MINNESOTA 55068 612-423-4411 Mayor Napper Council Members Klassen, Oxborough, Willcox, Wippermann Stephan Jilk, City Administrator March 29, 1991 Press Release - Special Investigation Per your direction I have developed a proposed press release regarding the special investigation completed by Mr. Jack Clinton. This press release is completed and attached for your review. I have had Mr. Clinton review it and his suggestions were implemented into the draft you are receiving. Upon your approval this release will be given to the three local newspapers; the Countryside, Thisweek, and the Farmington Independent for release. PRESS RELEASE In a special meeting of the Rosemount City Council, held November 13 of last year, concerns in four major categories relating to the operation of the City were identified, namely, financial matters, development matters, management issues, and personnel issues. Contributing to definition of the issues open for discussion at the meeting, which was closed pursuant to the Minnesota Data Practices Act (since personnel matters were discussed), included legal counsel from the League of Minnesota Cities, as well as counsel from the private law firm of Clinton & O'Gorman, P.A. The Council directed the firm of Clinton & O'Gorman to conduct an investigation into the issues identified above, and further instructed the firm to interview necessary staff members, review appropriate files, and report its findings to the Council. The investigation was to include determination of whether allegations concerning certain staff members' involvement in the issues identified had merit or foundation. Allegations included charges of mismanagement and illegal fund transfers. Clinton & O'Gorman proceeded with the investigation, which was concluded approximately three months later. A report of the findings of that investigation was submitted to the Council in two parts, the "public" part of which is now available for review at City Hall weekdays between the hours of 7:30 a.m. and 4:00 p.m. The "private" (personnel) part of the report is on file with the City and the City's legal counsel, but is not available to the public due to provisions of the Minnesota Data Practices Act. The results of the investigation, in relevant part, are as follows: 1. All issues determined by the Council and special legal counsel to have basis were investi- gated. 2. The City's financial stability is not in jeopardy. 3. Recommendations were made for minor revisions in financing and accounting procedures. 4. Project management practices as they are currently implemented are appropriate. 5. No expenditures have been made outside of the budget without Council approval. 6. Developmental and management issues are being handled appropriately. 7. Allegations by a Council member against three staff members (Richard Hefti, Dean Johnson and Stephan Jilk) were investigated and found to be completely without merit or foundation. 8. Richard Hefti, Dean Johnson and Stephan Jilk were formally exonerated by the Council following review of the investigation report. The City Council has extended its thanks to the City staff for its patience and consideration during the investigation. 030
