L ****�**********�r*�r�t****************MEMO*************************�********** DATE: MAY 10, 1990 T0: MAYOR & COUNCILMEMBERS C/O CITY ADMINISTRATOR JILK FROM: CITY ENGINEER/PUBLIC WORKS DIRECTOR HEFT RE: ITEM FOR THE MAY 15, 1990 COUNCIL MEETING CONSENT AGENDA Receive Bids Contract 1990-1, Pine Bend Trail Improvements Pro�ect #199 This item consist of analyzing the bids received and setting a new course of action. On April 27, 1990 we received bids for the Pine Bend Trail Street Improvements for the existing paved portion of Pine Bend Trail from Highway 55 to C.F. Industries. Although the low bid was slightly higher than the Engineers estimate, it was almost 49% higher than the feasibility report estimate presented at the September 19 , 1989 public hearing. At that hearing we estimated the assessable cost for this project to be $153 , 000 with the non-assessable cost being $32, 000. The non-assessable cost included crack filling and miscellaneous patching. All other cost including sub-grade correction, bituminous overlay, bituminous shoulders, miscellaneous culvert work, etc. were considered as assessable cost. Breaking that out of the bid reveals that the non-assessable cost would be $65, 412 whiZe the assessable cost would be $209,929 for an increase of 104% and 37% respectively. The non-assessable cost would come out of the street core cost that is made up of excess MSA monies after State Aid projects have been assessed. However, adding another $57 , 000 to this figure would certainly adversely impact our funds. Especially since we proposed from the start to assess all the assessable cost. Because the feasibility report estimate apparently did not accurately address the entire scope of the project, I would recommend that Council set a new public hearing for this project to be held on June 5, 1990 and continue consideration of this item until June 5. Depending on the outcome of the public hearing, the Council can either reject or award the contract because the bids are good until June 11, 1990. As long as we have previously prepared the mailing list it will not pose any problems for us from the time standpoint. Recommended action for Council to consider is to continue receipt of bids/award contract of Pine Bend Trail Improvements to the June 5, 1990 meeting. CITY OF ROSEMOUNT DAROTA COUNTY, MINNESOTA RESOLUTION 1990 - A RESOLUTION CALLING FOR A PUBLIC AEARING PINE BEND TRAIL STREET IMPROVEMENTS CITY PROJECT #199 WIiEREAS, the City Council received the feasibility report and found the project feasible for Pine Bend Trail Street Improvements, City Project #199, on the 19th day of September, 1989 ; and WHEREAS, the statute provided that no such improvements shall be made until the Council has held a public hearing on such improvements following mailed notice and two publications thereof in the official newspaper stating time and place of the hearing, the general nature of the improvement, the estimated costs thereof, and the area proposed to be assessed, in accordance with the law; and NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota, as follows: l. A public hearing will be held at the time and place set forth in the Notice of Hearing attached hereto as Exhibit A to consider said proposed improvements. 2 . The nature of the improvements, the estimated cost of each major portion thereof, and the areas proposed to be assessed therefor are described in the form of Notice of Hearing hereto attached. 3 . The notice of said public hearing shall be in substantially the form contained in the notice hereto attached. 4 . The City Clerk is hereby authorized and directed to cause notice of said hearing to be given two publications in the official newspaper. Said publications shall be one week apart, and at least three days shall elapse between the last publication and the hearing. Not less than ten days before the hearing the Clerk shall mail notice of the hearing to the owner of each parcel of land within the area proposed to be assessed as described in the notice. For the purpose of giving such mailed notice, owners shall be those shown to be such on the records of the County Auditor or, if the tax statements in the County are mailed by the County Treasurer, on the records of the County Treasurer. As to properties not listed on the records of the County Auditor or the County Treasurer, the Clerk shall ascertain such ownership by any practicable means and give mailed notice to such owners. . , � (nV 1 P.O. W. osernoun� ROSEMOUNT MINNESOTA 55068 612-423-441 1 CITY OF ROSEMOUNT DAROTA COIINTY, MINNESOTA PUBLIC NOTICE NOTICE OF PUBLIC HEARING ON IMPROVEMENTS PINE BEND TRAIL STREET IMPROVEMENTS PROJECT NO. 199 TO WHOM IT MAY CONCERN: NOTICE IS HEREBY GIVEN, that the City Council of the City of Rosemount, Minnesota, will meet at 8 : 00 o'clock p.m. or as soon thereafter as possible, Tuesday, June 5, 1990, in the Council Chambers of the City Hall, 2875 145th Street West, to consider the following improvements: Project #199 - Pine Bend Trail Street Improvements The total estimated cost of said improvements is $330,400. The amount to be assessed is estimated to not exceed $330, 400. The area proposed to be assessed for the foregoing improvements would generally be all that area generally described adjacent to Pine Bend Trail located in the south half of Section 18 and also in the north halves of Sections 19 and 20, Township 115, Range 18, Dakota County, Minnesota. The westerly project terminus is located at the intersection of Pine Bend Trail and S.T.H. 55 in the southwest quarter of Section 18. From this point, the project extends approximately 1. 5 miles easterly and terminates at the Chicago and North Western Railroad crossing located adjacent to C.F. Industries in the north half of Section 20. Such person as desires to be heard with reference to the proposed improvements will be heard at this meeting. Written or oral opinions will be considered.
