At its September 25th meeting the Planning Commission acting as
the Board of Appeals and Adjustment denied the Variance Petition
of Beth & Greg Bergacker, 3676 143rd Street West.
The Bergacker' s are currently constructing a home on a 10 acre
parcel situated on the east side of Akron Avenue approximately
1/4 mile north of County Road 38, and desire to construct a 2400
square �oot accessory building on that property. The Board of
Appeals and Adjustments denied the variance because the proposed
_ building doss_ _not conform with aesthetic requirements for _
accessory buildings on Agriculture zoned properties less than 20
acres in size.
The Bergacker's have requested the opportunity to appeal the
Board's decision based on the argument that they are being
treated differently than other property owners in the Agriculture
District.

Variance Appeal of Beth & Greg Bergacker for November 20, 1990 at

TO WHOM IT MAY CONCERN:
N���CE IS H�RE�Y GIVEN, the City Council of the City of Rosemount will
hold a Public Hearing to consider the item listed below on Tuesday, November
2�, 1990, in the Council Chambers of the City Hall, 2875 145th Street West,
begianing at 8:00 p.m. or as soon thereafter as possible. The Public Hearing
listed below pertains to the following described property:
iThe South 328.16 feet of the North 722.25 feet of the West 1/2 of the
Northeast 1/4 of Section 22, Township 115, Range 19, Dakota County,
Ntinnesota, Subject to Street Easement.
The purpose of this hearing is to consider the-variance appeal of Beth and- - - -
Greg Bergacker of 3676 143rd Street W. The City of �2osemount Board of
.�ippeals and Adjustments has denied the Bergacker's request for a variance
to Zoning Ordinance aesthetic requirements for accessory buildings in the
Agriculture District (less than 20 acre parcel size). The Bergacker's have
proposed to const:uct on their property at 13080 Akron Avenue a 2400 sq. ft.
accessory building which does not meet Zoning Ordinance requirements for
ex�erior building materials.
