This item was initiated by the Dakota County Technical College' in the fall of 1990. Ron McKeaver, program supervisor, has represented the college's interests in this petition. Mr. McKeaver will make a presentation to the 'City Council at the Public Hearing. The Planning Commission recommended approval of the ordinance amendment at its March 12,„1991 Regular Meeting. Attached is a cover letter and summary packet, giving background and recommendation on the petition. DATE: April 11, 1991 RE: April 16, 1991 Council Agenda DAKOTA COUNTY TECHNICAL COLLEGE - SIGN ORDINANCE AMENDMENT The Dakota County Technical College approached the City last fall to inquire about a permit for two electronic changeable message signs. The college wished to place 21x 24' electronic signs upon each of their entrance monuments, located on CSAH 42. Staff review concluded the following: 1. Electronic changeable message signs were not permitted in new sign ordinance. 2. The college was already in non-conformance of permitted signage, by having two rather than one freestanding signs. 3. Each existing freestanding sign (130 square feet) was in non-conformance of permitted sign area -- 80 square feet. Staff informed the college that the permits could not be granted without significant revision to the new sign ordinance. The college requested an informal recommendation or opinion from City department directors, before proceeding with an application to amend the ordinance. At a "regular staff meeting" the department directors recommended against the request on the basis of the debate, time and effort which had gone into establishment of the new ordinance, traffic safety and aesthetic considerations. Based upon their own research and efforts to improve promotion of the college and its outreach, the college decided to pursue an amendment to the zoning ordinance. Staff recommended denial of the petition, on the basis of the above findings and recommendations. At its December 11, 1990 Regular Meeting the Planning Commission requested that staff pursue changes in the ordinance that could accommodate the college, yet minimize conflicts. Attached is Mike Wozniak's February 7, 1991 memo to the Planning Commission. This memo summarizes staff's efforts to address the current non-conformance of signs at the college and the request to add electronic changeable message signs. We felt allowing freestanding sign areas to reach 130 square feet, set a precedent for increased signage elsewhere. We did, however, recommend that freestanding signs be permitted at each major site entrance at post -secondary schools. This would allow both signs, but they would remain non -conforming due to size. In response to the request for the electronic signs, we suggested adding a provision for a single freestanding electronic sign. This provision is limited to the Public zoning District, and only at post -secondary schools. Mike's memo also addresses the need for additional ordinance clarification. At its March 12, 1991 Regular Meeting, the Planning Commission recommended approval of the revisions to the zoning ordinance. Ron McKeaver, program supervisor at the college, has been the City's contact during this process. He informed the Commission, that the college would favor the proposed revisions, in lieu of their original request for signage. Based upon the college's offer "to allow promotion of City events," the Planning Commission recommended the City Council pursue an agreement with the college, if the ordinance amendment is adopted. The attached ordinance represents staff's best efforts to accommodate the applicant and minimize ordinance inconsistency. These efforts do not address original concerns of traffic safety, aesthetics and ordinance precedent. This matter was discussed again at the department head's April 9, 1991 staff meeting. With all due respect to the applicant and recommendation of the Planning Commission, the original staff recommendation for denial of the petition stands. MINNESOTA 55068 612-423-4411 ZONING TEXT AMENDMENT - ELECTRONIC CHANGEABLE MESSAGE SIGNS Required Action: To either recommend approval or denial of the text amendment to City Council. A third option for action by the Planning Commission is to recommend further changes to language which has been drafted. Intermediate School District No. 917 (Dakota County Technical College) has petitioned the City to consider a zoning text amendment to allow the use of Electronic Changeable Message Signs within the Public District. Attached with this review are the following items: 1. Zoning Text Amendment Application form. 2. Sketch of proposed Electronic Changeable Message Sign. 3. Site Plan of Technical College indicating proposed sign locations. 