attached notice of a public hearing for consideration of an

TO WHOM IT MAY CONCERN:
N�TICE IS HEREBY GIVEN, the Gity Council of -the City of
Rosemount will hold a public hearing to consider the item
listed below on Tuesday, June 19, 1990, in the Council
Chambers of the City Hall, 2875 145th Street West,
beginning at 8 : 00 p.m. or as soon thereafter as possible.
The public hearing listed below pertains to the following
described property:
That part of the east 1/3 of the east 1/2 of the
Southeast Quarter (SE 1/4 ) located north of State
Trunk Highway 55 , Section 20, Township 115 , Range
18, Dakota County, Minnesota; «nd
That part of the west l/3 of the west 1/2 of the
Southwest Quarter (SW 1/4) located north of State
Trunk Highway 55; and the north 950 feet of the
south 2 , 000 feet of the west 520 feet of the east
5/6 of the Southwest Quarter ( Sh7 1/4) , Section 21,
Township 115, Range 18, Dakota County, Minnesota.
The property in question encompasses approximately 39
acres situated on the north side of State Trunk Highway
55 and approximately 1/2 mile west of Fahey Avenue.
The purpose of this hearing is to consider an Interim Use
Permit Application from Parker Communications , ID�
Center, 28th Floor, Minneapolis, MN 55402 , to allow

6. PUSLIC HEARII�3G - PARKER COMMUNICATIONS - INTERIM USE PERMIT
1�PPLICATION
Parker Communication of Minneapolis, has submitted an Interim Use
Permit Application for development of the KTCJ-A.M. Radio Antenna
Facility.
Attached with this review are the following: Parker Communications
Interim Use Permit Application submittal, Interim Use Agreement and
Resolution authorizing approval of Interim Use Permit subject to
conditions.
Sta�f has reviewed and evaluated the Interim Use Permit Submittal
prepared by Parker Communications and has determined that it
provides the information required under the provisions of Ordinance
B-4 (A.M. Radio Communications Facility Permit Requirements) .
Conditions and requirements for the Interim Use Permit have been
specified in both the Application submittal, the Interim Use
�igreement and the Resolution which will serve as the actual, permit.
Staff review indicates that the project pl�ns conform to a11 Zoning
Ordinance requirements and that the Interim Use Agreement
accurately specifies all negotiated issues such as economic
berefits .
The Resolution does include a condition that the property must be

The Resolution attached with this review authorizes appro�al of the
Parker Communications Interim Use Permit subject to the listed
conditions. One of the conditions is that the permit is subject
to execution of the Interim Use Agreement. At this time the
Agreement is still being reviewed by the City Attorney and by the
Applicant's Attorney. Based upon legal review staff may present
minor changes to the attached Interim Use Agreement at the meeting
on tuesday. Presuming all issues pertaining to the Interim Use
A�reement are resolved by Tuesday action to approve the permit
could be taken tuesday evening. Staff will provide ff.nal
ra�co�nmenaation to City Council at t?�� meetiag.
INTERIM USE AGREEMENT
THIS AGREEMENT is made as of , 1990, by and
between PARKER C01�UNICATIONS, INC. , a Minnesota corporation �
( "Parker" ) , and the CITY OF ROSEMOUNT, a public body corporate
and politic organized under the laws of the State of Minnesota
(the °City�� � ,
RECITALS
Parker is the buyer of approximately thirty-nine (39 ) acres
of land located in Dakota County, Minnesota, legally
described in Exhibit _ attached hereto (the "Property" ) .
Parker desires and intends to improve the Property by the
construction of an A.M, radio antenna system to serve
Parker's radio station "KTCJ-AM. ° Such antenna system will
consist of four (4) A.M. radio ant�nna towers of
approximately 356 feet in height, including related
transmitter buildings, maintenance facilities and underground
radial antenna lines (the "Improvements° ) .
The City Council of the City of Rosemount, at its regular
meeting of May 15, 1990, pursuant to Minnesota Statutes,
Section 462 . 3597, approved and adopted Ordinance No. B-4, an
ordinance amending Ordinance B, City of Rosemount Zoning
Ordinance adopted September 19, 1989, (the "Zoning
Ordinance" ) , to allow A.M. radio antennae and supporting
towers and related accessory structures by interim use permit
in the AG Agricultural zoning district on properties situated
in that part of the City of Rosemount, north and east of
State Trunk Highway 55 . Ordinance No. B-4 is attached as
Exhibit hereto.
The City Council of the City of Rosemount, at its regular
meeting of , 1990, pursuant to Sections 6 . 1, 11 .4 and
14 . 10 of the Zoning Ordinance, approved the issuance of an
interim use permit ( "the IUP" ) to Parker to allow
construction and operation of the Improvements on the
Property. City of Rosemount Resolution No. , an Interim
Use Permit for the Improvements is attached as Exhibit _
hereto.
As of the date of this Agreement, the Property is zoned "AG
Agricultural" under the Zoning Ordinance.
NOW, THEREFORE, in consideration of the mutual covenants
contained herein, the recitals (which are incorporated herein) ,
�nd other good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, the parties hereto
agree as follows :
1 . Interim Use Permit Parker may construct, operate and
maintain the Improvements on the Property pursuant to the IUP,
dated , 1990, for the Term of this Agreement {as
defined herein) provided such construction, operation and
maintenance is in compliance with Ordinance No. B-4, the
standards and conditions of the IUP and this Agreement.
2 . Terna Notwithstanding anything in state law or in the
Zoning Ordinance to the contrary, the Term of this Agreement
shall be for twenty (20 ) years from the date hereof (the "Term" ) .
After the tsn (10) year period as defined below, Parker may
request the City to extend the Term of this Agreement for an
additional period not to exceed ten ( 10) years by submitting a
new application for an IUP to the City. The Term of this
Agreement may be extended by the City, without further action,
for the additional period of the new IUP or the City may require
Parker to modify this Agreement, or enter into a new agreement.
3 . Vested Rights Notwithstanding anything in state law or
in the Zoning Ordinance to the contrary, no amendment to the City

