RECOMMENDED ACTION: Motion to recommend the City Council approve the
amendment to the Official Map.
SUMMARY
This item is being initiated by Staff following the determination that the County can only purchase the
land that is needed for future improvements to the CSAH 42/Highway 52 interchange. The existing
Official Map contains two complete parcels in the northeast quadrant of the 42/52 intersection. This
amendment would reduce the amount of land allocated to future improvements at the intersection of
CSAH 42 and Highway 52 and limit the area of the official map to the south and west portions of the
subject parcels. City Code does not allow building permits to be issued for structures located within the
Official Map. By reducing the area of the official map on the subject parcels, land will be available for
future development at this location. Staff is recommending approval of this amendment.
BACKGROUND
Over time, a growing community needs to expand their street and other public facilities to accommodate
new growth. Often, communities know what improvements need to be made years before the
improvements are actually constructed. With this advanced knowledge, communities can design the
needed improvements when the land required for these improvements is either undeveloped or sparsely
developed. Often times there is a concern that currently undeveloped land will be developed before the
public improvements are made. This concern can be eliminated by mapping what land will need to be
preserved for the improvement and adopt it as an Official Map. The zoning ordinance was amended in
2007 to allow for the creation of Official Maps.
The current official map for this location was adopted in 2007 to accommodate future improvements to
the 42/52 intersection. The County has determined that the official map contains more area than is
needed for the ultimate layout of the intersection. The proposed amendment to the official map allocates
only the land needed for the ultimate layout of the intersection. This amendment will allow development
to take place on portions of the parcels that would otherwise not have been permitted due to their
inclusion in the Official Map.
The City Code only requires a public hearing before City Council. City Council can, at its discretion, ask
the Planning Commission to call a public hearing before making a recommendation. In this case, a public
hearing will be held before both the Planning Commission and the City Council.
RECOMMENDATION
Amending the Official Map to exclude portions of the subject parcels located in the northwest quadrant of
the intersection of CSAH 42 and Highway 52 will allow future development that would not otherwise have
been allowed under the current Official Map. For this reason, staff is recommending approval of the
amendment to the Official Map.
