This Plat consists of a division of a 15.85 -acre parcel (gross) into three
lots with a gross density of 4.42 acres after removing the highway
easement. When the preliminary plat was approved a lot area variance was
granted by the Planning Commission. The only site issue left unresolved
when the Planning Commission reviewed the preliminary plat in May was
access restrictions for Lots 2 and 3. The County Plat Commission had
recommended only one access shared by both lots. As you will recall, the
City Council felt it was appropriate for each lot to have an access and
requested a variance from the County Plat Commission in July. The County
approved the variance, stipulating that the access opening for Lot 3 must
be 450 feet west of the right-of-way of Truck Highway No. 3 and the access
opening for Lot 2 must be 900 feet west of the right-of-way of Trunk
Highway No. 3. These driveways are shown on the final plat.
In reviewing the history regarding the plat, Planning Staff realized that
Mr. Dunn was only charged for two assessment units on this property instead
of three. Originally the intent was that the right-of-way for County Road
38 was to be dedicated by the property owner, but the City actually
purchased the property. As well, the City has granted approval via a
variance to allow a third lot on the property. Therefore, staff is
recommending that Mr. Dunn be required to pay a cash fee to the City in
lieu of assessing a third assessment unit on the property. Attached is an
agreement drafted to accomplish this requirement.
The Planning Commission reviewed the final plat at the August 13 Regular
Meeting and recommended approval subject to: 1) Cash park dedication
requirements; 2) Access restrictions per Dakota County and as shown on the
final plat; and 3) Cash contribution of $1,818.87 in lieu of an assessment
unit for County Road 38.
RECOMMENDED ACTION: A motion to a adopt the resolution approving
Rosemount Hills Fourth Addition Final Plat subject to conditions.

RESOLUTION 1991-
A RESOLUTION APPROVING
ROSEMOUNT HILLS FOURTH ADDITION FINAL PLAT
WHEREAS, the City of Rosemount has approved the Rosemount Hills
Fourth Addition preliminary plat; and
WHEREAS, the Planning Commission of the City of Rosemount has
recommended approval of Rosemount Hills Fourth Addition final
plat.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of
Rosemount hereby approves the Rosemount Hills Fourth Addition
final plat subject to the following conditions:
1)cash park dedication requirements;
2)access restrictions per Dakota County and as shown
on the final plat; and
3)cash contribution of $1,818.87 in lieu of an assessment
unit for County Road 38.
ADOPTED this 20th day of August, 1991.

The Dakota County Plat Commission met on July 8, 1991, to
consider the variance request from the County's access
spacing guidelines for the plat of ROSEMOUNT HILLS 4TH
ADDITION. Said plat is adjacent to Co. Rd. 38 and therefore
is subject to the Dakota County Contiguous Plat Ordinance.
Based on the projected low traffic volumes of this segment
of road and the terrain hardship located at the proposed lot
line, the Plat Commission will recommend approval of the
City's variance request for a single driveway access to both
Lots 2 and 3 to the County Board of Commissioners when the
plat is submitted in its final form. Based on the City's
request, the access opening for Lot 3 must be 450 feet west
of the right of way of Trunk Highway No. 3 and the access
opening for Lot 2 900 feet west of the right of way of Trunk
Highway No. 3. The openings are to be 30 feet wide with the
remainder of County Road No. 38 frontage dedicated as
restricted access.

AGREEMENT
AGREEMENT made this day of , 1991, BETWEEN EDMUND B.
DUNN AND ELIZABETH J. DUNN, husband and wife, (hereinafter referred to as the "Owners"), and
the City of Rosemount, a municipal corporation, (hereinafter referred to as the "City").
RECITALS:
1. The City and the Owners have entered into various agreements regarding the
development of the real property legally described on Exhibit A attached hereto known as Rosemount
Hills Fourth Addition.

2. Disagreements have arisen regarding assessments for Rosemount Hills Fourth Addition.
3. The parties desire to resolve these disagreements on the terms and conditions set forth
NOW, THEREFORE, in consideration of the foregoing and the premises, the Owners and
the City do hereby agree as follows:
1. The Owners agree to pay to the City the sum of $1,818.87 as a cash dedication in lieu
of assessments for Rosemount Hills Fourth Addition.