of Rosemount Comprehensive Plan (the "Plan" ) , the Zoning
Ordinance, the City of Rosemount Zoning Map (the "Zoning Map" ) ,
or other official control of the City ( "Official Control" ) (as
defined by Minnesota Statute Section 462 . 357, subd. 15) shall
apply to or affect the Property, the number, height and layout of
the Improvements, or any other matters required or permitted by
the IUP or this Agreement for ten (10) years from the date hereof
(the "Ten-Year Period° ) . By virtue of this provision, the
Improvements are not rendered nonconforming by any change in the
Plan, the Zoning Ordinance, the Zoning Map or an Official Control
adopted during the Ten-Year Period. If the Improvements on the
Property are damaged or destroyed during the Ten-Year Period,
Parker may restore, repair or rebuild the Improvements without
City Council approval according to the requirements of the
aPProved IUP.
4 . Nonconforming Use Notwithstanding anything in state law
or in the Zoning Ordinance to the contrary, for the balance of
the Term of this Agreement, if the Improvements on the Property
become nonconforming as defined in Section 3 .2 of the Zoning
Ordinance because of a change in the Plan, Zoning Ordinance,
Zoning Map or Official Control adopted subsequent to the Ten-
Year Period, they may remain on the Property subject to
compliance with Ordinance No. B-4, the standards and conditions
of the IUP and this Agreement. If theg are damaged or destroyed
such that restoration does not exceed fifty percent (50�) of the
Smprovements' assessed value, Parker may restore, repair or
rebuild the Improvements without City Couneil approval subject to
requirements of the approved IUP in accordance with Section 13 .2
of the Zoning Ordinance. However, if after the end of the Ten-
Year Period the Improvements become nonconforming and are damaged
and destroyed such that restoration exceeds fifty percent (50�)
of the Improvements' assessed value, Parker may reapply for a new
IUP to restore, repair or rebuild the Improvements on the

