This item is on the agenda to consider a draft letter to USPCI confirming
the City Council's position on the University of Minnesota land as the
location for all waste management type activities in the city.
Also, the need for USPCI to consider the possibility of moving to the
University and the low possibility of approval to their project if
maintained on Highway #55.
RECOMMENDED ACTION:
Motion to approve the letter to USPCI indicating the city's position
on the location of their facility.

The Rosemount City Council wishes to re -confirm with you and your company
their position on the location of waste management projects within the City
of Rosemount.
On September 18th, 1990 the Rosemount City Council passed a resolution, a
copy of which is attached, declaring the city's "desire to obtain
possession of University of Minnesota Property", and to "control the
location of certain waste management projects affecting the City of
Rosemount."
A section of that resolution states that "it is the City's desire and
position that whatever waste management projects occur in Dakota County, if
they have any affect on the City of Rosemount, should be considered for
location on University of Minnesota property in the City of Rosemount.
Such waste management projects to include but not be limited to the Dakota
County Resource Recovery Project, USPCI Waste Management Project,
incinerator ash monofill, coal ash landfill, demolition landfill, ash
pellitization, composting, recycling, materials recovery facility and the
University's existing hazardous materials storage facilities.
The City Council has been advised that USPCI has in its efforts to proceed
with the project on Highway 55 made application to the City for a
comprehensive guide plan revision and a zoning revision to bring the land
use designation for the site into compliance which would allow ,its .total
use for your project.
The council wishes to advise you that, in consideration of its position, as
stated in the resolution of 9-18-90 (Resolution 1990-87) it recommends that
you seriously consider the location of your facility to the University of
Minnesota lands in Rosemount. The council finds it difficult to see the
possibility of approval for the Highway 55 site in light of its position
taken and now re -affirmed for the location of Waste Management activities
in the community.

The Council is aware that you have discussed this possibility and have
raised serious concerns about the move to the University. Among those
concerns are:
1) time frame
2) cost
3) community support
4) liability
5) city services
6) location of campus concept
In brief I would suggest the following comments on these issues:
Time Frame. The concern about locating on the University as it relates to
time of land acquisition/control may not be as serious as you may have
thought. ReComp, a company proposing a major compost facility on the
University has acquired a thirty year lease from the University within a
ninety day period. Without approaching the University we will not know
their position and the extent of work needed to proceed.
Cost. Obviously USPCI has expended a large amount of money to develop the
permit for the Highway 55 site. If the permit is not granted for the
Highway 55 site because the City Council has determined that this land use
is more suitable for the University those costs will all be lost.
Consideration of additional development costs on a proposal with less risk
may be money better spent.
Community Su ort. Though there have been no public meetings to
specifically solicit input and comment on the "Waste Management Campus"
concept, there has been public discussion and public decisions made by the
City Council regarding the concept, the adoption of the resolution and
extensive press on the matter. The City Council feels confident in the
position it has taken and the idea of development of lands on the
University.
Liability. Though there have been environmental issues raised and specific
contamination problems determined to exist at the University Property it is
not fair to say that a move to, or involvement in any portion of the
University would bring that liability to USPCI. Measures can be taken, as
the County has taken, to determine the "environmental status" of the land
under consideration and to ensure the lack of any liability for USPCI as it
relates to other lands in the area.
City Services. Though the cost of city services, especially a sewer
connection would obviously be more extensive than that needed on the
Highway 55 site the Council feels that those dollars would be well spent in
order to "manage" these types of projects in an area they determined to be
more suitable for such projects.
Some type of financial assistance for the creation of the service
infrastructure could be considered through a tax increment program. This
could include assistance in extending sewer and the upgrading of Blaine
Ave. if the Dakota County Resource Recovery Project is not built.

Location of Campus. In the discussion leading to the adoption of the
resolution back in September of 1990, the Council spent an extensive amount
of time deliberating the concept of developing some manner of:
1) Reacting in a responsible fashion to the management of the waste
stream, not just in Rosemount but in the region
2) Allowing those projects which could be proven to be
environmentally sound
3) Working with Dakota County and other private firms which would
want to develop environmentally sound and necessary waste
management projects.
4) Locating such projects in an area the Council felt most suitable
and with sufficient land to develop such a concept. That was the
University property.
The Council understands the financial and personal commitment made by USPCI
to the Highway 55 site but again would suggest that you reconsider the
opportunity to move the project to the University property.

RESOLUTION 1990- 87
A RESOLUTION DECLARING THE CITY OF ROSEMOUNT'S DESIRE TO
OBTAIN POSSESSION OF CERTAIN UNIVERSITY OF MINNESOTA PROPERTY
AND CONTROL THE LOCATION OF CERTAIN WASTE MANAGEMENT PROJECTS
AFFECTING THE CITY OF ROSEMOUNT
WHEREAS, the University of Minnesota owns several thousand acres
of property in the City of Rosemount; and
WHEREAS, the University of Minnesota has indicated its desire to
relinquish ownership of some of that property; and
WHEREAS, the City of Rosemount has long discussed the need to
take control of University lands in Rosemount; and
WHEREAS, Dakota County has chosen the location for its proposed
resource recovery project to be on a portion of University
property in Rosemount; and
WHEREAS, Dakota County has exhibited the need to purchase
additional University property for future waste management
projects unspecified at this time; and
WHEREAS, the City of Rosemount has long exhibited an interest in
supporting and promoting responsible waste management techniques
throughout Dakota County; and
WHEREAS, the City of Rosemount through its City Council and City
Staff has worked closely with Dakota County and has expended many
staff hours and City tax dollars in reviewing many issues
surrounding the proposed resource recovery project.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of
Rosemount declares its intent to make every effort to obtain
possession of University of Minnesota lands in the City of
Rosemount lying east of Akron Avenue and north of 160th Street;
and
BE IT FURTHER RESOLVED, that the City advise Dakota County that
it is the City's desire and position that whatever waste
management projects occur in Dakota County, if they have any
affect on the City of Rosemount, should be considered for
location on University of Minnesota property in the City of
Rosemount -- such waste management projects to include but not be
limited to the Dakota County resource recovery project, USPCI
waste management project, incinerator ash monofill, coal ash
landfill, demolition landfill, ash pelletization, composting,
recycling, materials recovery facility and the University's
existing hazardous materials storage facilities.

BE IT FURTHER RESOLVED, that Dakota County in consideration for
past involvement and effort on behalf of the City of Rosemount in
working with Dakota County on the resource recovery project
reimburse the City $75,000.00 and agree to reimburse the City of
Rosemount 100 percent of all future documented costs the City
incurs for its involvement on the resource recovery project and.
other related waste management projects, and
BE IT FURTHER RESOLVED, by the City Council of the City of
Rosemount that Dakota County be asked to respond to the direction
taken in this Resolution by October 10, 1990.
