The developers of the proposed Valleywood Estates subdivision have submitted a revised preliminary plat for consideration by the City. This development is a proposed eight lot rural residential development to be situated on a forty acre parcel situated on the south side of County Road 38 at Rosemount's west boundary. Because the City of Apple Valley has indicated that it has proprietary rights to the name "Valleywood" the developer has renamed the project "Amberwood Estates". On Thursday, January 31, 1991, the Developers of the Amberwood Estates subdivision decided to withdraw the revised preliminary plat application and to proceed with the original preliminary plat which was approved by City Council on September 4, 1990. The Developer has indicated that the revised preliminary plat has been withdrawn due to the controversy that has been associated with this project due to concerns of property owners in Apple Valley and because of the Planning Commission recommendation of denial of the revised preliminary plat. Attached with this summary sheet is a letter from the developer indicating this course of action. It will be necessary to open the scheduled public hearing and to announce to anyone in attendance that the developer has decided to pursue development of the property according to the original design. If the Council desires, staff will be prepared to do a brief summary of the approved preliminary plat. RECOMMENDED ACTION: MOTION to accept the letter from Meadowood, Inc., acknowledging the withdrawal of the revised Amberwood Estates preliminary plat. COUNCIL ACTION: Accepted letter of withdrawal. MINNESOTA 55068 612-423-4411 The City of Rosemount was informed on January 31, 1991, by the Developer of the Amber Wood Estates subdivision (forty acres south of County Road 38 abuting The Woods and Hearthstone subdivisions in Apple Valley and Mickelson's Second Addition in Rosemount) that a revised Preliminary Plat for that project will be withdrawn from consideration by the City. The Developer has further indicated that the subdivision will be developed according to the original preliminary plat for the project (approved by the Rosemount City Council on September 4, 1990). Attached with this notice is a reduction of a copy of the original preliminary plat for the project. You have previously been mailed a public notice regarding a public hearing scheduled to consider the revised preliminary plat for Amber Wood Estates scheduled for February 5, 1991, at 8:00 p.m. in the Council Chambers of the Rosemount City Hall. At this meeting the Rosemount City Council will acknowledge the Developer's intention to withdraw the revised Amber Wood Estates Preliminary Plat from further consideration. Since this public hearing has already been scheduled it will still be held and you are still welcome to attend and comment on the proceedings if you so desire.
