals, Policies and Objectives of the Rosemount Comprehensive Guide Plan." A year has lapsed since the City considered this proposal. The guide plan update is progressing and on schedule. The patience of L.H. Sowles is exemplary, yet they have expressed concern that some indication of the City's position be expressed at this time. L.H. Sowles Guide Plan Amendment March 19, 1991 City Council Reviews The immediate request for consideration of a guide plan amendment is limited to redesignation of the northerly 10 acres of the site to General Industry to accommodate the equipment storage needs of the company. This has been done to eliminate concerns about premature or duplicative utility provisions in the area. L.H. Sowles remains committed to pursue its long term industrial development initiatives, but would put them on hold until the guide plan update is completed. The issues here include time delays and "catch 22" scenarios. Originally the City staff pursued "commitments from the developer to "guarantee" the maximum development potential. It became clear, however, that approval of maximum development potential heightened concern over need and feasibility for public utilities, particularly adequate water supply for fire suppression and protection systems. At the City Council goals session a year ago, the need for expanding the industrial base in Pine Bend was tied to the diminishing inventory of "available" industrial property. Since that time, the acquisitions by Koch Refining Co. have accelerated and there is virtually no industrial land left on the market. As Mike Wozniak noted in his original review of this amendment, there are no apparent inconsistencies in this proposal, with respect to the current guide plan or the desire to expand industrial potential in the area. We are nearing completion of the goals and policies portion of the guide plan update process. If the Council has any desire to pursue the L.H. Sowles proposal, I would recommend authorizing staff to prepare the guide plan amendment for this proposal and resubmit it to the Planning Commission for formal recommendation. The City Council does not have to act on the amendment in order to submit the amendment to the Metropolitan Council for formal review. Because this site is located in the Candidate Search Area for the new airport, the review could take as long as 90 days. This timetable would allow the City to complete the goals and policies and draft land use plan elements of the guide plan. At the same time, if the City Council does not feel this site has the clear potential for being redesignated general industry in the new guide plan, an immediate denial of the L.H. Sowles request should be rendered. I am conscious of the time and effort and patience exhibited by L.H. Sowles and there is no point in "stringing them along" any further, if the industrial expansion is not envisioned. I would recommend City Council authorization to prepare the L.H. This application was originally submitted in January, 1990. The City Council chose to defer action on this item until completion of the Comprehensive Guide Plan. In consideration of the action by the City Council, regarding the L.H. Sowles Guide Plan Amendment hearing request, I would recommend the City Council set a public hearing to consider this request. There is proper time to publish and mail notices of this hearing, in order to be held on March 19th. The amendment being proposed requested redesignation of a 10 acre parcel of property from Agriculture to General Industrial. The property in question is situated immediately east of State Trunk Highway 52 and on the north side of C.S.A.H. 42 and is owned by Solberg. Attached with this review is a copy of the Planner's Review to the Planning Commission for the February 13, 1990 Commission Meeting. This review explains the amendment and includeds Staff recommendations. MINNESOTA 55068 612-423-4411 COMPREHENSIVE GUIDE PLAN AMENDMENT APPLICATION - SOLBERG AGGREGATE COMPANY Solberg Aggregate Company has submitted a Comprehensive guide Plan Amendment Application requesting redesignation of a 10 acre parcel of property from Agriculture to General Industrial. The property in question is situated immediately east of State Trunk Highway 52 and on the north side of C.S.A.H. 42, and is owned by Solberg. Attached with this review is a copy of a boundary survey and legal description for the property. Solberg Aggregate is a sand and gravel mining and bituminous paving business which currently operates from an 80 acre property located immediately south of Koch Refinery. Koch has purchased Solberg's current site of operations. The Refinery has agreed to lease back the property to Solberg for a period of three years. For this reason, Solberg is seeking to relocate its office and equipment storage to the 10 acre site situated at the intersection of Highways 52 and 42. Similar to the L.H. Sowles Guide Plan Amendment Application the Planning Commission in considering the Solberg Application should evaluate the proposed redesignation of the property for conformance with the Goals, Objectives and Policies of the Guide Plan. Also, the Commission should consider the appropriateness of the specific use proposed