Property and the City shall review and consider Parker's IUP
application in accordance with the procedures and standards as
set forth in Ordinance No. B-4 and Sections 6 . 1(c) , 11.4 and
14 . 10 of the Zoning Ordinance as of the date hereof. If the City
issues a new IUP pursuant to this Section 4, the City may request
Parker to modify this Agreement or enter into a new agreement
consistent with the new IUP, which modification or new agreement
shall run for a term of years consistent with the new IUP.
5 . Economic Benefits Parker hereby agrees to provide the
following economic benefits to the City during each year of this
Agreementc
(Ol) A direct cash payment in an amount of no less than Two
`Thousand Four Hundred Seventy Dollars ( $2,470 . 00) to the City
shall be due as of the date of issuance of a building permit
for the Improvements, and annually on the anniversary date of
such initial payment until this Agreement expires or is
terminated provided that such payment shall be adjusted
annually according to the Consumer Price Index (CPI) .
(02 ) Real estate taxes due on the Property shall be paid to
Dakota County in accordance with state laws on May 15 and
October 15 of each year as calculated by state and local
officials .
(03) At the City's option, Parker shall construct and
maintain a municipal two-way radio communications antenna in
or on the Improvements at no cost to the City ( $8, 300 . 00
annual equivalent in 1990 dollars ) . The City, or its
designees, shali have access to and free use of the antenna
for the Term.
(04} At the City's option, Parker shall produce up to
fifteen ( 15) minutes of radio programming per week for
twenty-six (26) weeks per year (the "Rosemount Review" ) for
the City and/or its designee ( $23, 400 . 00 annual equivalent in

1990 dollars } . The content of the Rosemount Review shall be
left to the discretion of the City or its designees .
(05) At the City's option, Parker shall broadcast, annually
up to one hundred ( 100) public service announcements (PSAs) ,
thirty (30) seconds in length, or two hundred {200) PSAs,
fifteen seconds in length or any combination thereof, on
behalf of the City, or any governrnental agency or community
organization designated by the City. The content of the PSAs
may include, without limitation, school closing information,
listings of community events and promotion of the City's
economic development programs ( $3, 000.00 annual equivalent in
1990 dollars) .
6 . Restrictioris on Use of Property Parker hereby agrees
that approximately one-half acre of the acreage of the Property
as depicted on Exhibit _ attached hereto shall be preserved as a
wildlife natural habitat area, undisturbed by development or
farming operations during the Term of this Agreement, except to
the extent necessary to maintain and operate the Improvements,
Further, Parker agrees that the heavily wooded northwest portion
of the property shall not be clearcut allow for construction of
the project improvements . Parker shall work cooperatively with
the City to develop a mutually acceptable plan to allow clearance
of underbrush and selective cutting of canopy trees for
installation of the required undergrou�d radials .
7 . Notice Notices given pursuant to this Agreement shall be
personally delivered or sent by certified mail to the City of
Rosemount, 2875 145th Street West, Rosemaunt, Minnesota 55068.;
and to Parker Communications, Inc. , IDS Center, 28th Floor,
Minneapolis, Minnesota 55402, attention: Ronald J. Kazda. All
notices shall be effective upon receipt.
8 . Amendments No amendment, change, waiver or modification

of this Agreement shall be binding upon either party unless in
writing and signed by both parties .
9 . Assignment This Agreement may be assigned by the parties
hereto and shall be binding upon and inure to the benefit of the
parties and their respective successors and assigns .
10 . Law Governina This Agreement shall be governed by the
laws of the State of Minnesota.
11 . Recordina. This Agreement shall run with the subject
land and may be recorded in the Dakota County Recorder's Office.
IN WITNESS WFiEREOF, the parties hereto have executed this

AN ORDINANCE AMENDING ORDINANCE B
CITY OF ROSEMOUNT ZONING ORDINANCE
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS
FOLLOWS:
SECTION 1. Section 3.2 of Ordinance B - City of Rosemount Zoning Ordinance is
amended by adding the following definitions:
A.M. Radio Antenna That portion of any communication equipment located on
the exterior or outside of any structure used for continuous or standby
transmission or reception of A.M. radio waves.
Tower A structure upon which communication equipment is mounted or attached
and including support devices such as cables, braces, etc.
SECTION 2. Section 6.1 of Ordinance B - City of Rosemount Zoning Ordinance is
amended by adding the following:
C. Uses Permitted bv Interim Use Permit
l. A.M. radio antennae and supporting towers and related accessory
structures. This use may be permitted only on properties situated in that
pazt of the City of Rosemount north and east of State Trunk Highway
55.
SECTION 3. Section 11 of Ordinance B - City of Rosemount Zoning Ordinance is
amended to include the following:
SECTION 11A A,M. RADIO COMMUNICATIONS ANTENNAE AND
SUPPORTING TOWERS
A. Permit applicants shall submit the following information together with any
other information requested by the City:
1. In submitting an application for an interim use permit for the construction
and maintenance of radio antennae, and accessory structures,the applicant
shall provide sufficient information to indicate that construction,
installation and maintenance of the antenna and tower will not create a
hazard to the health, safety and general welfare of surrounding property
owners, animal population or natural environment.
2. This information shall include an outside consultant conducting an
independent study at the cost of the applicant, demonstrating that the
tower complies with structural standards for steel antenna towers and
antenna supporting structures, Engineering Department, Electronic
Industries Association (EIA); describing the capacity of the tower,
including the number and type of antennae that it can accommodate and
the basis for the calculation of capacity; and demonstrating that the
application complies with FAA, FCC and, if applicable, State Aeronautics
Division requirements.

