Mr. Ed Dunn is requesting a metes and bounds lot division of a 55 acre
parcel in order to split off a 10 acre tract of land in Eastern Rosemount.
The original 55 acre parcel abuts State Trunk Highway 52 between County
Road 38 and County Highway 42. The 10 acre tract is located in the
northwest corner of the 55 acre parcel. The 10 acre parcel is to be
accessed off of County Road 38 via the 60' road easement shown along the
eastern portion of the 10 acre parcel.
The attached survey also shows the road easement continuing through the
remnant parcel to County Highway 42. If the remnant parcel is further
subdivided, the frontage road should be developed in the general location
shown on the Plat, but staff would prefer that the easement south of the 10
acre parcel not be shown on the survey at this time and requests that
Council make this a condition of the approval. It should be noted that at
some future date when the frontage road is developed in this manner, the
property owner will need to acquire an additional 160' of railroad right-
of-way to accommodate an acceptable curve radius entering onto County Road
42.
The Planning Commission reviewed and recommended approval of the lot
division subject to four conditions at the August 27 Regular Meeting.
1) Cash park dedication in lieu of land for the 10 acre parcel.
2) Access to the ten acre parcel be provided through theroad
easement.
3) The road easement must be graded and a gravel surface must be
installed the length of the 10 acre parcel by the property.'
4) No other parcels may be divided from the remnant parcel without
going through a Plat and/or Planned Unit Development.
After review of the revised survey submitted by Mr. Dunn on August 29,
staff recommends one additonal condition.
5) The easement shown on the survey should be revised according to
staff specifications.
RECOMMENDED ACTION: A motion to adopt A RESOLUTION FOR A METES AND
BOUND LOT DIVISION subject to a revised survey.

A RESOLUTION FOR A METES AND BOUNDS LUT DIVISION
WHEREAS, the Planning Commission of the City of Rosemount has
reviewed and recommended approval of a metes and bounds parcel
division as legally described in the hereto attached Exhibit A.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of
Rosemount hereby approves and authorizes a division of property
located in Section 25, Township 115, Range 19, Dakota County,
Minnesota, as legally described in Exhibit A, subject to the
following conditions:
1) Cash park dedication in lieu of land for the ten -acre
parcel;
2) Access to the ten -acre parcel be provided through the road
easement;
3) The road easement must be graded and a gravel surface must
be installed the length of the ten -acre parcel by the
property;
4) No other parcels may be divided from the remnant parcel
without going through a Plat and/or Planned Unit
Development; and
5) The easement shown on the survey should be revised according
to staff specifications.

ED DUNN METES & BOUNDS LOT DIVISION
RECOMMENDED MOTION: A motion to recommend approval of the lot
division subject to the corrected survey and legal description
for both lots and the three conditions enumerated in the staff
review.
A motion to recommend approval of the rezoning petition from
Agricultural to General Industrial.
BACKGROUND: The present request is two -fold: 1) a metes and
bounds lot division to split off a ten acre tract of land from a
larger 55 acre parcel in eastern Rosemount and 2) to rezone the
ten acre tract of land from Agricultural to General Industrial to
be used as a storage yard.
The original 55 acre parcel abuts State Trunk Highway 52, between
County Road 38 and County Highway 42. The ten acre tract is
located in the northwest corner of the 55 acre parcel. Attached
with this summary is a site location map and a copy of the survey
submitted by the current property owner Mr. Ed Dunn (only in
Planning Commission Packets). Staff has informed Mr. Dunn of
several concerns regarding the survey as submitted: 1) A legal
description should be provided for both the parcel being created
and the remnant of the 55 acre parcel; 2) The frontage road
easement should be limited to the length of the 10 acre parcel
and should be attached to the description of the remnant parcel;
3) The radius shown for the frontage road connection to County
Road 42 is too severe. Either additional land should be acquired
from the Railroad or the intersection should be moved to the
east. Until additional subdivision of the 55 acre property
occurs the City does not desire to maintain the road easement or
improve it in any way. That would be the responsibility of the
property owner. Pending resolution of these issues prior to the

Council meeting on September 3, staff recommends approval of the
metes and bounds lot division subject to the following
conditions:
1) Cash park dedication in lieu of land for the 10 acre
parcel.
2) Access to the ten acre parcel be provided through the
road easement.
3) Public Works requests that the road easement be graded by
the property owner and a gravel surface be installed the
length of 10 acre parcel.
4) No other parcels may be divided from the remnant parcel
with going through a platting and/or Planned Unit
Development process.
Mr. Dunn has a purchase agreement with L.H. Sowles for the
property. L.H. Sowles has petitioned the City to rezone the 10
acre parcel to General Industrial in order to use the property as
a storage yard for tower cranes. No utilities would be required
for this use of the property. Previously the Planning Commission
and City Council reviewed and approved a Comprehensive Guide Plan
Amendment request to designate this 10 acre parcel as industrial.
In that review it was determined that an industrial use of this
nature was appropriate for this property and it would be a
logical extension of the industrially zoned land to the north.
The Metropolitan Council approved the Guide Plan Amendment so a
rezoning at this time would be in conformance with the
Comprehensive Plan.
