The proposed plat involves the subdivision of a 15.85 -acre parcel into three rural residential lots. The property meets the gross acre density requirements of the one home per five acre standard, with one potential exception. The City acquired a 2.59 -acre highway easement across the northerly portion of the site, to construct the realignment of County Road 38. To allay concerns that the density should be calculated on the basis of 13.26 versus 15.85 acres, Mr. Dunn has submitted a variance petition for minimum lot area requirements. (See Item 6a. on this agenda.) This plat involves no street construction or public utility extensions. Access to Lot 1 is provided off Dodd Boulevard. Access to Lots 2 and 3 is provided off County Road 38. The Dakota County Plat Commission has recommended that a single joint access be granted at the common lot line of Lots 2 and 3. Lot 1 is encumbered with a gas line easement and a large ponding easement. Lot 2 is also encumbered with a ponding easement. Building sites, meeting structural and private utility setback requirements, are accommodated on all lots. The subdivision is consistent with area residential development, which includes 1/2 -acre lots to the east, 2.5 -acre lots to the west, 5 -acre lots to the south and undeveloped property to the north. Based upon the information submitted and the comments noted, I would recommend approval of the Rosemount Hills Fourth Addition preliminary plat subject to the following: 1. Approval of the minimum lot area variance petition; 2. Cash park dedication requirements; and 3. Access restrictions required by Dakota County. ROSEMOUNT HILLS FOURTH ADDITION - LOT AREA VARIANCE As noted earlier in the reviews, this variance is intended to address any questions regarding the density calculations for the proposed subdivision. The property in question contains 15.85 gross acres. While Mr. Dunn is underlying owner of the entire parcel, the City acquired 2.59 acres of highway easement across the northerly portion of the site. Mr. Dunn is submitting this variance to permit three lots on a resulting, or net, parcel of 13.26 acres. This results in an average density of one home per 4.42 "gross" acres. The proposed lot density is substantially consistent with the required lot density. It is a subjective, rather than legal, opinion that the street easement may not be calculated in the density calculation. The range of lot sizes in the immediate area are from one-half acre to five acres in size. An easement acquisition for a local street versus a county road would have resulted in a remaining parcel, consistent with density requirements. I believe all of these considerations meet the requirements in granting a variance in this instance.