for the site as well its general suitability for any industrial use. Please refer to copies of the Guide Plan pages that were attached to the Planner's Review for the L.H. Sowles Guide Plan Amendment Application. CONFORMANCE WITH COMMUNITY DEVELOPMENT GOALS OBJECTIVES & POLICIES Similar to the L.H. Sowles Guide Plan Amendment Application, I have not identified any direct conflicts with the Community Development Goals identified on page 8 of the Guide Plan. Again, it should be referenced that the Guide Plan makes no provision for extension of public water or public sanitary sewer service for the Pine Bend Area including the site in question. I have not identified any specific conflicts with Guide Plan Objectives pertaining to Industrial Development. The site is surrounded by agricultural land uses with no residences or structures in close proximity. Again, under Industrial Development Policies it is important to recognize that Policy #3 states: "extend no public sanitary sewer and water services into the Rural Service Area prior to 1990". At this point the city has no plans to extend water or sanitary sewer to serve the property in question for the foreseeable future. the Solberg Property could be served by the Rural Water System for domestic water usage. The Rural Water System cannot be utilized to meet fire suppression needs if sprinkler systems are required for structures to be built on the site. SUITABILITY OF SITE FOR INDUSTRIAL DEVELOPMENT The 10 acre site in question is currently vacant and is planted with perennial grasses. Its topography is characterized by a large relatively flat area occupying more than half the site running from the site boundary with C.S.A.H. 42 to the north portion of the site which slopes sharply upward. The Solbergs have previously excavated sand and gravel from the site to prepare the site for future development. There are no natural constraints on the site that would preclude its use for an office and equipment storage for Solberg Aggregate. Again, as was the case with the L.H. Sowles proposal, the site does not abut other industrial designated property, but, it is situated near the major industrial area of Pine Bend which establishes a corridor of industrial use along State Trunk Highway 52 in Rosemount and Inver Grove Heights. In looking at the appropriateness of the proposed land use the Commission should consider the following issues: 1. Will the properties around the site be ultimately developed for industrial purposes? 2. Is redesignation of the site to industrial premature before decisions are made regarding the entire Trunk Highway 52 corridor? 3. Should the site be redesignated prior to the City evaluating the future of public utilities in Pine Bend? It is important that I reiterate the following statement to the Commission: In light of these issues the Commission should bear in mind that the City Council at its recent goals session has determined that among the City's major priorities for 1990 is to begin a major revision of the Comprehensive Guide Plan including a thorough revision of Goals, Objectives and Policies. Among the issues that Council is concerned with is the prospect for additional industrial development along the Highway 52 corridor. Council has expressed a concern that the City clearly analyze land use policy for the Pine Bend Area to ensure that any additional develop which occurs complements the existing industrial complex without adding to existing environmental concerns present in the area. Council is also concerned that the City in its land use policies ensures that the value of property well suited for clean industrial development is recognized and -maintained -to promote high property values and attract additional investment to the area. STAFF RECOMMENDATION Staff recommends that the Planning Commission recommend to City Council that consideration of the Solberg Aggregate Company Comprehensive Guide Plan Amendment Application be deferred until the City has completed revision of the Goals, Policies and Objectives of the Comprehensive Guide Plan. The City Council has established a target date of July 1991 for this project. It is the opinion of staff that allowing an expansion of the industrial land use designation to include the Solberg Property represents a major land use policy change and requires close scrutiny by the City. Although the site in question is relatively small it is located at an intersection of major highways and may play an important part in Rosemount's future. The property proposed for redesignation from Agriculture to General Industrial may well be suitable for industrial development; but, the City should thoroughly evaluate the need for public services and the market for industrial development before acting to redesignate to avoid long term costs of after -the -fact utility installation. Also because of the site's strategic location it is important to make a concerted effort to determine what the most appropriate type of land use would be for the site to avoid land use compatibility problems in the future. Solberg does have at least three year to accomplish relocation of its facilities which should allow more than ample time for the City to update the Guide Plan.
