A copy is attached. I would like to briefly review this with you and provide additional information on the permitting process to you at the meeting. RECOMMENDED ACTION: None. COUNCIL ACTION: None. MINNESOTA POLLUTION CONTROL AGENCY PUBLIC NOTICE ON PROPOSED COMBINED AIR AND SOLID WASTE PERMIT NOTICE IS HEREBY GIVEN, that the Commissioner of the Minnesota Pollution --- --- - Control Agency has made a preliminary determination that Combined Air and Solid Waste Permit No. 2211 -OT -91-1 should be issued to Dakota County [mailing address: 1560 Highway 55, Hastings, Minnesota 55033] and ABB Resource Recovery Systems -Combustion Engineering, Inc. [mailing address: 7 Waterside Crossing, Windsor, Connecticut 06095-0500] for the Dakota County Resource Recovery Facility to be located in Rosemount, Dakota County, Minnesota. The draft permit applies to the entire facility and authorizes the construction and operation of a resource recovery facility capable of incinerating 800 tons per day of mixed municipal solid waste. The facility will consist of two identical, independently operated, waste incinerators and associated combustion and air pollution control equipment. The draft permit includes limitations on emissions of particulate matter (including total suspended particulate (TSP) and particulate matter less than or equal to 10 microns in diameter (PM -10)), sulfur dioxide (S02), nitrogen oxides (NOx), hydrocarbons (volatile organic compounds (VOCs)), carbon monoxide (CO), lead (Pb), mercury (Hg), beryllium (Be), polychlorinated dibenzo-p-dioxins/polychlorinated dibenzofurans (PCDD/PCDF, commonly referred to as "dioxins"), hydrogen chloride (HCl) and hydrogen fluoride (HF). The proposed duration of the permit is five (5) years from the date of issuance. In accordance with Minn. Stat. Sec. 473.823 subd. 3(c), issuance of this permit was approved at the October 11, 1990 meeting of the Metropolitan Council subject to specific conditions which have been incorporated into the draft permit. The facility is subject to federal Prevention of Significant Deterioration (PSD) regulations (cited at 40 CFR 52.21). The area in which the facility is to be constructed is primary nonattainment for S02, secondary nonattainment for TSP and attainment for all other criteria pollutants. The facility is a minor source for S02 and TSP. Pollutants with potential emissions in excess of the significance levels shown in the table below, were reviewed for application of Best Available Control Technology (BACT) as required. Michael Valentine Director Quality Division Minnesota Pollution Control Agency 261 NOTICE OF METROPOLITAN COUNCIL PUBLIC MEETING MIINNESOTA INDUSTRIAL CONTAINMENT FACILITY DRAFT ENVIRONMENTAL IWACT STATEMENT The Metropolitan Council will hold a public meeting to receive public comments regarding the Draft Environmental Impact Statement (DEIS) for the proposed Minnesota Industrial Containment Facility. The purpose of the EIS is to provide information to the general public, regulatory, and permitting agencies and local units of government, about potential impacts from a proposed project. You are encouraged to participate in this meeting and provide comments about the document. United States Pollution Control, Inc. has proposed to build a non -hazardous industrial waste containment facility in the northeast portion of the city of Rosemount. The site is bounded by Highway 55 and the Chicago Northwestern Railroad to the northeast and northwest respectively, and by County Road 38 to the south. The project, known as the Minnesota Industrial Containment Facility (MICF), will only accept waste certified as non -hazardous and consistent with its Minnesota Pollution Control Agency (MPCA) permit. Waste material proposed to be collected includes automobile shredder fluff, glass grinding residue, printing inks, foundry sand, computer circuit boards, aluminum slag, magnetic tapes, paint and kiln brick. The facility will not accept mixed municipal solid waste, sewage treatment sludge, waste tires, agricultural waste, incinerator, resource recovery or power plant ash, waste oil, slaughterhouse or rendering plant wastes, and hazardous waste. The facility will consist of ten six -acre cells, each with a capacity of 252,000 cubic yards of waste. The initial receiving rate is expected to be between 40,000 and 50,000 cubic yards of waste per year. The company anticipates the receiving rate could eventually increase to 80,000 cubic yards per year. At the expected receiving rates, each cell will be open for three to five years; the active life of the facility will be about 30 years. The public meeting will serve to advise the affected community of the findings in the Draft Environmental Impact Statement, and its analysis of the potential for significant adverse environmental effects, and provide an opportunity for public comment on the DEIS.
