This item addresses an agreement formally titled Termination of
Advertising Device Leasehold. The agreement says that the Minnesota
Department of Transportation will pay the City of Rosemount to
relocate our wooden "Welcome to Rosemount" sign which we have placed
in the right-of-way at Canada Avenue and Highway 3. This area will be
encumbered by a temporary easement for the reconstruction of the
railroad bridge and Highway 3 necessitating our relocation of the
sign.
The sign will be moved prior to November 1, 1991. Execution of this
agreement will allow the City to recuperate the relocation costs.
RECOMMENDED ACTION: Motion to authorize the Mayor and City Clerk to
execute the Termination of Advertising Device Leasehold Agreement with
MnDOt to relocate the "Welcome to Rosemount" sign at Canada Avenue and
Highway 3.

TERMINATION OF ADVERTISING DEVICE LEASEHOLD

The undersigned, City of Rosemount, a municipal corporation under the
laws of the State of Minnesota, Releasor, hereby warrants to the
State of Minnesota, Releasee, that it the owner of an advertising
device located on real property in Dakota County, Minnesota,
described as follows:
All of the following:
That part of Lots 2 and 4, Block 4, South Rose Park
Addition Replat, shown as Parcel 249D on Minnesota
Department of Transportation Right of Way Plat Numbered
19-79 as the same is on file and of record in the office
of the County Recorder in and for Dakota County,
Minnesota;
together with other rights as set forth below, forming and being
part of said Parcel 249D:
Temporary Easement:
A temporary easement for highway purposes as shown on
said plat as to said Parcel 249D by the temporary
easement symbol, said easement shall cease on December 1,
1993, or on such earlier date upon which the Commissioner
of Transportation determines by formal order that it is
no longer needed for highway purposes.
For a valuable consideration including relocation payments as
provided by law, Releasor hereby releases, surrenders and quit claims
to the State of Minnesota its right and interest in the described
property, and agrees to complete satisfactory removal ',ottf the
advertising device from the property not later than IVO✓, / 5� ,

Relocation payments for the advertising device will be made in
accordance with relocation policies and procedures. For further
information and assistance, contact the District Relocation Advisor.

It is understood and agreed that if the advertising device is not
timely removed from the property the device shall be considered
abandoned, and will become the property of the State of Minnesota to
dispose of as it sees fit.