4. Literature describing Electronic Changeable Message Signs submitted by Applicant. This item was originally considered by the Planning Commission at its December 11, 1990, Regular Meeting. At that meeting the Planning Commission considered a staff recommendation to recommend denial of the proposed Zoning Text Amendment to City Council, however, the Commission chose to direct staff to draft language necessary to amend the Zoning Ordinance to permit the use of a Electronic Changeable Message Sign on the Technical College Property. Currently the City allows exterior "electronic reader boards" only for use to display time and temperature or other public information (Sec. 10.1 C13.). The Dakota County Technical College desires to use Electronic Changeable Message Signs to inform persons travelling to the College and passersby about school events/happenings (i.e. open House, Job Fair, Registration Dates, Graduation, etc.). The Technical College has indicated a willingness to allow City and County public service announcement/information to be displayed on the proposed Electronic Changeable Message Sign(s). As indicated on the attached sketch the Technical College proposes to add 48 sq. ft. (2' x 241) Electronic Changeable Message Signs to two existing freestanding signs on the Technical College property. The Commission should note that the Technical College's existing signs exceed the maximum size for freestanding signs in the Public District. The existing signs are each 130 square feet in size while the maximum currently permitted in the district is 80 square feet. The two most significant reasons why the City does not currently allow the use of electronic reader boards except for display of time and temperature are concerns regarding aesthetics and traffic safety. A major concern is that the potential for widespread use of electronic reader boards in conjunction with commercial signs could significantly change the character of Rosemount's Commercial Districts in a negative way by detracting from the "small town character" so desired by Rosemount residents. At the time the current zoning ordinance was adopted (September 19, 1989) concerns were also expressed that the potential for widespread use of electronic reader boards could pose a traffic safety hazard by distracting motorists, bicyclists or pedestrians. The Planning Commission should keep these issues in mind when acting on an potential ordinance modifications which would permit the use of Electronic Changeable Message Signs. Despite being directed by the Planning Commission to proceed with drafting the required language to modify the Zoning Ordinance it is necessary for me to reiterate City staff has thoroughly evaluated this issue and has concluded that it is not in the best interest of the City to approve the proposed Zoning Ordinance Text Amendment. Concerns include the fact that if the City relaxes restrictions on the use of Electronic Changeable message signs in the Public District there will likely be considerable pressure from business owners to allow use of such signs in commercial districts. The potential for negative visual impact and traffic safety concerns would be more significant in commercial districts and allowing the use of Electronic Changeable Message Signs in the Public District would clearly establish a precedent which could make it difficult to restrict the use of such signs in the commercial districts. As evidence to contend arguments regarding safety or appearance of Electronic Changeable Message Signs the Technical College has provide copies of a brochure published by the National Electronic Sign Association. This brochure provides an overview on the function, efficacy, and community value of electronic changeable message signs. If the City does wish to amend the Zoning Ordinance to accommodate the Electronic Changeable Message Signs proposed by the Technical College several paragraphs within Section 10 would have to be amended. First of all it would be necessary to include a definition for Electronic Changeable Message Sign. Signs of this nature are referred to in the current ordinance as electronic reader boards. A preferred definition would be the following: Electronic Changeable Message Sign: An electronically activated sign whose message content, either in whole or in part, may be changed by means of electronic programming. If the ordinance were to be amended, staff would also recommend that a definition to clarify the use of Electronic Changeable Message Signs for display of time, temperature or other public - information. For clarification purposes it would be advisable to add the following definition: Public Service Announcement: Any sign display intended primarily to promote items of general interest to the community such as time, temperature, date, atmospheric conditions, public notices, news, etc. This does not include any information which would be related to the products or services located at the display site. It would be necessary to amend Section 10.1 C. General Provisions 12., to read as follows: 12. No exterior sign shall pivot, move, rotate or display any moving parts including Electronic Changeable Message Signs, except as permitted in Section 10.2 E4., and Section 10.2 G3. Interior