Attached please find the agreement for severance between Mr. Don Darling
and the City. This item is placed on the agenda for your affirmation as
you have already taken action to agree but this action should be confirmed.
RECOMMENDED ACTION:
Motion to affirm the action taken by Council on February 14, 1991 to
approve a severance agreement between Mr. Don Darling and the City
of Rosemount.
COUNCIL ACTION:
Approved.
AGREEMENT
AGREEMENT made and entered into this day of
February, 1991 by and between the CITY OF ROSEMOUNT, a Minnesota
municipal corporation, hereinafter "City", and DON F. DARLING,
hereinafter "Darling".
WHEREAS, Darling has been employed by City on a full-
time basis since April 1, 1973; and
WHEREAS, Darling desires to tender his resignation
subject to certain conditions where are agreeable with City.
NOW THEREFORE, in consideration of the following and
other good and valuable consideration, the parties agree as
follows:
1. Darling resigns as a City employee effective June 15,
1991, and City accepts his resignation as of that date. Between
the date of this Agreement and June 15, 1991, the parties agree
that Darling shall not return to work, nor shall he receive any
salary, accrue any sick leave, vacation, or other benefits;
except for all health, dental and life insurance benefits which
City agrees to provide and pay through June 15, 1991.
2. Upon execution of this Agreement, City shall pay
Darling a one-time employee severance payment of $51,642.66. Any
taxes due as a result of this severance pay shall be the
responsibility of Darling.
IN WITNESS THEREOF, the parties hereto have executed this
Agreement the day and year first above written.
