Two Rosemount property owners have requested that the City
Council consider their applications for renewal of the
Agricultural Preserve status of their properties which is set to
expire this month.
Earl and Florence Bester and Earl and Doris Marotzke have
requested that they be allowed to enter their respective
properties into the Agricultural Preserves Program for another
eight-year period.
The Metropolitan Agricultural Preserves Program provides tax
breaks to farmers on the condition that property use is limited
to agriculture and that residential development be limited to one
home per forty acres.
Attached with this summary attached is a map indicating the
location of the properties.
Besides the Bester and Marotzke properties, also indicated on the
map, is approximately 75 acres of property owned by Koch
Refining. This property, now owned by Koch Refining, is
currently enrolled in the Agriculture Preserve Program, but its
Agricultural Preserve status is set to expire in February. This
property owned by Koch Refining was formerly owned and farmed by
Wayne Groth. Koch Refining has indicated that it does not have
any interest in seeking renewal of the Agriculture Preserve
status of the property and will allow that status to expire.
RECOMMENDED ACTION: MOTION to adopt A RESOLUTION CERTIFYING LANDS
ELIGIBLE FOR AGRICULTURAL PRESERVES.

i RESOLUTION 1991-
A RESOLUTION CERTIFYING LANDS ELIGIBLE
FOR AGRICULTURAL PRESERVES
WHEREAS, the Metropolitan Agricultural Preserves Act (Minnesota
Statutes 473x.01 et seq.) provides for establishing Agricultural
Preserves; and
WHEREAS, the Act requires that to be eligible land must be
planned for long-term agricultural use according to the local
comprehensive plan adopted pursuant to Minnesota Statutes 473.851
(et seq.); and
WHEREAS, the Act further requires such property be zoned for
long-term agricultural use with a maximum residential density not
to exceed one unit per 40 acres; and
WHEREAS, the City of Rosemount has planned and zoned certain
areas as required by the Act.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of
Rosemount hereby certifies that all of the areas so marked on the
map appended are eligible for designation as agricultural
preserves.
BE IT FURTHER RESOLVED, the Clerk shall file a copy of this
resolution with the Metropolitan Council.