Electronic Changeable Message Signs visible to pedestrians on the outside of buildings are allowed only as permitted in Section 10.2 E4. If the Ordinance amendment were to be approved it would be advisable to amend Section 10.2 E. (Signs Allowed by Permit in Commercial and IP Districts, subparagraph 4., to read as follows: 4. Changeable letter reader boards provided the sign area is included in the total sign area permitted. Exterior Electronic Changeable Message Signs not to exceed fifty (50) square feet provided the sign area is included in the total sign area permitted, only for display of public service announcements. Electronic Changeable Message Signs may be displayed from the inside of buildings to be visible through windows by pedestrians. Maximum size for interior displayed Electronic Changeable Message Signs displayed in this fashion shall be determined by the Planning Commission; in general, such displays should be limited to a size which does not represent a distraction to passing motorists. It would be necessary to amend Section 10.2 G1., to read as follows: 1. One (1) freestanding sign for each principal structure or major site entrance not exceeding eighty (80) square feet nor twenty (20) feet in height. 3. For Colleges and Universities situated in this district in addition to other permitted signs, one (1) freestanding or wall mounted Exterior Electronic Changeable message sign per public and institutional site not exceeding 50 square feet nor twenty feet in height. An Exterior Electronic Changeable Message sign may be incorporated into an existing freestanding sign provided that the public and institutional district size requirement for freestanding signs is not exceeded. Summary The Zoning Ordinance Text Amendment referenced in this review would allow the opportunity for the Dakota County Technical College to utilize an Electronic Changeable Message Sign for the purpose of advertising events or services located on the premises. The language which has been prepared would not allow any further expansion of the existing freestanding signs the Technical College currently utilizes. The ordinance would be amended to allow one freestanding sign at each site entrance rather than the current limit of one sign per site. The current freestanding signs are 130 square feet in size versus the 80 sq. ft. size limit indicated in the ordinance. Staff would not recommend that the ordinance be modified to allow an increase in size of the existing freestanding signs which are already nonconforming by adding an electronic changeable message sign. Options which exist for the Technical College are to bring one of the existing freestanding signs into conformance with the current ordinance size requirement of 80 sq. ft. and to incorporate the electronic changeable message sign as part of maximum 80 sq. ft. size. The other option which exists for the Technical College is to create a separate freestanding Electronic Changeable Message Sign which does not exceed 50 square feet or 20 feet in height. The proposed language to amend Section 10 of the Zoning Ordinance which has been drafted by staff would allow the Technical College to utilize a single Electronic Changeable Message Sign of up to 50 sq. ft. in size. The language would not allow any further expansion of the existing Technical College Signs which already exceed the maximum of 80 sq. ft. currently allowed for freestanding signs in the Public and Institutional District. Although the language proposed by City Staff would not permit the Technical College to install Electronic Changeable Message Sign(s) exactly as proposed; it is the staff opinion that the language as drafted represents a fair compromise which would not set a precedent for enlargement of the existing nonconforming signs already on the Technical College property. The draft language to amend the Zoning Ordinance included in this review was developed upon request of the Planning Commission. For reasons previously cited city staff has recommended against approval of the proposed zoning text amendment. At this point it is the obligation of the Planning Commission to review the amendment changes drafted by staff and to either recommend approval or denial of the text amendment to City Council. A third option for action by the Planning Commission is to recommend further changes to language which has been drafted. MINNESOTA 55068 612-423-4411 ANNUAL PLANNING COMMISSION MEETING MINUTES - MARCH 12, 1991 Pursuant to due call and notice thereof the Annual Meeting of the Planning Commission was duly held on Tuesday, March 12, 1991 at 5:00 p.m. Acting Chairperson Hathaway called the meeting to order with members Edwards, Meyer and Busho present. Also present was Community Development Director Dean Johnson. MOTION by Edwards to approve the February 26, 1991 Regular Meeting Minutes as presented. Second by Meyer. Ayes: 4. Nays: 0. Community Development Director Dean Johnson advised that Planning Intern Cindy Carlson and