Mr. �tto Ped, 4992 145th Street East, has petitioned the City to consider
an amendment to the Zoning Ordinance Text to allow Mineral Extraetion as a
permitted use in the Agriculture District only east of State Trunk Highway
52, subject to requixements of Section 14.8 of the Zoning Ordinance. Mr,
Ped is pursuing this zoning ordinance text amendment in order to allow a
sand and gravel mining operatian to be conducted on his property situated
on C.S.A.H. 42 approximately 1-� miles east TH 52. Attached with this
Executive Summary is a copy of Ordinance B-9 an amendment to Section 6. 1 of
the Zoning Ordinance relating to germitted uses in the Agriculture
District. Also attached is a copy of the public notice for this item which
was published and mailed to all owners of Agriculture zoned property east
of TH 52 .
The City Couneil discussed this issue at its August 7th meeting and
concluded that it did not object to sand and grave� mining taking place on
Mr. Ped's property. If excavation could not be completed during one
construction season, however, it should be required that the sand and
g�avel removal be regulated by means of a Mineral Extraction Permit. The
City Council reached consensus that it would be willing to consider an
amendment to the Zoning Ordinance text to allow sand and gravel mining by
permit on Agriculturai zoned property, situated east of State Trunk Highway
52, subject to reguirements of Section 14 . 8 ( Mineral Extraction Permit
Requirements) .
Mr. Ped proceeded to request the required aoning text amendment, which was
considered by the Planning Commission at its August 28th meeting. At that
meeting the Commission recommended approval to City Council of the proposed
zoning text arnendment.

THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS
FOLLOWS:
SEC"TION 1. Section 6.1 {District Use Regulation - Agriculture District) of Ordinance
B - City of Rosemount Zoning Ordinance is amended by adding the following paragraph to sub-
section B. (Uses Permitted by Right):
9. Mineral Extraction only east of State Trunk Highway 52 and subject to
� requirements of Section 14.8.
SECTION 2. This ordinance shall be effective unmediately upon its passage and
publication.

G. Boundaries indicated as approximately following the center line of streams, rivers, canals '
or other bodies of water shall be construed to follow such center lines.
H. Where the application of the aforesaid rules leaves a reasonable doubt as to the
boundaries between two (2) districts, the regulations of the more restrictive district shall
govern the entire pareel in question,unless otherwise determined by the Boazd of Appeals
and Adjustments.
SECTION 6 DISTRICT USE REGULATIONS
SECTION 6.1 AG AGRICULTURAL DISTRICT
A, Purpose and Intent. This district is primarily established to encourage the long term
continuation of agricultural and related uses in the City in areas which are both suitable
for agriculture and are not planaed for urban development until after the turn of the
century.
B:' Uses Permitted bv Ri�ht
l. Agriculture, accessory and related uses.
2. Commercial greenhouses and landscape nurseries.
3. Home occupations subject to requirements established in Section 4.16 of this
Ordinance.
4. Veterinarv clinics. kennels and furbearing animals provided as follows:
a. The site shall be not less than twenty (20) acres in size.
b. All structures shall be located a minimum of seventy-five (7�) feet from all
residential property lines. :;
5. The keeping of horses provided as follows:
a. The site shall be not less than five (5) acres in size.
b. All structures shall be located a minimum of seventy-five (75) feet from all
residential properry lines, and
c. The maximum number of harses shall not exceed one (1) per two (2) acres.
6. The raising or keepin� of commercial livestock and fowl (cattle, sheep, hogs, poultry,
etc.), dairy faz-ming and commercial horse stables provided as follows
a. The site shall not be less than twenty (20) acres in size, and
b. All structures shall be located a minimum of sevenry five (7�) feet from all
residential property lines.
7. Stands for the sale of a�sicultural products provided said products are at least in part
raised on the premises.
8. Sia lg,e-fam'ilv detached dwellings and accessory structures provided all dwellings shall
meet all site dimensional standards as established by Secuon 7.1 and the City's
minimum requirements for on-site sewer systems.
SECTION 6.2 AG-P AGRICULTURAL PRESERVE DISTRICTS
A. Purpose and Intent This district is expressly established to allow land owners to camply
with the requirements of the Metropolitan Area Agricultural Preserves Act, Minnesota
Statutes, Chapter 473H.

NOTICE IS HEREBY GIVEN, that the City Council of the City of
Rosemount will conduct a public hearing on Tuesday, September 18,
1990, in the Council Charnbers of City Ha11, 2875 145th Street West,
beginning at 8 : 00 p.m. or as soon thereafter as possible. The
purpose of this hearing is to consider an amendment to Ordinance
B - Zoning Ordinance, affecting Section 6 (District Use
Regulations) . The proposed amendment would cause Section 6 . 1,
Distric� Use Regulations for the Agriculture District to be amended
to recognize Mineral Extraction as a permitted use in the
Agriculture District, only east of State Trunk Highway 52 and
subject to requirements of Section 14 . 8 (Mineral Extraction Permit
Requirements) . Currently the City allows Mineral Extraction as a
�ermitted use only in the General Industrial District.
Any questions regarding the proposed Zoning Ordinance Amendment may
be directed to the City of Rosemount, Cammunity Development