4 3. A site plan including contents as specified in Section 14.4 Subsection B
� of this Ordinance.
4. A wntten analysis of the impacts of the proposed project shall be
required. The applicant must discuss issues related to the aesthetics of
the project, any implications or nuisances in the operations of the project
and property tax implications for long term use of the site.
B. Permit Reqpirements for Construction and Maintenance: Permits for A.M.
radio communications antenna, towers and accessory structures erected,
constructed or located on any property and all supporting devices thereof shall
only be issued if the following standards are met or exceeded:
1. The tower shall not exceed four hundred feet (400') above grade or less
as autharized by law.
2. Antenna and or tower setbacks shall be such that the distance from the
base to the neazest property line or non-owned structures is not less than
the calculated structural collapse radius.
3. No part of any antenna or tower nor any lines, cable, equipment or wires
or braces in connection with either shall at any time extend across or over
any part of the right-of-way, public street, highway, sidewalk or property
line.
4. Towers with antennae shall be designed to withstand a uniform wind
loading as prescribed by the State Building Code and the Electronic
Industries Association recognized national standazds, whichever is more
restrictive.
5. Antenna and metal towers shall be properly protected against direct strike
by lightning, either by adequate grounding or suitable circuits designed
to provide such protection. The installation shall comply with all
applicable electrical wiring codes, statutes, regulations and standards.
6. The City shall determine whether self-supported towers or whether towers
supported by cables or guy wires serve to protect the public health, safety
and welfare.
7. All signal and remote control conductors of low energy extending
horizontally above the ground between the tower or antenna and
structure, or between towers, not buried underground, shall be at least
twelve feet (12') above the ground at all points.
8. The base of the tower and all anchors shall be surrounded with a
minimum six foot (6') high security fence with the appropriate warning
signs posted on all sides.
9. No accessory structure or appurtenances shall be temporarily or
permanently affixed to A.M. radio antennae or supporting towers except
as required to accomplish the license service for which the antenna or
tower is authorized by the FCC, or as may be approved by City Council.
10. The economic benefits, incentives and other advantages to the City and
community must outweigh any known or potential negative aspects of the
project.

11. The applicant shall furnish the City with copies of all correspondence with
the FCC and FAA regarding permit performance of the A.M. radio
antennae; or any matters affecting public health, safety and welfaze.
12. If use of the tower is discontinued for a period of twelve (12) months,
or upon expiration of the Interim Use Permit the A.M. Radio
Communications antennae, supporting towers and all above and below
ground appurtenances shall be removed.
13. The applicant shall be required to adequately maintain the A.M. radio
communications antennae, supporting towers and related accessory
structures and property upon which those facilities do not represent a
hazard or nuisance to the public, animal population or natural
environment.
C. Broadcast Interference: The applicant shall be responsible to investigate all
and remedy legitimate compiaints regarding interference to consumer
electronic equipment alleged to be caused by sigaals from the broadcast
facility.
D. Advisorv Commissian: The City Council may establish an advisory
commission to hear disputes that cannot be resolved between the broadcast
representatives and affected parties.
E. Tower Use Fee: The City Council may require an annual use fee in lieu of
t�es.
SECTION 4. This ordinance shall be effective immediately upon its passage and
publication.

