This item is a request to grant a medical leave of absence to Larry Kane.
The bylaws of the Rosemount Fire Department allow the members, with the
approval of the City Administrator, to grant up to 60 days of medical leave
per calendar year. This was granted for the months of January and February
of 1991 (see attachment dated 12/19/90).
Larry Kane was unable to return to unrestricted duty as of
February 28, 1991 and thus needs an extension of medical leave (see
attachment dated 2/4/91 for details). Any time beyond 60 days per calendar
year requires council approval in addition to the approval of the
membership and the City Administrator. The membership at its regular
meeting on February 26th approved such an extension of leave and the leave
has also been approved by Steve Jilk, City Administrator.
This leave would be in effect for 90 days from March 1, 1991 to
June 1, 1991 at which time the status will be reviewed.
RECOMMENDED ACTION:
Motion by city council to approve a medical leave of absence for 90 days
for Larry Kane, in effect from March 1, 1991 to June 1, 1991.
COUNCIL ACTION:

RE: Medical Leave
On February 28, 1991 your first 60 days of medical leave which
was granted by the membership with the approval of Steve Jilk,
City Administrator, will run out. This 60 days which is provided
for in the bylaws of the RFD has been counted towards your time -
of -service.
A leave for medical reasons beyond 60 days per calendar year
requires the action and approval of the FD membership, the City
Administrator, and the Rosemount City Council. Any time beyond
the 60 days allowed per calendar year does not count toward time -
of -service with the RFD.
To return to active, unrestricted duty would require a letter
from your physician that is acceptable to both the City's
insurance provider and the RFD physician. If you are able to
secure such a letter prior to February 28, 1991 please have it
sent to:

Our time table for moving ahead to get you the additional time
necessary for recovery, should you need it, will be as follows:
Tuesday, February 26, 1991 - Seek membership approval,
if approved;
February 27, 1991 to March 4, 1991 - seek City Administrator
approval,
if approved;
Tuesday, March 5, 1991 - Seek council approval
If approved at all levels, your medical leave will be retroactive
to March 1, 1991 and will be in effect until terminated by your
request and having met all necessary requirements. Please refer

to the "Bylaws" and the "Policy and Procedures" manual for
guidance and options along these lines.
A letter indicating the membership's, administrator's, and
council's decision will be forthcoming after March 5, 1991, or
sooner, if medical leave were to be denied by the membership or
the City Administrator prior to reaching the council.

RE: Light Duty Termination/Medical Leave
On December 31, 1990 your period of light duty will terminate.
As of that date you will have no additional light duty time
available to you for your current injury. At the end of light
duty a fire fighter does have several options available to them.
Two of which are to go on a medical leave of absence or return to
unrestricted duty. In order to return to unrestricted duty, it
would require a letter from your doctor saying that you are now
able to perform all the duties of afire fighter as outlined in
NFP 1001 and this would also need to be reviewed by the city
doctor. In order to begin your first 60 days of medical leave,
it would be necessary to gain approval of the city administrator
and the department membership.
I would refer you to Article 8, Section 2 of the fire department
bylaws which indicate medical leaves of absence may be granted
only with a doctor's slip. These leaves of absence may be
granted for up to sixty days by the membership, subject to the
approval of the city administrator. Medical leaves of absence
for sixty days or less per calendar year, does not affect the
member's time -of -service. A medical leave of absence beyond
sixty days requires membership, city administrator, and city
council approval. A medical leave of absence, any time beyond
the sixty days per calendar year, will not count towards time -
of -service.
You would be eligible to begin that first sixty days of medical
leave on January 1, 1991 which could continue through
February 28, 1991.
The Rosemount Fire Department and city administrator have
reviewed your status and need for medical leave from
January 1, 1991 until February 28, 1991 and have ruled as is
indicated below.