Comprehensive Guide Plan Update Consultant Fred Hoisington, Hoisington Group Inc., have been compiling data for development of City Policies and a Land Use Plan for the Comprehensive Guide Plan update. Mr. Hoisington and Ms. Carlson anticipate these draft documents will be ready for presentation to the Planning Commission for review at the April 9, 1991 Regular Meeting. Community Development Director Johnson reviewed with the Commission a request from Dakota County Technical College, 1300145th Street East, for a Zoning Ordinance text amendment to allow the use of an Electronic Changeable Message Sign on their property. Current ordinance provisions allow exterior "electronic reader boards" only for display of time and temperature and other public information. The Technical College wishes to use Electronic Changeable Message Signs to inform the public of school events and has further indicated a willingness to also allow City and County public service announcements/information to be displayed. Johnson reiterated staff's recommendation to deny this request based upon objections expressed in thorough discussions by both Council and Planning Commission in their consideration of sign ordinance modifications, potential negative aesthetic and visual impact, traffic safety concerns and the potential for establishment of a precedent. However, at the Commission's direction to attempt to accommodate the applicant's request to allow this use in the Public District, staff has drafted a sign ordinance text modification which they feel represents the least impact and ramifications to other districts. Ron McKeaver, Dakota County Technical College representative, stated his awareness of the proposed text language submitted by staff and expressed his endorsement of the proposed standards and conditions. Planning Commission discussion ensued with Mr. McKeaver responding to several questions of the Commissioners regarding sign dimensions and location, and message content, length and interval/pause frequency details. The majority of the Commissioners appeared to be in consensus that there is a need for improved advertisement for public awareness of the events that take place at the Technical College and believed that the opportunity for City/County announcements would benefit the Rosemount residents. There was further agreement that the draft text amendment, submitted by staff, represented the least impact on other districts. MOTION by Hathaway to recommend to City Council approval of a text amendment to SECTION 10 SIGNS of Ordinance B - City of Rosemount Zoning as submitted and to set a public hearing for consideration of the text amendment. Second by Meyer. Commissioner Edwards stated, for the record, his decision to take a negative position regarding this request based upon the following: 1) his cognizance of debates and discussions taking place in municipalities bordering Interstate 494 with respect to signage problems along this corridor and due to his vision of growth within the City of Rosemount whereby he anticipates increased growth along County Annual Planning Commission Meeting Minutes March 12, 1991 Page Two Road 42 which may necessitate and facilitate creating amendments, or exceptions, as growth continues; 2) his opinion that this type of advertisement is limited when there are so many other avenues of advertisement media to pursue; and 3) his appreciation of the time and effort invested by planning staff in researching this issue and the presentation of staff findings and department head comments; and, therefore, he felt he could not oppose staff recommendation. Vote on the MOTION: Ayes: Hathaway, Meyer, Busho. Nays: Edwards. Motion carried. Should Council approve the pending text amendment to allow electronic changeable message signs in the PUB District and a sign permit is granted to the applicant, Commissioner Busho suggested that Council pursue some form of formal or informal agreement with the Technical College to allow the use of the sign to publicize City events. Acting Chairperson Hathaway opened the floor for further nominations for the positions of Planning Commission Chairperson and Secretary. MOTION by Edwards to close the nominations. Community Development Director Dean Johnson discussed a proposed use of property located at 15280 South Robert Trail as detailed in correspondence received from Mr. Robert J. Regan of Osseo - Brooklyn Bus Co. Mr. Regan is contemplating purchasing a portion of the property, consisting of two structures, with the intent to operate a retail and wholesale distribution service of bus parts and, further, to provide additional storage of ISD 196 school buses. The subject property is currently zoned C-4 which does not expressly address bus storage as a permitted use. Upon discussion and debate of the proposed use, the Planning Commission directed staff to relay an administrative interpretation to Mr. Regan, that the use does not conform to the district requirements of this Zoning Ordinance.
