USPCI, Inc. has requested that the City authorize a division of property
located on County Road 38, by metes and bounds description. The purpose of
this request is to allow the formal division and titie transfer of a
portion �of a parcel, which is currently severed by CR 38 . Enclosed with
this Executive Summary is a letter from USPCI which includes legal
descriptions of the existing and proposed parcels . Also included is a map
indicating the location of the parcel in question.
The property is currently zoned Agriculture. Since the division of
property which has been requested would result in a parcel which is less
than 1D acres in size it will be necessary to require the applicant to
agree to legally combine the 3 . 3 acre parcel (parcel B on the sketch) to be
created with the abu�ting property to the north (parcel A) . Attached with
this Executive Summary is a Lot Combination Agreement.
USPCI has not yet made application to the City for an znterim Use Permit
for its propased facility; and, therefore the property for the time being
will remain in agricultural use. The City Council and applicant' should
recognize that if a permit is issued to USPCI, the property should be
platted due to the proposed use and number of parcels involved. The
property is currently owned by M.G. Astleford and it is the desire of USPCI
to acquire that portion of the parcel situated north of County Road 38 as
part of its other holdings north of CR 38 . No park dedication is triggered
at this time due to the Agriculture zoning and the combination of the
parcels involved,
At its August 28th meeting the Planning Commission recommended that City
Council approve this division of property subject to an executed Lot
Combination Agreement.

A RESOLUTION FOR A SIMPLE LOT DIVISION
WHEREAS, the Planning Commission of the City of Rosemount has
reviewed and recommended approval of a metes and bounds parcel
division, described below, of the following legally described
parcel:
The East 1/2 of the Northwest 1/4, of Section 29 Township
115, Range 18, Dakota County, Minnesota.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the Gity of
Rosemount hereby approves the division of the above referenced
parcel resulting in the following described parcels :
That part of the East 1/2 of the Northwest 1/4, Section
29, Township 115, Range 18 lying Northerly of County Road
38 .
- and -
That part of the East 1/2 of the Northwest 1/4, Section
29, Township 115, Range 18, lying Southerly of County Road
38.
- BE IT FURTHER RESOLVED, that approval of this metes and: bounds
parcel division is subject to an executed Lot Combination
Agreement, attached hereta as Exhibit A.

_ LOT COMBINATION AGREEMENT
THIS AGREEMENT made this day of �
1990 by and between USPCI, INC. , a Delaware corporation with its
principal office at Houston, Texas and its local office at
Rosemount, Minnesota, herein referred to as "USPCI" , and CITY OF ,I
. ROSEMOUNT, a Minnesota municipal corporation in the County of I
Dakota and State of Minnesota, hereinafter referred to as "City" .
WITNESSETH:
WHEREAS, USPCI is owner of the following described
premises to wit:
Parcel A•
All of the East 1/2 of the Southwest 1/4 and
the Southeast 1/4 of the Northwest l/4 lying
Southerly of State Trunk Highway 55, Section
20, Township 115, Range 18, Dakota County,
Minnesota.
WHEREAS, the City has approved a division of property by
metes and bounds description which has authorized creation of the
following described parcels;
Parcel B•
That part of the East 1/2 of the Northwest
1/4, Section 29, Township 115, Range 18 lying
Northerly of County Road 38 .
Parcel C•
That part of the East -1/2 of the Northwest
1/4, Section 29, Township 115, Range 18,
lying Southerly of County Road 38 . 6 .
WHEREAS, the said Parcels A and B are adjacent to �«ch
other and have a common boundary line.
NOW THEREFORE, the parties do hereby covenant and declare
that Parcels A and B be, and the same hereby are, subject to the
following xestrictions to wit:
1 . That upon recording of this Lot Combination Agreement,
neither of said Parcels A or B shall be sold, transferred, ,I
encumbered or otherwise alienated separate and apart from the '
other. It is agresd hereby that Parcels A and B shall be a
single integral tract for purposes of the City's zoning and
subdivision ordinances and shall not be sold, transferred,
encumbered, or otherwise alienated separately without approval of
the City.
2 . That the restrictions set forth by this Lot Combination
Agreement shall run with the land.
IN WITNESS WHEREOF, the parties hereto have executed this
Lot Combination Agreement the day and year first above written.
