Eric Short, from our legal firm, prepared the attached resolution
supporting a moratoriumonthe weed ordinance until the Weed Ordinance
Revision Committee -can recommend changes that will better serve the city.
RECOMMENDED ACTION:
MOTION to adopt a Resolution For Withholding of Enforcement of Weedand
Vegetation Control.

RESOLUTION 1991 -
A RESOLUTION FOR WITHHOLDING OF ENFORCEMENT
OF WEED AND VEGETATION CONTROL ORDINANCE
WHEREAS, the City of Rosemount presently has an ordinance
regarding weed and vegetation control, Sections 5-2-1 through
Sections 5-2-4, inclusive (the "Weed Ordinance"); and
WHEREAS, the Weed Ordinance is presently being reviewed for
revision by a Committee established by the City Council (the
"Committee"), and
WHEREAS, the City Council of the City of Rosemount desires to
withhold enforcement of the present Weed Ordinance pending
completion of the review and possible revision of the Weed
Ordinance by the Committee.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Rosemount, as follows:
1. That enforcement of the Weed Ordinance shall be
withheld effective immediately pending completion of
the review and possible revision of the Weed Ordinance;
and
2. That the City Administrator is directed to take all
such steps as may be necessary or appropriate to
accomplish withholding of the enforcement of the Weed
Ordinance.

RE: Rescheduling Meeting for Tuesday, May 14, 6:30 p.m.
Due to several factors impacting our scheduled meeting of May 9th,
I would like to reschedule it for Tuesday, May 14 at 6:30 p.m..
This will allow you more time to examine the enclosed weed
ordinance from other cities and glean from them ideas to revise our
own. While some do not sufficiently address our issue, others give
the matter the consideration I hope we can give our own. Thanks
to John Hauge and Mark Joosten for supplying this information.
I am awaiting an opinion from our attorney as to the legality of
writing our ordinance by "areas". As you will see, some cities are
doing this. After a discussion with Steve Jilk, City
Administrator, the moratorium expiration will be recommended to
Council as July 15, 1991, rather than the end of August as we
discussed. This is to allow for the cutting of weeds, etc., before
they go to seed in the fall. Steve and i agreed this would be more
acceptable to citizen complaints.
In view of the moratorium expiration date, I would like to suggest
the following meeting schedule to allow us ample time to complete
our task by the Council meeting of July 2nd, at which time our
recommendation can be presented. Also, this schedule takes into
account the time needed for our attorney to draft the wording for
the ordinance. Please let me know of any conflicts you may have
with this schedule.
Tuesday - May 14, 6:30 p.m.
Tuesday - May 28, 6:30 p.m.
Tuesday - June 11, 6:30 p.m.
Please come prepared on May 14th to discuss your suggestions for
our ordinance revision keeping in mind the discussion of our first
meeting. A recap of that meeting is enclosed.
