Jim Oberg, 12261 South Robert Trail, has petitioned the City to rezone his
property ( see attached map) from Agriculture to Rural Residential . The
property in question is approximately 5 acres in size and is legally
described as follows :
Part of the East Half (E 1/2 ) of the Northeast Quarter (NE 1/4 ) lying
West of State Trunk Highway #3 and South of a Line commencing at a
point on the West right-of-way of State Trunk Highway #3 1452 . 58 feet
following the right-of-way South of its intersection with the north
line of the Northeast Quarter right 90 degrees 438 . 05 feet to the west
line of the East Half of the Northeast Quarter, Section 17 , Township
115, Range 19 , Dakota County, Minnesota.
Mr. Oberg is pursuing this rezoning to address a yard setback issue
affecting his plans to build an addition to his house. Mr. Oberg desires
to construct an addition to his home to within 40 feet of the easement for
South Robert Trail . The front yard setback for the Agriculture District is
50 feet. Mr. Oberg' s home is currently setback 50 feet and he would be
unable to construct the addition without encroaching into the required
front yard setback for the district. The front yard setback requirement
for the Rural Residential District is 40 feet which would allow
construction of the addition without encroaching in the required setback.
The property in question is designated Rural Residential in the
Comprehensive Guide Plan and abuts other property zoned Rural Residential
on the east side of South Robert Trail . Since the property is not being
used for agricultural purposes the rezoning would be consistent with the
current use of the property as a residence.
The Planning Commission at its September 11, 1990 meeting recommended that
City Council approving this rezoning of the Oberg property from Agriculture
to Rural Residential .
RECOMMENDED ACTION: Motion to set hearing date for October 2 , 1990
at 8 : 00 p.m. to consider Jim Oberg Property
Rezoning.
COUNCIL ACTION:
Approved.

NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount
wi7�l hold a Public Hearing to consider the item listed below on
Tuesday, October 2, 1990, in the Council Chambers of the City Hall,
2875 145th Street West, beginning at 8: 00 p.m. or as soon
thereafter as possible. The Public Hearing listed below pertains
to the following described property:
Part of the East Half (E 1/2 ) of the Northeast Quarter
(NE 1/4) lying West of State Trunk Highway #3 and South
of a Line commencing at a point on the West right-of-
way of State Trunk Highway #3 1452 .58 feet following the
right-of-way South of its intersection with the north
line of the Northeast Quarter right 90 degrees 438 . 05
feet to the west line of the East Half of the Northeast
Quarter, Section 17, Township 115, Range 19, Dakota
County, Min�esota.
The purpose of this hearing is to consider rezoning of 12263 South
Robert Trail (a residence) . This involves rezoning of an
approximately 5 acre parcel of property situated on the west side
of South Robert Trail {State Highway #3) approximately 1J4 south
of 12Cth Street f-rom the Agriculture District to the Rural :
Residential District.
Such persons as desire to be heard with reference to this item will
�e heard at this meeting.