WHEREAS, the City Council did receive an Interim Use Permit
Application for the Parker Communications KTCJ-AM Radio Antenna
Project pertaining to the following legally described property:

This letter, together with the supporting plans and materials '
submitted herewith, constitutes Parker Communications ' (Parker) '
application to the City of Rosemount (the City) for an Interim Use
Permit (the Permit) for its KTCJ-AM radio antenna project (the
Project) pursuant to Sections 6. 1 and 11.4 of the Rosemount Zoning
Ordinance (the Zoning Ordinance) .
The Permit application consists of the tollowing documents:

2 . Site plan and elevations of antennae and transmitter buildings .

As you requested, we have previously submitted a draft of an Interim
Use Agreement between Parker and the City (the Draft Agreement) . This
letter refers to the Draft Agreement in documenting compliance with
Zoning Ordinance Permit application requirements .
Pursuant to our May 21, 1990 meeting, this letter addresses the
requirements of Sections 11.4 and 14.4 of the Zoning Ordinance.
�ection 11 4 - Performance Standarcis for AM Radio Communication
Antenna and Su�gortina Towers:
A( 1) This section requires the Permit applicant,to provide
sufficient information to indicate that construction,
installation, and maintenance of the antennae and towers will
not create a hazard to the general welfare. Refer to our
February 28, 1990 informational submission which documents
compliance with this general standard.
A(2) See May 31, 1990 letter from Ernest R. Jones, Vice President
of Engineering, Central Tower, Inc. , documenting the
Project's compliance with Electronic Industries Association
Structural 5tandards for Steel Antenna Towers and Antenna
Supporting Structures (EIA-222-D) . As stated in Mr. Jones'
letter, the propased project design also meets Minnesota
State Building Code requirements.
A(3) Site plan as specified in Section 14 .4B of the Zoning
Ordinance. Refer to discussion below.
A(4) Written analysis of the impacts of the Project. Refer to
February 28, 1990 informational submission.
B( 1) "The tower shall not exceed 400 feet above grade or less as
authorized by law. " The submitted site plan shows that each
of the four proposed antenna will be 356 feet in height.
B(2) "Antenna and/or tower setbacks shall be such that the
distance from the base to the nearest property line or non-
owned structures is not less than the calculated structurai
collapse radius . " The submitted site plan shows the safety
setbacks in accardance with this Zoning Ordinance standard.
The collapse radius is confined within the limits of the
property.

confined to the property.
B(4) "Towers with antennae shall be designed to withstand a

B(5) "Antenna and metal towers shall be properly protected against

B(6) "The City shall determine whether self-supported towers or
whether towers supported by cables or guy wires serve to
protect the public health, safety, and welfare. " The Pro�ect
proposes guyed towers, rather than self-supported towers. As
noted on page 7, Tab 2 of the February 28, 1990 informational
submission, guyed antennae are generally preferred to self-
supporting antennae because they are less visible, require
less disruption of the environment, and are more secure
because of their multiple anchor points.
B(7) "All signal and remote control conductors of low energy
extending horizontally above the ground between the tower or
antenna and structure, or between towers, not buried
underground, shall be at least 12 feet above the ground at
all points. " The Project does not include above-ground
"signal and remote control conductors of low energy. " All
required radials will be buried underground.
B(8) "The base of the tower and all anchors shall be surrounded
with a minimum six-foot-high security fence with the
appropriate warning signs posted on all sides . " The
submitted site plan shows a cyclone fence six feet in height,
with a barbed wire top at a 45-degree angle around the base
of each antenna tower.

