Jim Oberg, 12261 South Robert Trail, has petitioned the City to rezone his property (see attached map) from Agriculture to Rural Residential. The property in question is approximately 5 acres in size and is legally described as follows : Part of the East Half (E�) of the Northeast Quarter (NE4) lying west of State Trunk Highway #3 and south of a line commencing at a point on the west right-of-way south of its intersection with the north line of the Northeast Quarter (NE4) right 90 degrees 438 . Q5 feet to the west line of the East Half {E�) of the Northeast Quarter (NEa) , Section 17, Township 115, Range 19, Dakota County, Minnesota. Mr. Oberg is pursuing this rezoning to address a yard setback issue, affecting his plans to build an addition to his house. Mr. Oherg desires to cor.struct an addition to his home to within 40 feet of the easement for South Robert Trail . The front yard setback for the Agriculture District is 50 feet: Mr. Oberg' s home is currently set back 50 feet and he would be unaale to construct the addition without encroaching into the required front yard setback for the district. The front yard setback requirement for the Rural Residential District is 40 feet, which would allow construction of the addition without encroaching into the required setback. The property in question is designated Rural Residential in the Comprehensive Guide Plan and abuts other property zoned Rura1 Residential on the east side of South Robert Trail . Since the property is not being used for agricultural purposes, the rezoning would be consistent with the current use of the property as a residence. The Planning Commission, at its September 11, 1990 meeting, recommended ' that City Council approve the rezoning of the Oberg property from Agriculture to Rural Residential . Ordinance No:B, adopted September 19, 1989, entitled "City of Rosemount - Zoning Ordinance," is hereby amended to rezone from Agriculture to Rural Residential the following described property located within the City of Rosemount, Minnesota to-wit: Part of the East Half (E'�) of the Northeast Quarter {NE 4) lying west of State Trunk Highway #3 and south of a line commencing at a point on the west right-of-way south of its intersection with the north line of the Northeast Quarter (NE 4) right 40 degrees 438.05 feet to the west line of the East Half (E�) of the Northeast Quarter (NE 4), Section 17, Township 115, Range 19, Dakota County, Minnesota. SECTION 2. The Zoning Map of the Citv of Rosemount referred to and described in said Ordinance No. B as that certain map entitled, "Zoning Map of the City of Rosemount," shall not be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove provided for in this Ordinance and all of the notation references and other information showa thereon aze hereby incorporated by reference and made a pazt of this Ordinance.
