The City is in receipt of a petition from U. S. Homes, Orrin Thompson
Division, for the development of Country Hills 4th Addition. Staff is
asking the Council to receive the petition and order a feasibility
report prepared for the project.
Simultaneously with feasibility report Staff is requesting
authorization to order plans and specifications for streets and
utilities.
Report as well as plans and specifications will be prepared by O.S.M.
& Associates.
This item willbeon the April 8, 1991 Utility Commission agenda.`

The City has received a petition from U. S. Home Corporation to
do the public improvements of streets, utilities, street lights
and walkways for Country Hills 4th Addition.
The petition which is attached is asking the City to order the
feasibility study for these improvements. In a telephone
conversation and follow-up letter, Mr. Lee Johnson, Senior Vice
President of U. S. Homes, is also asking the City to order plans
and specifications at the same time as the feasibility report.
Since this project is 100% assessable to U. S. Homes there is no
financial risk to the City in ordering the preparation of either
the feasibility or the plans and specifications. Payment is
guaranteed by signature of the owner on the petition.
The attached map shows the location of the 4th Addition in
relationship to the other additions in Country Hills. This
segment of development has been moved from the area shown in the
original Planned Unit Development. The reason for the change is
to utilize and take advantage of the sanitary sewer line which
was installed on U. S. Home property in 1989 in conjunction with
the construction of Shannon Park Elementary School.
This will require a P.U.D. amendment prior to final plat
approval. That action has been scheduled for Planning Commission
action.
By ordering the feasibility study and plans and specifications
simultaneously, it will allow street construction in the first
phase of this addition this construction season with some homes
by fall.
There are currently no issues from Staff on this proposal. I
would recommend approval of U. S. Homes request and ask that the
City's consulting engineers be allowed to proceed with
feasibility report and plans and specifications simultaneously.

PETITION FOR LOCAL IMPROVEMENTS

To the City Council of Rosemount, Minnesota:
We, the undersigned, being the owners of all the real property
legally described as follows:
Country Hills 4th Addition
hereby petition the city council to undertake without a public
hearing under Minnesota Statutes, Section 429.031, the following
improvements to such property and agree to pay for all costs for
the preparation of the feasibility report for these improvements
in the event the improvements are not ordered in:
X Sanitary Sewer
Y Watermain
X Storm Sewer
X Streetlights
X Walkways
X Streets
X Curb & Gutter
Other
and to pay the entire assessable costs thereof against our
Property encompassing or abutting said improvements based on
benefits received without regard to cash valuation.

A RESOLUTION ORDERING PLANS AND SPECIFICATIONS FOR
COUNTRY HILLS 4TH ADDITION STREET AND UTILITY IMPROVEMENTS
CITY PROJECT #222
WHEREAS, the City Council of the City of Rosemount by a unanimous
vote ordered a feasibility report for Country Hills 4th Addition
Street and Utility Improvements, City Project #222; and
WHEREAS, the developer, U. S. Home Corporation, has submitted a
written request for the City Council to order the plans and
specifications for City Project #222; and
WHEREAS, the developer, U. S. Home Corporation, has indicated in
writing they will be responsible for all costs incurred for
preparation of the plans and specifications for City Project #222.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City
of Rosemount orders the plans and specifications for the
improvements of the Country Hills 4th Addition Street and Utility
Improvements, City Project #222.

A RESOLUTION RECEIVING PETITION AND ORDERING
THE FEASIBILITY REPORT FOR
COUNTRY HILLS 4TH ADDITION STREET AND UTILITY IMPROVEMENTS
CITY PROJECT # 222
WHEREAS, the City Council of the City of Rosemount has received a
petition from the developer and property owners of the proposed
Country Hills 4th Addition Street and Utility Improvements, City
Project #222.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of
Rosemount as follows:
(1) the aforesaid petition represents 100% of the owners of
the affected property;
(2) the property owner requests in the petition that the
improvements be constructed and that the entire cost for their
share less the City's share of the cost of the improvement be
assessed against the property;
(3) the aforesaid petition is approved and placed on file;
and
(4) the City's Consulting Engineer, O.S.M. & Associates, is
directed to have the necessary feasibility report prepared for
Country Hills 4th Addition Street and Utility Improvements,
City Project #222.