B(9) "No accessory structure or appurtenances shall be temporarily
or permanently affixed to AM radio antenna or supporting
towers except as required to accomplish the license service
for which the antenna or tower is authorized by the FCC, or
as may be approved by City Council. " As set forth in the
Draft Agreement, the economic benefits package conceptually
approved by the City Council includes, at the City's option,
Parker's construction and maintenance of a municipal two-way
radio communications antenna in or on the Project at no cost
to the City during the term of the Permit as defined in the
Draft Agreement. No other accessory structures or
appurtenances will be temporarily or permanently affixed to
the Project.
B( 10) "The economic benefits, incentives, and other advantages to
the City and community must outweigh any known or potential
negative aspects of the Project." The City Council's May 15,
1990 approval of the Zoning Ordinance text amendment included
conceptual approval of the economic benefits package proposed
by Parker. The conceptually approved economic benefits
package is set forth in pages 4-5 of the Draft Agreement.
B( 11) "The applicant shall furnish the City with copies of all
correspondence with the FCC and FAA regarding permit
performance of the AM radio antennae; or any matters
affecting public health, safety, and welfare. " This is a
_ prospective obligation which does not take effect until the
Project is constructed.
B(12} "If use of the tower is discontinued for a period of 12
months, or upon expiration of the Interim Use Permit, the AM
radio communications antenna, supporting towers, and all
above- and below-ground appurtenances shall be removed. "
This is a prospective obligation which does not take effect
until the occurrence of certain specified events .
B( 13) "The applicant shall be required to adequately maintain the
AM radio communications antennae, supporting towers, and
related accessory structures and property upon which [sic]
those facilities do not represent a hazard or nuisance to the
public, animal population, or natural environment." This is
a prospective obligation, which will continue throughout the
term of the Permit.
C "The applicant shall be responsible to investigate all and
remedy legitimate complaints regarding interference to
consumer electronic equipment alleged to be caused by signals

E ��The City Council may require an annual use fee in lieu of
taxes. " As described above, on May 15, 1990, the City
Council conceptually approved an economic benefits package.
The package included a direct cash payment to the City in the
amount of $2,470. 00 during each year of the Agreement. As �
presented to City staff and the City Council, the $2,470.00
is equal to the 1991 City portion of real estate taxes if the
entire Project site is classified commercial/industrial.
(The site is currently classified "Green Acres . ")

(b) Name of person preparing and presenting the site plan
information. Refer to February 28, 1990 informational
submission. The site plan submitted in support of the Permit
application was prepared by Arvid Elness Architects, Inc. ,
Butler North Building, Suite 200, 510 First Avenue North,
Minneapolis, Minnesota 55403 .
(c} Names of adjacent landowners or uses, streets, highways,
railroads, easements, or other landmarks . Refer to submitted
site plan, February 28, 1990 informational submission and
list of property owners previously prepared by City staff.
(d) Name and address of owner/developer, scale, north point,
date, and number of streets. Refer to February 28, 1990
informational submission and submitted site plan.
(e) Existing two-foot topography. As discussed in our May 21
meeting, we have submitted a USGS survey, in lieu of two-foot
topography.
(f) Existing drainage of the site in terms of direction and the
rate at which storm water flows. Not agplicable, pursuant to
our May 21 meeting.
(g) A description of soils . Pursuant to our May 21 meeting, to
be submitted with the application for building permit.
(h) The proposed size, alignment, height, and use of structures.

(i) A description of driveways, sidewalks, and parking
f acilities, including a description of the type and quantity
of surfacing materials. As shown on the submitted site plan,
access to the Project site will be provided from an existing
driveway to T.H.55 . No other impervious surface is proposed.
(j ) A grading plan at two-foot contour intervals . Not applicable
pursuant to our May 21 meeting.
(k) A scaled landscape plan and an explanation of any existing
vegetation that may be disturbed, removed, or replaced. The
City Council's May 15 approval of the Zoning Ordinance text
amendment included acceptance of Parker's praposal that
approximately one-half of the property remain undisturbed by
development or farming operations during the term of the
Permit„ except to the extent necessary to maintain and
operate the Project. This restriction on the use of the
property is set forth in page 5 of the Draft Agreement. The
requirement to provide a scaled landscape plan was deemed
inapplicable, at least for this Permit application, pursuant
to our May 21 meeting.
(1) A description of the availability and access to required
public utilities. The Project does not require public
utilities.
(m) A description of the method of waste treatment and an
analysis of the wastewater flows. Not applicable; refer to
February 28, 1990 informational submission.
(n) An erosion control plan. As discussed in our May 21 meeting,
construction of the Project does not require earth moving.
There will be no change in grades or the existing drainage
pattern. An erosion control plan has therefore not been
submitted. If, however, such a plan is required by the
Public Works Department as a condition to issuance of a
building permit, it will be provided by the applicant.
(o) A description of lot lighting or extraordinary illumination
projecting from a structure. Consistent with opinions
expressed at the April 16 neighborhood meeting and discussion
at the May 15 City Council meeting, nighttime lighting will
