6e. MAC�S BOTTLE SHOP - SIMPLE LOT DIVISION
Mr. Cliff Carlson has requested that the City consider authorizing
a simple lot division of property within South Rose Park Addition
Replat affecting the Mac's Bottle Shop Property.
Attached with this review are the following three items:
1. Boundary Survey and Legal Description for Mac' s Bottle Shop
Property.
2 . Copy of Mac's Bottle Shop Site Plan indicating existing and
proposed lot boundaries.
3 . Copy of Proposed Development Plan for abutting property
(Rosemount Center Project) .
4. Shared Parking Agreement.
Last fall (September 19, 1989) the City Council approved a Simple
Lot Division to create the Mac's Bottle Shop parcel. The City
permitted the Mac's Property to be divided by simple lot division
based upon a commitment from Mr. Carlson to include that property
in the final plat of the Rosemount Center Project.
When the simple lot division was discussed last fall Mr. Carlson
originally requested that the east lot line for the Mac's Bottle
Shop property be situated on the center line of the common drive
designed to also serve the proposed Rosemount Center property (see
Mac's Site Plan) . Because additional parking (7 spaces) was
required to meet minimum requirements for the proposed building,
Mr. Carlson was required to include proposed parking to be situated
on the east side of the common drive within the parcel boundaries
of the Mac' s Bottle Shop property.
However, when the simple lot divisian was approved it was
recognized that upon development of the Rosemount Center project
the lot line could be reconfigured and parking could be controlled
through a Planned Unit Development Agreement.
Mr. Carlson has recently submitted to the City a revised concept
. t
plan for the Rosemount Center Project (see attached plan} . To
allow a mortgage to be place on the Mac' s Bottle Shop Property at
this time, Mr. Carlson is now requesting that the City authorize
an additional simple lot division to divide the Mac' s Bottle Shop
Property as indicated on the attached Mac's Bottle Shop Site Plan
(see existing and proposed lot boundaries) .
Ultimately both of the resulting parcels and the future Rosemount
Center Property would be replated. Temporarily, a Shared Parking
Agreement (see attached Agreement) referencing the required shared
parking arrangement would be recorded against the new parcel to be
created. When the Rosemount Center project is final platted a
revised Planned Unit Development Agreement will specify the shared
parking arrangement between that property and the Mac's Bottle Shop
Property.
The Planning Commission has recommended approval of the proposed
simple lot division to City Council subject to submittal of a
Certificate of Survey and Leqal Description of the proposed parcel
and subject to execution of a shared parking agreement. It is
further recommended that the Planninq Commission reference in its
action that the Carlson�s in a letter (see attached letter) dated
November 14, 1989, have committed to replatting the Mac�s Bottle
Shop property by December 31, 1991.

Dear Mr. Jilk:
In order to induce the City of Rosemount to approve a lot
subdivision of the property described on Exhibit "A" attached
hereto, please be advised that it is the intent of Carlson Farms
of Minnesota, a Minnesota general partnership consisting of
Ronald C. Carlson, Richard J. •Carlson, and myself, as general
partners, to plat the property described on Exhibit "A" in
� connection with the development of the remainder of Lot 1,
Block 1, South Rose Park Addition Replat. In the event the
remainder of the parcel does not develop as soon as anticipated,
Carlson Farms of Minnesota will formally plat the property
described on Exhibit "A" by itself before December 31, 1991.

AGREEMENT
THIS AGREEMENT made and entered into this day of , 1990,
by and between the City of Rosemount, a Minnesota municipal
corporation, ( "City" ) , and CARLSON FARMS OF ROSEMOUNT, A Minnesota
general partnership, ( "owner" ) .
WHEREAS, the City of Rosemount has authorized a division of
property by Simple Lot Division resulting in the creation of two
separate parcels legally described as Parcels A and B on the
attached Exhibit "A" ; and
WHEREAS, the above referenced owner owns Parcels A and B as
legally described on the attached Exhibit "A" ; and
WHEREAS, the owner recognizes that adequate number of parking
spaces to meet City of Rosemount Zoning Ordinance requirements have
not been provided within the boundaries of Parcel A, to serve
existing develapment on Parcel A, comprised of a 9, 000 square foot
Co.*nmercial Building; and
WHEREAS, the owner has agreed to restrict ,usage of seven
e�isting parking spaces situated within Parcel B, for usage
exclusively for purpose of providing parking for commercial
development situated on Parcel A; and
WHEREAS, the owner has agreed to replat Parcels A and B in
conjunction with replatting and development of the remainder of Lot
1, Block 1, South Rose Park Addition Replat; and
WHEREAS, in the event the remainder of Lot 1, Block l, South
Rose Park Addition Replat, does not develop as soon as anticipated,
Carlson Farms of Minnesota will replat the properties described on
Exhibit "A" before December 31, 1991 .
NOW THEREFORE, in consideration of this mutual covenant, the
parties agree as follows :
1 . The owner shall restrict usage of seven parking spaces
situated within Parcel B, for usage exclusively for the purpose of
providing parking for commercial development situated on Parcel A.
2 . The City will allow this agreement to be renegotiated at
such time as the remainder of Lot 1, Block 1, South Rose Park
Addition Replat is developed and a Planned Unit Development
Agreement is executed to reference a shared parking arrangement
between parcels .
3 . This Agreement shall run with the land and mag be
recorded against the title of Parcel B.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year above written.

Attached is a copy a Resolution to authorize the Mac's Bottle Shop
Simple Lot Division. After packet distribution on Friday, City
Clerk, Sue Johnson, reminded Community Development Staff that a
Resolution was required for this item. This resolution is written
to authorize the proposed simple lot division subj ect to the shared
parking Agreement which was attached with the origonally packet
materials for this item.

A RESOLUTION FOR A SIMPLE LOT DIVISION
WHEREAS, the Planning Commission of the City of Rosemount has
reviewed and recommended approval of a simple lot division,
described below, of the following legally described parcel:
Al1 that part of the West 268 . 00 feet, as measured at
right angles to and parallel with the west line, of Lot 1,
Block 1, South Rose Park Addition Replat, according to the

Rosemount will hold a public hearing on Tuesday, September 3 ,
