RECOMMENDED ACTION: A motion to accept Alternate B of the Valley Oak Pond Project dependent on the participation from Ducks Unlimited and Koch Refining for funding. COUNCIL ACTION: Adopted resolution (Alternate B) TO: Mayor Napper Council Members Klassen, Oxborough,, Wi)-lcox, Wippermann FROM: Stephan Jilk, City Administrator DATE: March 1, 1991 RE: Valley Oak Pond Contract On Tuesday you will be asked to consider the awarding of the contracts for the completion of the "Valley Oak Pond" Project. This item was deferred from our January 15th meeting when you formally received the bids for the project. At that meeting it was decided to wait until March 5, because the information regarding the potential sponsorship of a Ducks Unlimited Project was unknown then. This Ducks Unlimited Project could provide the funding to create "wet lands" in all three ponds proposed under this project. Since that time we have had discussions with Ducks Unlimited and people from Koch Refining who is considering the sponsorship. The estimated cost difference to create the wet ponds is $32,700. Koch representatives have indicated that they will consider making a contribution to the City for this amount. We do not have a formal commitment at this writing but are expecting one. In this regard Mr. Bill Allen, area manager for Ducks Unlimited will be present at our meeting to present information regarding their program, what type of "environment" they would develop there and what the residents would expect to be created. I have sent an announcement of this presentation to all residents who were notified of the previous meetings on the project. If the Ducks Unlimited proposal is acceptable we must decide as to whether to proceed with the wet ponds or dry ponds concept. To recap the bids and the alternate bids from when we received them and how the different prices are affected by the choice of the alternates. Please see the attached bid tabulation from the bid opening which shows the bids listed in order - 1.) being low bid. If you proceed with: 1.) Base Bid - consider Resolution marked "Base" 2.) Alternate A - consider Resolution marked "Alt All 3.) B $158,722.72 $162,062.20 $172,689.07 $172,727.00 $184,172.00 $185,526.50 VALLEY OAR POND OUTLET PROJECT #197 BID TABULATION On January 4, 1991 we opened bids for Contract 1990-6, Valley Oak Pond Outlet, Project #197. Attached is a bid tabulation of those results. As you can see, the lowest responsible bidder changes depending upon what alternative we choose. Alternate A would provide one wet pond, Alternate B would provide three wet ponds. the lowest responsible base bid is about 16% under feasibility estimated cost and 25% under the engineers estimate. Applying an overhead factor to this would yield a project cost of $177,434 excluding easement costs. The individual assessment would then be about $445. Estimates for easement costs could add another $300, or more, to the assessment amount bringing the total cost to about $745. If Alternate A is awarded with the base bid, then the estimated project costs would be approximately $181,590 for the base bid and $14,400 for the 20 lots around Pond 1, again excluding easement cost. Under this scenario, the individual assessment would be approximately $453 plus another $300 for easement acquisition bringing their estimated assessment to approximately $753. The lots around the pond would be charged an additional $725 bringing their total estimated assessment to approximately $1,478, without outside funding. The bid was structured so we could wait until March 5, to find out if there was any outside funding assistance before we decided we want to proceed with Alternate A or if the property owners adjacent the pond bring in a petition, signed by the majority of them supporting construction and payment for the wet pond. WHEREAS, all bids on construction of Valley Oak Pond Outlet Improvements were tabulated and accepted on January 15, 1991 by the City Council, and; WHEREAS, the bid of Brown & Cris in the amount of $129,988.00 for the construction of the Base Project improvements in accordance with the plans and specification and advertisement for bids is the lowest responsible bid for these improvements and was accepted. NOW THEREFORE BE IT RESOLVED, that the City Council awards the contract for Valley Oak Pond Outlet Improvements Base Project to Brown & Cris in the amount of $129,988.00 and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for the construction of said improvements for and on behalf of the City of Rosemount. BE IT FURTHER RESOLVED, the City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposit of the successful bidder and the next two lowest bidders shall be retained until a contract has been executed. Dave commented that if the award is made, it should be made contingent upon several items. Accordingly, the Council may wish to award the Base Bid together with Add Alternates "A" and "B" to S. M. Hentges & Sons, Inc. in the amount of $158,722,72, contingent upon the following items: 1. Receipt of a letter from Ducks Unlimited/Koch Refining Company indicating that they will contribute 532,700 for the construction of the wet ponds. 2. Acquisition of Rights -of -Entry for all affected pZoperties located north of 160th Street West. 3. Acquisition of a Right -of -Entry for the Empire Aggregate property, or initiation of Eminent Domain proceedings as provided for in Minnesota Statutes, Chapter 117. 4. Agreement by the Contractor to accept a delay in the contract award (as necessary to complete Items 1 - 3) without additional cost to the City.
